About approval of the Procedure for issue of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, equipment of the increased danger

According to article 21 of the Law of Ukraine "About labor protection" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for issue of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, equipment of the increased danger which is applied.

2. Recognize invalid:

Procedure for issue of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, equipment of the increased danger

1. This Procedure determines the procedure of issue or refusal in issue, renewals, Gostrud's cancellations and her territorial authorities of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, equipment of the increased danger (further - permission).

2. Action of this Procedure does not extend to the state rescue services and their forming which in accordance with the established procedure underwent certification, and also on bodies of military management, military units, military educational institutions, organizations and the organizations of Armed Forces, other military forming formed according to the laws and in which hired employees are not involved in performance of works of the increased danger and/or operation (application) of machines, mechanisms, equipment of the increased danger.

3. In this Procedure terms are used in such value:

experimental testimony - the document which is constituted by the expert organization for results of conducting examination of condition of labor protection and safety of industrial production of the subject of managing for the form developed Gostruda and approved in accordance with the established procedure contains information on compliance (discrepancy) of object of examination to requirements of the legislation concerning labor protection and industrial safety and based on which the decision concerning issue of permission is made;

the expert organizations - the expert and technical centers which belong to the sphere of management of Gostrud or the independent expert organizations which provide scientific and technical support of the state supervision in the sphere of industrial safety and labor protection and have the confirmed competence for inspection activities in the sphere of labor protection according to the legislation;

operation of machines, mechanisms, equipment of the increased danger - the long-term period of use during production process of machines, mechanisms, equipment of the increased danger taking into account their operational characteristics;

use of machines, mechanisms, equipment of the increased danger - use of machines, mechanisms, equipment of the increased danger to destination according to results of assessment of their compliance to requirements of the legislation concerning labor protection and industrial safety;

scientific and technical support of the state supervision in the sphere of industrial safety and labor protection - the technical, expert activities for the directions developed Gostruda and approved in accordance with the established procedure, directed to increase in efficiency of control and observation activities in the specified sphere.

Other terms are used in the value given in the Laws of Ukraine "About labor protection" and "About authorization system in the sphere of economic activity".

4. Requirements to the expert organizations are developed Gostruda and affirm in coordination with the Antimonopoly Committee in accordance with the established procedure.

5. The payment for conducting examination of condition of labor protection and safety of industrial production of the subject of managing is determined by the expert organizations according to the Procedure for limiting determination of the size of rate for conducting examination of security status of industrial production of the subject of managing approved by the resolution of the Cabinet of Ministers of Ukraine of November 4, 2009 No. 1251 (The Official Bulletin of Ukraine, 2009, No. 91, the Art. 3079).

6. Permission in form according to appendix 1 is issued:

to the employer - on performance of works of the increased danger, work types of the increased danger specified in the Section A of the list (appendix 2), or on operation of the machines, mechanisms, the equipment of the increased danger specified in group A of the list of machines, mechanisms, the equipment of the increased danger approved by the resolution of the Cabinet of Ministers of Ukraine of February 3, 2021 No. 77;

to the producer or the supplier of machines, mechanisms, the equipment of the increased danger (further - the producer or the supplier) - on use of the machines, mechanisms, the equipment of the increased danger specified in group A of the list of machines, mechanisms, the equipment of the increased danger approved by the resolution of the Cabinet of Ministers of Ukraine of February 3, 2021 No. 77, if other form of assessment of its compliance which is the mandatory requirement to it is not established by technical regulations.

7. Permission to performance of works of the increased danger and to operation (application) of machines, mechanisms, the equipment of the increased danger is issued by territorial authority of Gostrud in the place of state registration of the legal entity or physical person entrepreneur.

8. No. 927 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 10.10.2012

9. For receipt of permission the employer, the producer or the supplier gives personally, through the Portal of electronic services of Ministry of Economics person authorized by it or sends by mail to territorial authority of Gostrud or to the administrator of the center of provision of administrative services in paper form or electronically through the Single state web portal of electronic services, including through the information system of Gostrud integrated with it, the statement in form according to appendix 4, to which is attached:
