About approval of the Regulations on the state regional inspectorates for nuclear and radiation safety of Gosatomregulirovaniya of Ukraine

According to the Regulations on the State inspection of nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 403, and the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 No. 563 "About approval of the Standard regulations on territorial authorities of the ministry and other central executive body" PRIKAZYVAYU:

1. Approve Regulations on the state regional inspectorates for nuclear and radiation safety of Gosatomregulirovaniya of Ukraine which are applied.

3. In accordance with the established procedure to provide to legal department (Matveev V. G.) submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of the order on the vice-chairman Makarovskaya O. A.

Regulations on the state regional inspectorates for nuclear and radiation safety of Gosatomregulirovaniya of Ukraine

1. The state regional inspectorates for nuclear and radiation safety of Gosatomregulirovaniya of Ukraine (further - State inspections) are formed in accordance with the established procedure as interregional (which powers extend to several administrative and territorial units) territorial authorities which submit to Gosatomregulirovaniya of Ukraine.

State inspections are independent of state bodies, organizations and officials which activities are connected with use of nuclear energy, from regional authorities and self-government, associations of citizens.

2. State inspections in the activities are guided by the Constitution and the laws of Ukraine, acts and orders of the President of Ukraine, acts of the Cabinet of Ministers of Ukraine, orders of the Prime Minister of Ukraine, Gosatomregulirovaniya's orders of Ukraine, orders of the Chairman Gosatomregulirovaniya of Ukraine and his deputies, acts of Council of Ministers of the Autonomous Republic of Crimea, the local state administrations, local government bodies.

3. The main objectives of State inspections is realization of the powers of Gosatomregulirovaniya of Ukraine provided by the Regulations on the State inspection of nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of 06.04.2011 No. 403, in the corresponding territory determined by Gosatomregulirovaniya of Ukraine according to the regional principle of embracing of subjects of activities in the sphere of use of nuclear energy.

4. State inspections according to the tasks assigned to them:

4.1 perform licensing of activities for use of sources of ionizing radiation in the procedure established by the legislation;

4.2 perform assessment of safety of sources of ionizing radiation;

4.3 participate in registration of sources of ionizing radiation;

4.4 exercise the state supervision of observance:

legislations, regulations, rules and standards on nuclear and radiation safety, physical protection of nuclear materials, radioactive waste, other sources of ionizing radiation, accounting and control of nuclear materials and other sources of ionizing radiation;

conditions of the issued documents of allowing nature for implementation of activities for production and use of sources of ionizing radiation, to conversion of uranium ores, transportation of radioactive materials, conversion, storage of radioactive waste, on use of the lands and reservoirs located in the sanitary protection zone of the object intended for the treatment of radioactive waste, uranium object;

4.5 perform state examination of nuclear and radiation safety of sources of ionizing radiation, physical protection of sources of ionizing radiation within the powers;

4.6 exercise within the powers supervision of implementation of actions directed to accident prevention in production process and uses of sources of ionizing radiation and on the objects intended for the treatment of radioactive waste, uranium objects on ensuring readiness of the companies, organizations and organizations for mitigation of consequences of such accidents;

4.7 exercise supervision of office investigation of radiation accidents and record such accidents in the corresponding territory, except radiation accidents on the NPP;

4.8 apply within the powers enforcement powers to legal entities and physical persons in case of violation of the legislation, conditions of the issued documents of allowing nature, regulations, rules and standards by them on nuclear and radiation safety, requirements of physical protection of nuclear materials, radioactive waste, other sources of ionizing radiation, accounting and control of nuclear materials and other sources of ionizing radiation;

4.9 send within the competence to licensees, their officials, heads of local executive bodies, local government bodies instructions, obligatory for accomplishment, about elimination of violations and shortcomings of the sphere of safety of use of nuclear energy;

4.10 apply within the competence in accordance with the established procedure financial sanctions against the companies, organizations and the organizations, other subjects of business activity in case of violation of the law, conditions of the issued documents of allowing nature, regulations, rules and standards on nuclear and radiation safety, requirements of physical protection of nuclear materials, radioactive waste, other sources of ionizing radiation, accounting and control of nuclear materials and other sources of ionizing radiation;

4.11 attract in the procedure established by the legislation within the competence to responsibility of persons guilty of violation of the law, conditions of the issued documents of allowing nature, regulations, rules and standards on nuclear and radiation safety, requirements of physical protection of nuclear materials, radioactive waste, other sources of ionizing radiation, accounting and control of nuclear materials and other sources of ionizing radiation;

4.12 send within the competence to licensees, owners or heads of the companies, organizations and organizations of idea of discrepancy of individuals to posts;

4.13 stop action or cancel licenses to use of sources of ionizing radiation, submit to Gosatomregulirovaniya's management of Ukraine proposals on stop of action or cancellation of licenses for implementation of separate types of activity in the sphere of use of nuclear energy in case of violation by the licensee of their conditions, regulations and rules of nuclear and radiation safety;
