Some questions of implementation of the Law of the Republic of Kazakhstan "About law-enforcement service"

1. Approve enclosed:

2) Rules of posting of law enforcement officers of the Republic of Kazakhstan to state bodies of the Republic of Kazakhstan and the international organizations.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of payment of immediate compensation in case of receipt of mutilation by the employee of law enforcement agency of the Republic of Kazakhstan, the public courier service during execution of service duties by it, and also in case of his death (death) to persons having the right to its obtaining

1. These rules are developed according to the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" and determines payment procedure of immediate compensation in case of receipt of mutilation by the employee of law enforcement agency of the Republic of Kazakhstan, the public courier service during execution of service duties by it, and also in case of his death (death) to persons having the right to its obtaining.

2. Payment of immediate compensation is made to the employee of law enforcement agency, public courier service or persons having the right to its obtaining in the following cases:

1) in case of death (death) of the employee of law enforcement agency, the public courier service on duty or within year after dismissal from service owing to the injury got in case of execution of service duties, obligatory for execution;

2) in case of establishment to the employee of law enforcement agency, public courier service of the disability which was caused mutilation (injury, wound, contusion), the diseases got on duty;

3) in case of receipt by the employee of law enforcement agency, the public courier service on duty the heavy or easy mutilation (injury, wound, contusion) which did not entail disability.

3. For receipt of immediate compensation the employee of law enforcement agency, public courier service or person having the right to its obtaining draw up and represent to financial division of law enforcement agency, the public courier service in the place of service of the employee (further - financial division) the following documents:

1) in case of death (death) of the employee during execution of service duties by him or the dead within year after dismissal from service owing to the injury got in case of execution of service duties, obligatory for execution:

the statement according to appendix 1 to these rules;

the copy of the death certificate certified notarially;

the copy of the conclusion from the place of service of the died (dead) about circumstances of death (death);

the certificate on the right to inheritance if addressed for payment is heir of the died (dead);

the certificate of financial division of monetary pay of the died (dead) on the date of death (death).

Upon death (death) of the employee who died before the expiration of one year owing to damage of health in case of approach of the events specified in the subitem 1) of Item 2 of these rules, besides, the conclusion of the military-medical commission is submitted (further - VVK);

2) in case of establishment to the employee of the disability which came from damage of health in case of approach of the events specified in the subitem 2) of Item 2 of these rules:

the statement according to appendix 1 to these rules;

the copy of the conclusion from the place of service of the employee about circumstances of receipt of mutilation (injury, wound, contusion), diseases;

the copy of the conclusion issued to VVK, confirming the fact of damage of health, certified by seal of this VVK;

the certificate of financial division of monetary pay of the employee on the date of receipt of mutilation (injury, wound, contusion), diseases;

copy of the certificate of disability;

3) in case of receipt of health by the employee of heavy or small damage in case of approach of the events specified in the subitem 3) of Item 2 of these rules:

the statement according to appendix 1 to these rules;

the copy of the conclusion from the place of service of the employee about circumstances of receipt of heavy or easy mutilation;

the certificate of treatment and prevention facility or VVK of weight of the received injury to health;

the certificate of financial division of monetary pay of the employee on the date of approach of event.

4. In case of the address of the employee of law enforcement agency, public courier service or persons having the right to immediate compensation with the statement for compensation payment the financial division checks completeness and correctness of document creation, the these rules specified in Item 3, and registers the application issued addressed to the head of law enforcement agency or the public courier service in the magazine of registration of statements on payment of immediate compensations in case of receipt of mutilation by the employee of law enforcement agency of the Republic of Kazakhstan, the public courier service during execution of service duties by it, and also in case of his death (death) to persons having the right to its obtaining according to appendix 2. In case of incomplete submission of the relevant documents specified in Item 3 of these rules, the statement is not subject to registration.
