The agreement between the Government of the Republic of Belarus and the Government of Turkmenistan on cooperation in the field of standardization, metrology, certification and accreditation

The government of the Republic of Belarus and the Government of Turkmenistan which are hereinafter referred to as with the Parties

for the purpose of creating favorable conditions for development of trade and the economic relations between the Republic of Belarus and Turkmenistan,

taking into account mutual desire to develop cooperation in the field of standardization, metrology, certification and accreditation on the basis of the principles and regulations accepted by International Organizations for Standardization

being guided by economic interests of the Republic of Belarus and Turkmenistan,

agreed as follows:

Article 1

The parties perform cooperation within this agreement and according to national legal systems of the states of the Parties.

Article 2

The parties recognize on mutually agreed terms the operating national systems of standardization, ensuring unity of measurements, certifications (confirmation of conformity) and accreditation.

The parties perform interaction and cooperation in the following directions:

development of legislative, regulating and methodical documents on standardization, metrology, certifications and accreditations;

unification of systems of certification (confirmation of conformity) and their reduction in compliance with the procedures and rules accepted by the international organizations;

monitoring procedure of quality and checks of compliance to the mandatory requirements of safety existing in the states of the Parties for mutually delivered goods;

creation, enhancement, checking and certification of the state standards of units of physical quantities;

development, production and application of standard samples of structure and properties of substances and materials, standard help data on physical constants and properties of substances and materials;

development of information activities in the field of standardization, metrology, certification and accreditation.

Article 3

The parties are recognized on mutually agreed terms:

the certification bodies accredited in national systems on certification (accreditation);

the certificates and marks of conformity issued by national authorities on certification or the certification bodies accredited in national systems on certification (accreditation);

certificates of approval like measuring instruments, results of their checking and calibration, and also the existing state standards of units of physical quantities;

results of testing of the test, testing and measuring laboratories accredited by the Parties, granted by them protocols and certificates;

certificates (certificates) on preparation and advanced training of personnel in the field of standardization, metrology, the certifications and accreditations issued by educational institutions (centers) performing training of specialists in these areas.

Article 4

Competent authorized bodies for the purposes of implementation of this agreement are:

in the Republic of Belarus - the State committee on standardization;

in Turkmenistan - the Main public service of Turkmenstandartlara.

In case of change of the name or function of the specified competent authorities of the Party timely notify on this each other through diplomatic channels.

Article 5

Regulating documents on standardization, metrology, certification and accreditation of one Party can become effective in the territory of the state of other Party according to requirements of the national legal system of the state of other Party.

Article 6

The parties if necessary provide on mutual basis regulating legal and information documentation on standardization, metrology, certification (confirmation of conformity) and accreditation on the conditions approved by the competent authorized bodies specified in Article 4 of this agreement.

Article 7

The parties shall cooperate by exchange of delegations of the specialists and teachers, provision of services of consulting nature based on experience of cooperation in standardization, metrology, certification and accreditation.

Article 8

The parties provide confidentiality of the obtained information on the works which are carried out within this agreement and the achieved scientific and technical results if by the transferring Party it is stipulated that these results have confidential nature.

The scientific and technical information obtained by one of the Parties during cooperation can be transferred to the third party only from written consent of the Party which provided this information.

Information on negotiations and results of sci-tech cooperation can be published according to the mutual arrangement of the Parties.

Article 9

Provisions of this agreement do not affect the rights and obligations of the Parties according to other international treaties which participants they are.

Article 10

Disagreements between the Parties concerning interpretation and application of provisions of this agreement will be solved by mutual consultations and negotiations.

Article 11

The parties use operating or develop necessary documents for implementation of provisions of this agreement.

Article 12

According to the mutual arrangement of the Parties changes and additions which are drawn up by the separate protocols which are integral part of this agreement and becoming effective according to the procedure, provided in Article 13 of this agreement can be made to this agreement.

Article 13

This agreement is signed for a period of five years and becomes effective from the date of receipt through diplomatic channels of the last written notice of accomplishment of the interstate procedures by the Parties necessary for entry into force of this Agreement. If one of the Parties in six months prior to the expiration of the specified term in writing will not notify on the intention to terminate this agreement, the Agreement is automatically prolonged for the subsequent five-year periods.

It is made in Ashgabat on March 17, 2011 in two authentic copies, everyone in the Belarusian, Turkmen and Russian languages, and all texts are equally authoritative.

In case of disagreements in interpretation of provisions of this agreement the advantage will be had by the text in Russian.
