The convention on standards of democratic elections, the voting rights and freedoms in the State Parties of the Commonwealth of Independent States

The State Parties of this Convention (further - the Parties),

proceeding from the purposes and principles of the Charter of the Commonwealth of Independent States,

confirming value of the Universal Declaration of Human Rights and International Covenant on Civil and Political Rights, determined that powers on the power shall be based on the declaration of will of the people expressed in genuine and periodic elections and also documents of Organization for Security and Cooperation in Europe, Council of Europe, other international organizations on carrying out free and fair elections,

being convinced that recognition, observance and protection of rights and freedoms of man and citizen, development and enhancement of democratic institutes of national declaration of will, procedures of their realization according to the conventional principles and rules of international law on the basis of the national Constitution and legal acts is the purpose and obligation of the constitutional state, one of the integral conditions of public stability and further strengthening of cooperation between the states for implementation and protection of the ideals and the principles which are their general democratic property

aiming to promote approval and enhancement of democratic systems of representative board, democratic traditions of declaration of will of the people in case of elections, implementation of other forms of democracy on the basis of supremacy of law and the law, the maximum accounting of national and historical traditions,

being convinced that elections are one of political and legal instruments of stable civil society and sustainable development of the state,

recognizing the value of the national experience of legal regulation of elections accumulated by the State Parties of the Commonwealth of Independent States, guarantees of the voting rights and freedoms of man and citizen

the performed determination to provide combination of the conventional standards of elections and national regulations of regulation of elections, the voting rights and freedoms of man and citizen, and also guarantees of their implementation and protection, to put into practice provisions of this Convention on the basis of the Constitution and the national legal system and the corresponding state policy,

aiming to fix guarantees for the organization of public and international observation of elections in the State Parties of this Convention,

agreed as follows:

Article 1 Standards of democratic elections

1. Democratic elections are one of the highest direct expressions of the power and will of the people, basis of the elected public authorities and local self-government, other bodies of national (national) representation, elected officials.

2. The parties are recognized that standards of democratic elections are: the right of the citizen to choose and be elected to public authorities, local government bodies, to other bodies of national (national) representation; the principles of frequency and obligation, justice, authenticity and freedom of elections on the basis of general equal suffrage in case of secret vote providing freedom of declaration of will of voters; open and public nature of elections; implementation of judicial and other protection of the voting rights and freedoms of man and citizen, public and international observation of elections; sales warranties of the voting rights and freedoms of participants of the electoral process.

3. The right of the citizen to choose and be elected is enshrined in the Constitution and (or) the laws, and the procedure for its implementation is determined by the laws and other regulatory legal acts. Legislative regulation of the right to choose and be elected, procedure for elections (electoral systems), and equally in restriction of the voting rights and freedoms shall not limit or cancel the conventional rights and freedoms of man and citizen and the constitutional and (or) legislative guarantees of their realization or have discrimination character.

4. Appointment, preparation and elections is performed on the basis of the Constitution and the laws.

5. The elected persons who received the necessary poll determined by the Constitution, the law enter position according to the procedure and the terms established by the laws thereby acknowledging the responsibility to voters, and remain in position before the expiration of the powers or before their termination otherwise which is regulated by the Constitution, the laws according to democratic parliamentary and constitutional processes.
