The agreement on perpetuating of memory of courage and heroism of the people of the State Parties of the Commonwealth of Independent States in the Great Patriotic War of 1941-1945

The State Parties of the Commonwealth of Independent States which further are referred to as with the Parties

being guided by the conventional principles and rules of international law in the humanitarian area, the Geneva conventions of August 12, 1949 and Additional protocols to them of June 8, 1977, international treaties and the decisions made within the Commonwealth of Independent States (further - the CIS),

considering that the people of the State Parties of the CIS made decisive contribution to achievement of victory over fascism,

expressing the aspiration to keep and immortalize memory of courage and heroism of the people of the State Parties of the CIS in the Great Patriotic War of 1941-1945,

agreed as follows:

Article 1

For the purposes of this agreement the following terms mean:

memory perpetuating - the activities directed to preserving respect for the died military personnel, to their courage and heroism, directly connected with arrangement, preserving and content of military burials and military monuments, carrying out search works for the purpose of identification of unaccounted military burials and personal data of the died military personnel for forming on this basis of electronic databank and also implementation of the additional actions provided by the national legal system of the Parties;

the died military personnel is the citizens of the former USSR who were part of Armed Forces of the USSR, guerrilla groups and other underground anti-fascist forming, the home front workers who died and buried during fighting in the Great Patriotic War of 1941-1945 in captivity and also the dead as a result of their effects in hospitals, including in post-war time, in the territories of the Parties;

military burials - places of burial of the died military personnel, including individual and mass graves, cemeteries or sites of cemeteries, in the territories of the Parties;

military monuments - the memorial and other constructions, monuments, memorials, memorable places, the territories and objects connected with events of the Great Patriotic War of 1941-1945, located in the territories of the Parties;

unaccounted military burials - the places of burial (death) of the military personnel and civil victims of war which are not registered according to the national legal system of the Parties;

arrangement of military burials - designation of borders of places of burial and installation of memorable signs, gravestones, monuments or other memorial constructions or their recovery and repair, and also other necessary actions;

content of military burials and military monuments and leaving for nimiobespecheny safety of military burials and military monuments, their maintenance as appropriate;

search work - form of perpetuating of memory by identification of unaccounted military burials and unburied remains of the dead or missing persons in case of protection of the Fatherland for subsequent their burial, and also establishment of names of the dead and missing persons for perpetuating of their memory.

Article 2

The parties undertake agreed measures for further development of humanitarian cooperation in the field of perpetuating of memory of courage and heroism of the people of the State Parties of the CIS in the Great Patriotic War of 1941-1945 of willows these purposes:

perform actions for preserving memory of the died military personnel, content and arrangement of military burials and military monuments;

continue search work, provide burial of the died military personnel with military honors;

will organize illumination of the facts about immortal feat of the people of gosudarstvuchastnik of the CIS in the Great Patriotic War of 1941-1945;

enhance legal mechanisms of cooperation in implementation of this agreement.

Article 3

The parties in case of the solution of the questions connected with identification, accounting, arrangement and content of military burials and military monuments, and also exhumation of remains of the died military personnel and their reburial are guided by this agreement and the national legal system of the Party in the territory of which they are.

The parties when implementing actions for perpetuating of memory of courage and heroism of the people of the State Parties of the CIS in the Great Patriotic War of 19411945 years consider national, religious and other traditions of the people of the State Parties of the CIS, including texts on graves and military monuments.

Article 4

The parties provide protection and preserving the military burials and military monuments located in their territories.

Arrangement of again revealed military burials is made in the locations of remains or if it is impossible, in other places, worthy memories of the died military personnel.

Article 5

The parties promote identification, accounting, arrangement, content of the military burials and military monuments which are in their territories and care of them, and also the solution of the questions connected with exhumation, transfer of remains of the died military personnel and their reburial.

The parties inform each other on availability, the location, condition of military burials and military monuments and exchange personalized lists, other personal data about the died military personnel and the place of their burial, and also the other information connected with implementation of this agreement.

Article 6

The parties provide carrying out search work, burial of the died military personnel with military honors, undertake necessary measures for accounting of military burials in the territories.

The parties can perform joint actions for conducting search work, reburial of remains of the died military personnel, arrangement and content of military burials.

Financing of the joint events held within this agreement is performed according to additional arrangements of the Parties.

The parties provide according to the national legal system provision in free and unlimited use of land areas under the existing and again equipped military burials and military monuments.

The parties in case of mutual interest inform each other on arrangement of military burials on new land areas, carrying out reburials of remains of the died military personnel, transfer of military monuments.

Article 8

Exhumation of remains of the died military personnel for the purpose of their transfer to the concerned party is performed only according to the petition of the concerned party and with the consent of the Party in the territory of which there are remains, taking into account its national legal system.

Mutual notifications are transferred by the Parties through diplomatic channels.

Article 9

The parties foot the bill on content and care of the military burials and military monuments which are in their territories.
