DECISION OF THE COMMISSION OF CUSTOM UNION

About adoption of the technical regulation of the Customs union "Safety of highways"

(as amended on 12-10-2015)

According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Commission of the Customs union (further - the Commission) solved:

1. Accept the technical regulation of the Customs union "Safety of highways" (TR CU 014/2011) (is applied).

2. Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 18.09.2012 No. 159

3. Establish:

3.1. The technical regulation of the Customs union "Safety of highways" (further - the Technical regulation) becomes effective since February 15, 2015;

3.2. The documents on assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union, issued or accepted concerning the road-building materials and products which are objects of technical regulation of the Technical regulation (further - products), about day of entry into force of the Technical regulation, are valid before the termination of term of their action, but no later than September 1, 2016. The specified documents issued or accepted about day of official publication of this Decision are valid before the termination of term of their action.

From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union is not allowed.

Renewal of the project documentation developed and approved before entry into force of the Technical regulation is not required;

3.3. Till September 1, 2016 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted about day of entry into force of the Technical regulation is allowed;

3.3-1. Till September 1, 2016 production and release into the stream of commerce on customs area of the Eurasian Economic Union of products which were not subject about day of entry into force of the Technical regulation to obligatory assessment of conformity to the mandatory requirements established by the acts of the Eurasian economic commission entering the right of the Eurasian Economic Union or the legislation of state member of the Eurasian Economic Union without documents on obligatory assessment of conformity and not marked national mark of conformity (market access mark) is allowed;

3.3-2. Till September 1, 2016 development and approval of the project documentation based on regulatory legal acts of the state members of the Eurasian Economic Union adopted before entry into force of the Technical regulation is allowed;

3.4. The product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision is allowed during expiration date (service life) of products established according to the legislation of state member of the Customs union.

4. From the effective date the separate technical regulation of the Customs union on construction materials and products Item 14 of Article 3, Item 24 of Article 5, Article 6 and appendix 1 to the Technical regulation are not applied to road-building materials.

5. To the secretariat of the Commission jointly with the Parties to prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure.

6. To provide to the Russian side with participation of the Parties based on monitoring of results of application of standards preparation of offers on updating of lists of the standards specified in Item 2 of this Decision and representation at least once a year from the date of entry into force of the Technical regulation in the Secretariat of the Commission for approval by the Commission in accordance with the established procedure.

6. To the parties:

6.1. to date of the introduction of the Technical regulation in force to determine the state control (supervision) bodies responsible for implementation of the state control (supervision) of observance of requirements of the Technical regulation and to inform on it the Commission;

6.2. provide carrying out the state control (supervision) of observance of requirements of the Technical regulation from the date of the introduction it in force.

7. This Decision becomes effective in 15 days from the date of its official publication if during this term of the Party do not declare suspension of the approval of the Technical regulation.

Preface

This technical regulation of the Customs union is developed based on the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.

Requirements of this technical regulation are harmonized with the European Agreement on the international highways (SMA) of UNECE, Geneva, on November 15, 1975, the Convention on traffic of UNECE, Vienna, on November 8, 1968; The Convention on route signs and signals of UNECE, Vienna, on November 8, 1968, the European Union directive 2004/54/EU of April 29 2004, the Agreement on masses and dimensions of the vehicles performing interstate transportations across highways of the State Parties of the Commonwealth of Independent States of June 4, 1999.

Article 1. Scope

1. This technical regulation is accepted for the purpose of providing on blueprint stages, constructions, reconstruction, capital repairs and operation of highways:

a) protection of life and (or) health of citizens, property;

b) environmental protections, animals and plants;

c) preventions of the actions misleading consumers;

d) ensuring energy efficiency and resource-saving.

2. This technical regulation establishes minimum necessary safety requirements to highways and processes of their designing, construction, reconstruction, capital repairs and operation, and also form and evaluation procedure of compliance to these requirements.

3. The legal basis of technical regulation in the field of safety of highways during the designing, construction, reconstruction, capital repairs and their operation are the international agreements and legal acts of state members of the Customs union on technical regulation in the field of highways, this technical regulation.

4. Objects of technical regulation of this technical regulation are again under construction, reconstructed, capitally repaired and operated highways public and road constructions on them, including arrangement elements (for objects of road and roadside service only their arrangement is regulated), and also the related design processes, constructions, reconstruction, capital repairs and operation of highways and road constructions and the applied road-building materials and products.

5. Requirements of this technical regulation do not extend to the highways which are not relating to highways public such as the highways of industrial, construction, forest and other production enterprises, roads intended for temporary use the roads located in special exclusion zones and constructed for needs of defense or is exclusive in the sports purposes.
