Approve the Procedure for determination of difference between the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" and the pension size from solidary system according to the Law of Ukraine "About obligatory national pension insurance" which is applied.

Procedure for determination of difference between the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" and the pension size from solidary system according to the Law of Ukraine "About obligatory national pension insurance"

1. This Procedure establishes the mechanism of determination of difference between the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" and the pension size from solidary system according to the Law of Ukraine "About obligatory national pension insurance".

2. For persons to whom pension is granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" the Pension fund of Ukraine determines the size of pension to which specified persons have the right from solidary system according to the Law of Ukraine "About obligatory national pension insurance" based on bodies of certificates of length of service, cash cover and other documents issued by military units, the territorial centers of completing and social support and other representatives on it.

At the same time the calculated pension size from solidary system cannot be less, than the minimum size of pension determined according to paragraph one of part one of article 28 of the Law of Ukraine "About obligatory national pension insurance", and no more than the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons".

3. For persons to whom pension is granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" till October 1, 2011 and who have pension entitlement according to the Law of Ukraine "About obligatory national pension insurance" the pension size from solidary system cannot be less, than the minimum size of pension determined according to paragraph one of part one of article 28 of the Law of Ukraine "About obligatory national pension insurance", and no more than the size of the pension granted according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons".

4. The difference between the size of the pension granted to person according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" and the size of the pension determined according to Item 2 or 3 of this Procedure is paid for the account of means of the government budget.
