About the single automated information system of technical inspection of vehicles

1. Approve the enclosed Rules of collection, processing, storage, transfer, use of information containing in the single automated information system of technical inspection of vehicles, and also ensuring access to this information.

2. Determine that the Ministry of Internal Affairs of the Russian Federation is the state customer of creation and operation of the single automated information system of technical inspection of vehicles and her operator, and also performs coordination of activities of bodies and organizations for use of the specified information system.

3. To the Ministry of Internal Affairs of the Russian Federation:

provide functioning of the single automated information system of technical inspection of vehicles since January 1, 2012;

approve the technical requirements providing connection of information systems of operators of technical inspection to the single automated information system of technical inspection of vehicles.

4. This resolution becomes effective since January 1, 2012.

Rules of collection, processing, storage, transfer, use of information containing in the single automated information system of technical inspection of vehicles, and also ensuring access to this information

1. These rules determine procedure for collection, processing, storage, transfer, use of information containing in the single automated information system of technical inspection of vehicles (further - information system), ensuring access to this information, and also the requirement to technological, program, linguistic and organizational means of information system.

2. Are subject to collection, processing, storage, transfer and use:

a) information on operators of technical inspection of vehicles (further - technical inspection) provided by part 2 of article 12 of the Federal law "About Technical Inspection of Vehicles and about Modification of Separate Legal Acts of the Russian Federation";

b) the data provided by part 3 of article 12 of the Federal law "About Technical Inspection of Vehicles and about Modification of Separate Legal Acts of the Russian Federation".

3. Collection, processing, storage, transfer and use of information and data, stipulated in Item 2 these rules, are performed for information support of the solution of the following tasks:

a) conclusion of the agreement of obligatory civil liability insurance of owners of vehicles;

b) providing the rights (legitimate interests) owners of vehicles or other persons on indemnification, caused to life, health or property owing to the road accidents which reasons the materiel failures of vehicles which are not revealed were (or not brought in the diagnostic card) by the operator of technical inspection;

c) implementation in accordance with the established procedure control of the insurers by professional association created according to the Federal Law "About Obligatory Civil Liability Insurance of Owners of Vehicles" (further - professional association of insurers), behind activities of operators of technical inspection.

4. Participants of information exchange in information system are the following bodies and the organizations:

a) the operator of information system - the Ministry of Internal Affairs of the Russian Federation;

b) professional association of insurers;

c) operators of technical inspection.

5. Information provided by the subitem "an" of Item 2 of these rules is placed in information system authorized persons of professional association of insurers by transfer of this information from the register of operators of technical inspection which is kept according to article 13 of the Federal law "About Technical Inspection of Vehicles and about Modification of Separate Legal Acts of the Russian Federation". Information transfer in information system is made within a day from the moment of entering of this information into the register of operators of technical inspection.

The data provided by the subitem "b" of Item 2 of these rules are placed authorized persons of operators of technical inspection directly in information system or are transferred from information system of the operator of technical inspection within a day from the moment of the end of carrying out technical inspection.

Transfer of data in information system is performed using means of the strengthened qualified digital signature.

6. The information access and to the data containing in information system is provided with the operator of information system round the clock with compliance with law of the Russian Federation about personal data protection. The specified access is provided using means of the strengthened qualified digital signature and is provided gratuitously.

7. Providing with certificates keys of the strengthened qualified digital signature for placement of information and data in information system and access to them is performed by the certification centers accredited by the Ministry of digital development, communication and mass communications of the Russian Federation according to the procedure, established by the Federal Law "About the Digital Signature".

8. Obtaining and use of information and the data containing in information system are performed in accordance with the legislation of the Russian Federation about information, information technologies and information security, including authorized persons:

a) professional association of insurers - for informing insurance companies in case of the conclusion of the agreement of obligatory civil liability insurance of owners of the vehicles, for check of compliance provided by the insurer of data and realization of the right of the recourse requirement in cases, the stipulated in Article 14 Federal Laws "About Obligatory Civil Liability Insurance of Owners of Vehicles" and also for implementation of powers, the stipulated in Clause 10 Federal Laws "About Technical Inspection of Vehicles and about Modification of Separate Legal Acts of the Russian Federation";

b) operators of technical inspection - in case of issue of the duplicate of the diagnostic card;

c) The Ministries of Internal Affairs of the Russian Federation - in case of investigation of the road accidents and application of measures of administrative influence according to the Russian Federation Code of Administrative Offences.
