About rate for services in the organization of buying up of precious metals and gemstones
Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 "About some questions of price regulation (rates) in the Republic of Belarus", subitem 4.52 of item 4 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585 "Questions of the Ministry of Finance of the Republic of Belarus", the Ministry of Finance of the Republic of Belarus DECIDES:
1. Determine that the rate for the services in the organization of buying up of precious metals at physical persons for republican state needs (further - services in buying up) rendered by the organizations authorized on implementation of this type of activity (further - the organizations), is created proceeding from the limiting standard rate of profitability in the amount of 6 percent to the costs for services in buying up determined by terms of the contract between the organizations and the Ministry of Finance.
2. Bring in the Instruction about procedure of payments for supply of precious metals to the State fund of precious metals and gemstones of the Republic of Belarus approved by the resolution of the Ministry of Finance of the Republic of Belarus of March 31, 2004 No. 59 (The national register of legal acts of the Republic of Belarus, 2004, No. 69, 8/10848; 2006, No. 104, 8/14558; 2007, No. 249, 8/17208), following changes and amendments:
2.1. state Items 1 and 2 in the following edition:
"1. This Instruction establishes procedure of payments of the Ministry of Finance of the Republic of Belarus (further - the Ministry of Finance) with the organizations for supply of precious metals to the State fund of precious metals and gemstones of the Republic of Belarus (further - State fund of Belarus), for services in the organization of buying up of precious metals at physical persons for republican state needs and procedure of payments of processors with suppliers of precious metals in the form of scrap and waste for the state needs.
2. For the purposes of this Instruction the following main terms and their determinations are used:
precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium, osmium) in the form of ingots, granules, hire, powder and other products, including the precious metals in products and scrap which are bought up at physical persons;
estimated price - the price of the precious metals (except precious metals in case of banking operations) received in State fund of Belarus;
the skupochny price - the price of the precious metals in products and scrap which are bought up by the organizations at physical persons (except purchase and sale of precious metals by the banking and non-bank credit and financial organizations in the form of measuring ingots and coins at physical persons);
weight in purity - the mass of chemically net precious metal in alloy;
raw materials - the scrap and waste containing precious metals;
services in buying up - services in the organization of buying up of precious metals at physical persons for republican state needs;
the organization - the legal entity or the individual entrepreneur performing supply of precious metals to State fund of Belarus and/or rendering services in buying up;
the processor - the legal entity having special permission (license) for the activities connected with precious metals and gemstones for collection and conversion of scrap and the waste containing them;
the supplier - the legal entity or the individual entrepreneur performing raw materials supply to the processor for the state needs.";
2.2. to add Item 5 after the words "and gemstones" with words ", and also on services in buying up";
2.3. to add the name of Chapter 2 with words "(EXCEPT FOR the ORGANIZATIONS RENDERING SERVICES IN BUYING UP)";
2.4. add the Instruction with Chapter of 21 following contents:
"CHAPTER 21 PROCEDURE OF PAYMENTS OF THE MINISTRY OF FINANCE WITH THE ORGANIZATIONS RENDERING SERVICES IN BUYING UP
241. Settlings with the organizations rendering services in buying up for the precious metals delivered in State fund of Belarus in products and scrap (further - values) are carried out at the skupochny prices established for date of buying up taking into account features of their carrying out in case of acceptance of the values on the weight and test provided by terms of the contract.
242. Money for buying up of values is transfered to the organizations by advance payments to account on accounting of budget funds proceeding from actually developed amount of the bought-up values for previous period and changes of level of the skupochny prices of precious metals based on calculation of these organizations.
243. Calculations for the rendered services in buying up are perfromed by money transfer on the current (settlement) account in the amount of 50 percent according to calculation of planned costs of the organizations for buying up for month. Final settlement on the rendered services in buying up in the agreement is made monthly based on the act of the performed works.".
3. Recognize invalid resolutions of the Ministry of Finance of the Republic of Belarus according to the list according to appendix.
4. This resolution becomes effective after its official publication.
