About provision to some legal entities of the Grodno region of privileges on payment of customs duties and the value added tax
For the purpose of cost reduction on production of agricultural products I decide:
1. Exempt the legal entities of the Grodno region who are engaged in technological providing agricultural industry:
from payment of customs duties and the value added tax for the Republic of Belarus imported in 2006 on customs area agricultural machinery and spare part cases to it according to appendix for alienation to the legal entities performing activities for production of agricultural products, for the list determined by the Grodno regional executive committee for the purpose of use in agricultural production;
from calculation and the tax discharge on value added from turnovers on realization of this agricultural machinery and spare part cases to it.
2. Determine that conditions of provision of privileges to the legal entities specified in paragraph one of Item 1 of this Decree are:
reduction by them of the cost of agricultural machinery and spare part cases to it according to appendix for 23 percent;
accomplishment by them in 2006-2007 indicators on growth rates of proceeds from sales of products (goods, works, services) and profitability of the realized goods, the performed works and the rendered services finished in accordance with the established procedure.
In case of the inappropriate use of agricultural machinery and spare part cases to it specified in appendix, and (or) failure to carry out of conditions of provision of privilege according to part one of Item 2 of this Decree customs duties and the value added tax are collected according to the legislation.
3. Prohibit to the heads of the legal entities performing activities for production of agricultural products, called in the paragraph the second Item 1 of this Decree, alienation of agricultural machinery and spare part cases to it according to appendix before the expiration of terms of depreciation.
4. Confer the personal responsibility:
4.1. on heads of legal entities:
called in paragraph one of Item 1 of this Decree, - for ensuring accomplishment of the conditions determined in part one of Item 2 of this Decree;
specified in the paragraph the second Item 1 of this Decree, - for target use of agricultural machinery and spare part cases to it according to appendix;
4.2. on the chairman of the Grodno regional executive committee, the Minister of Agriculture and Food, the Deputy prime minister of the Republic of Belarus supervising questions of agricultural industry - for realization of provisions of Item 2 of this Decree.
5. To impose control over the implementation of this Decree on Council of Ministers of the Republic of Belarus and the Grodno regional executive committee.
6. This Decree becomes effective from the date of its signing.
