About local representative bodies of the government

This Law determines the legal basis of activities, operating procedure and powers of local representative bodies of the government, their members and officials.

Chapter I. General provisions

Article 1. Representative bodies of local government

According to the Constitution of Turkmenistan local representative bodies of the government are formed: in the welayat - velayatsky Hulk of maslakhata, the city with the welayat rights - city Hulk of maslakhata (further velayatsky Hulk of maslakhata), the etrap - etrapsky Hulk of maslakhata, the city with the etrap rights - city Hulk of maslakhata (further - etrapsky, city Hulk of maslakhata).

Article 2. Legislation on representative bodies of local government

The legislation of Turkmenistan on local representative bodies of the government is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.

2. The meeting Hulk of maslakhata is competent if at it there are at least two thirds of the determined number of his members.

3. Representatives of state bodies and local government bodies, political parties, public associations, mass media, and also citizens can be invited to meeting Hulk of maslakhata in the procedure established by it.

4. The first meeting Hulk of maslakhata of new convocation is convened by the chairman Hulk of maslakhata of former convocation and held within two weeks after elections.

Article 9. Resolutions Hulk of maslakhata

1. Hulk of maslakhata within the powers accepts resolutions.

2. Resolutions Hulk of maslakhata are accepted by open voting by a simple majority vote from the determined number of his members.

Article 10. Change or cancellation of resolutions Hulk of maslakhata

Change or cancellation of the resolutions Hulk of maslakhata which are not corresponding to the Constitution and the laws of Turkmenistan, acts of the President of Turkmenistan, Majlis of Turkmenistan, the Cabinet of Ministers of Turkmenistan and other regulatory legal acts of Turkmenistan is made according to the legislation of Turkmenistan.

1. The chairman Hulk of maslakhata, his deputy are elected from members Hulk of maslakhata at meeting Hulk of maslakhata by open voting by a simple majority vote from the determined number of his members.

1) according to Hulk Maslakhata's proposal of Turkmenistan;

2) according to the offer at least one third of members Hulk of maslakhata.

The resolution on dismissal of the chairman Hulk of maslakhata, his deputy is accepted by open voting by a simple majority vote from the determined number of his members.

3. The bases for dismissal of the chairman Hulk maslakhata, his deputy are:

1) improper execution of the obligations;

2) making of the act not compatible to their position;

3) impossibility of performance of obligations for health reasons;

4) personal request;

5) exit from among members Hulk of maslakhata;

6) other bases determined by the legislation of Turkmenistan.

Chapter III. Competence Hulk of maslakhata, chairman Hulk of maslakhata, his deputy

Article 12. Competence Hulk of maslakhata

1. Hulk maslakhata are within the competence:

1) ensuring accomplishment of the Constitution and laws of Turkmenistan, Hulk Maslakhata's acts of Turkmenistan, President of Turkmenistan, Majlis of Turkmenistan, Cabinet of Ministers of Turkmenistan, velayatsky and corresponding Hulk of maslakhata;

2) participation in the organization of accomplishment of programs of economic, social and cultural development in the corresponding territory;
