Procedure for use of the means transfered to account the Public migratory service of the Azerbaijan Republic, collected by bodies of migration from application of penalty based on the Code of the Azerbaijan Republic about administrative offenses in connection with offenses in the migratory sphere

1. General provisions

1.1. This Procedure is developed according to Article 90-1 "Regulations on service in migratory bodies", No. 930-IIIQ approved by the Law of the Azerbaijan Republic of December 4, 2009, and determines procedure for use of the special means transferred into the special treasurer account of the Public migratory service of the Azerbaijan Republic (further - the special treasurer account), collected by bodies of migration from application of penalty based on the Code of the Azerbaijan Republic about administrative offenses in connection with offenses in the sphere of the migratory legislation.

1.2. Special means are used for the purpose of strengthening of social security and improvement of material security of employees of migratory bodies.

1.3. For the purpose of collection and proper use of special means in the State treasurer agency of the Ministry of Finance of the Azerbaijan Republic the special treasurer account for the Public migratory service of the Azerbaijan Republic is opened.

1.4. The source of financing of the special treasurer account is constituted by the funds raised by bodies of migration from application of penalty based on the Code of the Azerbaijan Republic about administrative offenses in connection with offenses in the sphere of the migratory legislation.

1.5. special means are paid by charge in the form of the allowance to monthly official pay rate of staff of bodies of migration.

1.6. According to this Procedure the allowance to monthly official pay rate is not included in the expenses on providing provided in article 1.0.5 of the Law of the Azerbaijan Republic "About work pensions".

2. Procedure for use of special means

2.1. Implementation of assignments and the related supervision are provided with the Public migratory service of the Azerbaijan Republic and the Ministry of Finance of the Azerbaijan Republic.

2.2. The report on use of special means is prepared by the Public migratory service of the Azerbaijan Republic and at the scheduled time it is submitted in the Ministry of Finance of the Azerbaijan Republic.

2.3. The other questions connected with use of means are performed according to the approved resolution of the Cabinet of Ministers of the Azerbaijan Republic of March 10, 1997 No. 16 "Regulations on extrabudgetary funds of the companies and the organizations financed from the government budget of the Azerbaijan Republic".

3. Procedure for charge of allowances to monthly official pay rate

3.1. Payment of allowances to monthly official pay rate is performed once a month, in the next month for every month.

3.2. For the purpose of payment of the allowance to monthly official pay rate for every month the complete allowance is charged. For calculation of the allowance of 25 percent of the funds raised by bodies of migration from application of penalty based on the Code of the Azerbaijan Republic about administrative offenses is divided into the actual number of employees of bodies of migration in this month.

3.3. The allowance is established by mathematical rounding to one hundredth part after integer and estimated on the following formula:
