1. Approve the enclosed Rules of rational use of lands of agricultural purpose.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of rational use of lands of agricultural purpose

1. General provisions

1. These rules of rational use of lands of agricultural purpose (further - Rules) are developed according to subitem 7-1) of Article 13 of the Land code of the Republic of Kazakhstan of June 20, 2003 and determine procedure for rational use of lands for agricultural purpose.

2. In these rules the following concepts are used:

1) rational use of lands of agricultural purpose - providing the parcels of land with owners and land users in production process of agricultural products of the maximum effect in implementation is more whole than land use taking into account protection of lands and optimum interaction with natural factors by the methods which are not leading to essential decrease in fertility of soils and meliorative condition of lands;

2) essential decrease in fertility of soils - decrease in indicators of fertility of the soils established when comparing results of two last agrochemical inspections;

3) degradation of lands of agricultural purpose - deterioration in properties of lands in agricultural purpose as a result of natural and anthropogenous impact, leading to decrease in the natural and economic importance;

4) the project of intraeconomic land management - the document determining and proving the organization and the device of the territory of farmlands on the near-term outlook, containing complex of the actions providing the most optimum use of each parcel of land taking into account its individual characteristics (fertility, technological properties, location, natural and historical, ecological and other features);

5) the process chart of cultivation of crops - the document reflecting procedure for carrying out technological transactions of cultivation of crops;

6) the book of history of fields and crop rotations - normative technical document having the advisory nature reflecting the planned crop rotation, the actual alternation of cultures and vapors and accomplishment of technological transactions in time and for the territories;

7) the passport of the parcel of land of agricultural purpose - the document reflecting actual state of the parcel of land, its identification characteristics, and also soil fertility of object of land use at the time of creation;

8) the central authorized body on management land the resursamigosudarstvenny body performing regulation in the field of land relations (daleetsentralny authorized body).

2. Procedure for rational use of lands for agricultural purpose

3. Rational use of lands of agricultural purpose includes:

1) maintenance and increase in certain level of productivity of the main crops, providing surplus of agricultural products;

2) observance of the established scheme of alternation of crops in crop rotations;

3) preserving and improvements of fertility and meliorative condition of soils;

4) prevention of disposal of agricultural holdings from economic circulation, non-admission of overgrowing of lands weed and wood and shrubby vegetation, and also litterings by household and production waste;

5) non-admission of burning of afterharvest remaining balance and by-products of crops on the processed sites of lands of agricultural purpose.

4. When using lands of agricultural purpose by owners of the parcels of land and land users events for improvement of lands, including obligatory are held:

1) holding agrochemical actions:

introduction of mineral and organic fertilizers according to scientifically based regulations;

observance of the established regulations of application of remedies of the plants and growth factors permitted to use in the territory of the Republic of Kazakhstan;

2) application of agrotechnical acceptances of preserving fertility of soils, including by observance of agrotechnological transactions according to the accepted process charts of cultivation of crops;

3) accomplishment of actions for protection of soils from degradation of lands of agricultural purpose according to projects of intraeconomic land management;

4) observance of crop rotations taking into account scientifically based schemes of rotation of cultures;

5) holding actions for seed farming and accomplishment of phytosanitary requirements for cultivation of crops in the way:

observance of evidence-based terms of strain changing and strain renovation of seeds of crops;

holding phytosanitary actions for disinfecting of seeds, fight against weed and quarantine vegetation, diseases and wreckers;

6) holding actions for flood of pastures;

7) observance of standard rates of loading of pasture of farm animals per acre the pastures approved by authorized state body in the field of development of agro-industrial complex.

5. Essential decrease in fertility and deterioration in meliorative condition of soils on the following indicators is not allowed:

1) decrease in the arable horizon (0-20 cm) of content of general humus more than for 5 percent, the weighted average content of easily hydrolyzable nitrogen, mobile phosphorus and exchange potassium - more than for 20 percent;

2) increase in acreage with very low and low supply of these elements more than for 10 percent;

3) pollution of lands of agricultural purpose pesticides and mineral fertilizers above threshold limit values;

4) reduction as a result of erosion of capacity of the upper humic horizon more than on 5 centimeters;

5) increase in soil layer up to 30 centimeters of the amount of toxic salts:

chloride more than on 0,4 of percent;

sulphatic more than on 0,8 of percent;

increase in the soil of alkalinity more than for 5 percent;

6) disposal of the parcel of land from agricultural use owing to overgrowing by weed vegetation (with number of weeds, above admissible economic threshold of injuriousness) or quarantine vegetation.

6. Determination of rational use of lands of agricultural purpose, at owners of the parcels of land and land users requires availability of the following documents:

1) the annual statement about financial productive activity of owners of the parcels of land and (or) land users;
