About the National commission performing state regulation in the sphere of power

In pursuance of the Laws of Ukraine "About natural monopolies" and "About power industry" I decide:

1. Form the National commission performing state regulation in the sphere of power.

2. Approve Regulations on the National commission performing state regulation in the sphere of power it (is applied).

3. Approve the extreme number of employees of the National commission performing state regulation in the sphere of power in number of 412 established posts.

4. This Decree becomes effective from the date of its publication.

Regulations on the National commission performing state regulation in the sphere of power

1. The national commission performing state regulation in the sphere of power (NKREZh) is the state collegiate organ subordinated to the President of Ukraine and accountable to the Verkhovna Rada of Ukraine.

NKRE is body of state regulation of activities in power.

2. NKRE in the activities is guided by the Constitution and the laws of Ukraine, acts and orders of the President of Ukraine, acts of the Cabinet of Ministers of Ukraine, other regulatory legal acts, and also this Provision.

3. The main objectives of NKRE are:

state regulation of activities of subjects of the natural monopolies and subjects of managing performing activities in the adjacent markets in spheres of power industry, heat supply regarding activities for production of heat energy on combined heat and power plants, thermal power plants, nuclear power plants and the cogeneration installations and installations with use nonconventional or renewable energy resources (further - the sphere of heat supply), in the natural gas markets, oil (passing) gas, gas (methane) of coal fields and gas of slate thicknesses (further - natural gas), oil and oil products;

assistance to development of the competition in the sphere of production and delivery of electrical energy, in the natural gas market, and also to creation of competitive environment in the sphere of heat supply;

ensuring carrying out price and tariff policy in the sphere of power and oil and gas complex;

assistance to effective functioning of the goods markets on the basis of balancing of interests of the state, subjects of natural monopolies and consumers of goods (services) which are made (are provided) by subjects of natural monopolies;

consumer protection of goods (services) in the market which is in condition of natural monopoly and in the adjacent markets in spheres of power industry, heat supply, and oil and gas complex.

4. NKRE according to the tasks assigned to it:

1) takes part in forming and ensuring realization of single state policy in the sphere of functioning of the markets of electrical energy and in the sphere of heat supply, the natural gas markets, oil and oil products;

2) generalizes practice of application of the legislation on the questions which are within its competence develops and makes in accordance with the established procedure offers concerning enhancement of the legislation;

3) is given to the President of Ukraine and the Verkhovna Rada of Ukraine by the annual report on results of the activities and will promulgate it on the NKRE website;

4) is performed by licensing of economic activity in spheres of power industry, heat supply and oil and gas complex, grants licenses for the right of implementation of activities on:

to production of electrical energy in the amounts exceeding the level established by licensed conditions;

to the combined production of heat and electrical energy;

transfers and deliveries of electrical energy;

to production of heat energy on combined heat and power plants and installations with use nonconventional or renewable energy resources;

to oil transportation, oil products bulk distribution line, transportation of natural, oil gas and gas (methane) of coal fields by pipelines and to their distribution;

to supply of natural gas, gas (methane) of coal fields on the regulated and unregulated rate;

to storage of natural gas, gas (methane) of coal fields in the amounts exceeding the level established by licensed conditions;

the instruction about procedure for issue of licenses for the right of implementation of economic activity in spheres of power industry and heat supply;

conditions and rules of implementation of licensed activities (daleelitsenzionny conditions);

procedures for control of observance of licensed conditions;

procedures (techniques) for pricing and rates for goods (services) which are made (are provided) by the subjects of natural monopolies and subjects performing activities in the adjacent markets in spheres of power industry, heat supply and oil and gas complex and methodology valuable, tariff setting;

instructions for use electrical energy;

instructions for use natural gas for legal entities;

procedure for indemnification as a result of provision abuse of regulations to the population of services in gas supply;

procedure for forming of investing programs;

rules of accession of the cogeneration installations to power networks;

procedure for holding the auction concerning access to handling capacity of interstate power networks of Ukraine;

rules of provision and coordination of specifications on connection to networks (constructions) electro-and power system;

procedure for access to the Single gas-transport system of Ukraine;

algorithm of distribution of means;

standard forms of economic agreements, including on:

- purchase sale of natural gas (between owners and suppliers of natural gas);

- transportation of natural gas by bulk distribution lines;

- storage (pumping, storage, selection) of natural gas;

- accession to gas networks;

- distribution of natural gas;

- supply of natural gas on the regulated rate;

indicators of reliability and commercial quality of provision of services by subjects of natural monopolies;

economic coefficients of standard technological costs of the electric power, and also criteria of determination of classes of the consumers of electrical energy differentiated on tension degrees;

Establishes 6):

prices (rates) for electrical energy, rates for its transfer and delivery;

the prices of commodity natural gas of own production for the subjects determined by the law;

retail prices on natural gas which is used for requirements of the population;
