For the purpose of regulation of the legal relations between the operator of the transferring network, operators of distribution networks and final consumers of natural gas concerning quality of the delivered services, according to requirements of Art. 44 of the Natural Gas Act No. 123 of December 23, 2009 (Monitorul Oficial al Republicii Moldova, 2010, No. 23-24, the Art. 31) the administrative board of the National agency on regulation in power DECIDES:

1. Approve Regulations on service quality on distribution and supply of natural gas it (is applied).

2. To impose control over implementation of the approved Provision on department of monitoring of service quality.

Regulations on service quality on transfer and distribution of natural gas

Part 1. SCOPE

1. The regulations on service quality on transfer and distribution of natural gas (further the Provision) regulate service quality, rendered by the operator of network, establish the minimum measure values of quality and effect of non-compliance with these indicators by the operator of network.

2. Requirements of the Provision are applied to the legal relations between the operator of network and final consumers. In case of the final consumers having several places of consumption, the Provision is applied to each place of consumption separately.

3. Requirements of this provision are not applied:

a) in case of force majeur circumstances especially in case of the emergency situations established according to the legislation if these circumstances influence provision of services on transfer and distribution of natural gas. If force majeur circumstances arose during execution of already begun works, this Provision is not applicable for action of the mentioned obstacles;

b) in case of the actions performed by the third parties who can lead to violation of high-quality delivery of services by the operator of network;

Part 2. Main determinations

4. The main terms and determinations used in this Provision mean the following:

the announcement - bringing information to data of general public one of the following methods: by means of mass media (the press, radio stations and television broadcasting in the mentioned territory, other similar means), by means of placement of announcements on web страницe the operator of network, placement of announcements at the place of residence of consumers (at each entrance, in case of multi-storey houses; on boards of announcements of the city hall, in case of villages and communes);

accident - damage, destruction of the buildings and/or technical installations used on dangerous production objects, spontaneous explosions of flammable substances;

incident - damage of the technical installations used on hazardous production facility, variations from engineering procedure, violation of requirements of the normative and technical documents established by the law which regulate performance of works on hazardous production facility.

5. The operator of network shall provide supply of natural gas to final consumers reliably and continuously, according to the minimum measure values of quality established by this Provision. Proceeding from it the operator of network has the right to carry out the planned and unplanned works.

6. When carrying out the planned works:

1) duration of one planned break connected with accomplishment of complex of works (replacement of the general counter in the house or entrance, installation or reinstallation of the counter or copper by means of welding at the residential customer which are followed by interruption of supply of natural gas to consumers of all or part of the house), necessary for the problem resolution, connected taking into account natural gas or for installation of autonomous heating, shall not exceed 12 hours;

Duration of one planned break connected with accomplishment of complex of works (check of density, repair, replacement of one sector or element, recovery, upgrade, connection of object, etc.), gas networks of low and average pressure, necessary for reliable operation, cannot exceed 2):

a) 24 hours, in case of shutdown no more than 100 consumers;

b) 48 hours, in case of shutdown no more than 200 consumers;

c) 72 hours, in case of shutdown no more than 500 consumers;

d) 120 hours, in case of shutdown of 500 and more consumers;

3) duration of one planned break connected with accomplishment of complex of works (repair, replacement of one sector or the element, reconstruction, upgrade, connection of object, prevention of the transferring network of natural gas, check of density) necessary for reliable operation of network of natural gas of average or high pressure with delivery break for consumers from rural settlements / groups of settlements, will not exceed 120 hours;

If it becomes clear that work in case of which it is necessary to execute check of density of network of natural gas of average and high pressure requires more than 120 hours, representatives of operator of network will provide to the Agency before the expiration of 120 hours (from the moment of interruption) the report on the current situation which will contain the argumentation of need of prolongation of term of work.

7. When carrying out unplanned works:

Duration of one unplanned break connected with recovery from the accident or incident which occurred in network of natural gas of low and/or average pressure shall not exceed 1):
