About measures for further enhancement of activities of the Ministry of Justice of the Republic of Uzbekistan

For the purpose of further enhancement of activities of the Ministry of Justice of the Republic of Uzbekistan, increase in efficiency of its activities for ensuring strict observance of legality in law-enforcement practice and rule-making activities, strengthenings of its role in system of law enforcement agencies, consecutive realization of provisions of the Concept of further deepening of democratic reforms and forming of civil society in the country:

1. Approve Regulations on the Ministry of Justice of the Republic of Uzbekistan according to appendix No. 1.

Determine that the Ministry of Justice submits to the Cabinet of Ministers of the Republic of Uzbekistan, and on the single questions of activities provided by acts of the legislation - directly to the President of the Republic of Uzbekistan.

2. The main objectives and activities of the Ministry of Justice of the Republic of Uzbekistan to determine:

consecutive realization of single state policy in the field of rule-making and the law-enforcement practice aimed at providing reliable protection of constitutional rights and freedoms of citizens, rule of law, legality in the sphere of public and state construction;

development of offers on consecutive enhancement of the legislation of democratic, social and economic, social and political reforms; identification in the current legislation of "white spots", and also the provisions and regulations creating conditions for manifestations of corruption, making of other offenses in system of the government and management;

ensuring effective control behind observance in activities of state bodies, the law-enforcement and controlling structures in the center and on places of human rights and freedoms;

implementation of organization-legal measures for consecutive realization of the state policy directed to further strengthening of independence of judicial authority, unconditional execution of court resolutions, comprehensive material and financial provision of activity of the courts;

law enforcement, enhancement of organization-legal bases of functioning of non-state non-profit organizations, other institutes of civil society, their active participation in protection of interests of various segments of the population, program implementation of social and economic, humanitarian development, democratic updating and upgrade of the country; carrying out system monitoring of observance the requirement of the legislation in activities of the international and foreign non-state non-profit organizations registered in the country;

implementation of measures for ensuring reliable protection of the rights and legitimate interests of subjects of small business, private entrepreneurship, foreign investors; to strengthening of contractual and legal discipline, rendering efficient legal assistance to business entities in case of the conclusion and execution of agreements, to non-admission of illegal intervention in their financial and economic activities, creations of bureaucratic barriers and obstacles in the sphere of development of small business, private entrepreneurship, farms;

ensuring effective functioning of system of the state regulation directed to increase in efficiency of activities of notariate, legal profession, bodies of ZAGS and other structures performing legal servicing of citizens and legal entities;

providing together with the relevant state bodies of reliable legal protection of interests of the Republic of Uzbekistan in the field of the international legal relations;

implementation of effective coordination of work of state bodies, public associations in the sphere of the legal promotion and education directed to increase in sense of justice, legal culture of the population and strengthening of legality in society;

control and coordination of activities for preparation, retraining, advanced training of legal personnel taking into account modern requirements and democratization processes of the sphere of the state and public construction.

3. Determine that for the purpose of accomplishment of the assigned tasks the Ministry of Justice:

performs on system basis of check, studying of rule-making practice of bodies of the public and economic board, public authorities on places;

performs on system basis studying of law-enforcement practice of state bodies, public authorities on places, the law-enforcement and controlling structures for the purpose of reliable protection of the rights and legitimate interests of subjects of entrepreneurship, foreign investors and the companies with foreign investments;

carries out legal expertize, registration of regulatory legal acts of the ministries, state committees and departments;

requests and receives from state governing bodies, the law-enforcement and controlling structures, other organizations, and also their officials the documents, statistical and other data, analytical materials necessary for accomplishment of the tasks facing the ministry;

addresses on the questions entering its competence, courts with statements and claims for the benefit of the state, legal entities and physical persons without payment of the state fee;

performs systematization, codification of acts of the legislation, provides broad informing the public on the measures undertaken in the field of enhancement of rule-making, law-enforcement activities, deepening of the judicial and legal reforms performed in the country.

4. Approve organizational structure of system of the Ministry of Justice of the Republic of Uzbekistan, structure of central office of the Ministry of Justice of the Republic of Uzbekistan, the Ministry of Justice of the Republic of Karakalpakstan, standard structure of justice departments of areas and Tashkent and extreme number of managerial personnel of the Ministry of Justice of the Republic of Karakalpakstan, justice departments of areas and Tashkent according to appendices No. No. 2-6.

Establish the extreme number of managerial personnel of central office of the Ministry of Justice of the Republic of Uzbekistan in number of 160 units financed from the Government budget.

Grant to the Minister of Justice of the Republic of Uzbekistan the right to make changes to structure of central office of the Ministry of Justice of the Republic of Uzbekistan and territorial authorities of justice within the established total number.

5. Accept the offer of the Ministry of Justice of the Republic of Uzbekistan on formation of Interdepartmental council on coordination of work of state bodies on legal promotion and education (further - Interdepartmental council) in structure according to appendix No. 7.
