About approval of the Regulations on rules of inclusion of legal acts in the State register of legal acts of the Azerbaijan Republic

Being guided by Item 32 of article 109 of the Constitution of the Azerbaijan Republic I decide:

1. Approve Regulations on rules of inclusion of legal acts in the State register of legal acts of the Azerbaijan Republic it (is applied).

2. Ministry of Justice of the Azerbaijan Republic:

2.1. provide the beginning of functioning of electronic version of the State register of legal acts of the Azerbaijan Republic since November 1, 2011;

2.2. prior to functioning of the State register of legal acts of the Azerbaijan Republic to provide the publication of the legal acts included in the State register in the specially allotted Section information the Internet of resource of the ministry;

2.3. provide introduction within one year into the State register of legal acts of the Azerbaijan Republic of acts of Millie of Majlis of the Azerbaijan Republic, the President of the Azerbaijan Republic and the Cabinet of Ministers of the Azerbaijan Republic accepted before entry into force of this Decree and to inform on it the President of the Azerbaijan Republic;

2.4. once in three months to provide to the President of the Azerbaijan Republic statistical information on legal acts which entering into the State Register it is refused, and about the bodies which accepted them.

3. Recommend Millie to Majlis of the Azerbaijan Republic and the Constitutional Court of the Azerbaijan Republic, charge to the Cabinet of Ministers of the Azerbaijan Republic and Administration of the President of the Azerbaijan Republic, based on requests of the Ministry of Justice of the Azerbaijan Republic to represent to the Ministry of Justice of the Azerbaijan Republic the corresponding legal acts which are not entered in the State Register of legal acts of the Azerbaijan Republic in the form of the valid copy of the original on paper and at the same time in the form of text files on electronic media.

4. Charge to the Cabinet of Ministers of the Azerbaijan Republic:

4.1. provide allocation within fifteen days of the financial resources necessary to start functioning, forming and maintaining electronic version of the State register of legal acts of the Azerbaijan Republic;

4.2. within three months to determine procedure for official publication of acts of the Cabinet of Ministers of the Azerbaijan Republic, having approved it with the President of the Azerbaijan Republic.

Regulations on rules of inclusion of legal acts in the State register of legal acts of the Azerbaijan Republic

1. General provisions

1.1. This Provision determines rules of inclusion of legal acts in the State register of legal acts of the Azerbaijan Republic (further - the State Register) based on the Constitutional Law of the Azerbaijan Republic "About regulatory legal acts".

1.2. The state Register is the state information resource reflecting the regulatory legal acts adopted in the Azerbaijan Republic, acts of normative nature, Millie's resolution of Majlis of the Azerbaijan Republic, the order of the President of the Azerbaijan Republic and the Cabinet of Ministers of the Azerbaijan Republic, and also their details.

1.3. Entering of legal acts into the State Register is the activities connected with entering of the adopted legal acts into the State Register according to the procedure, determined in this Provision, and also with modification of earlier adopted legal acts and recognition their invalid.

1.4. The state Register is kept by the Ministry of Justice of the Azerbaijan Republic (further - the Ministry of Justice).

1.5. The Ministry of Justice provides forming, maintaining, management, integrity, permanent openness for general use by means of corresponding information the Internet of resource and protection of the State Register.

1.6. Legal acts state and municipalities of domicile of the Nakhchivan Autonomous Republic are entered in the State register of legal acts of the Nakhchivan Autonomous Republic. The state register of legal acts of the Nakhchivan Autonomous Republic is kept by the Ministry of Justice of the Nakhchivan Autonomous Republic and is component of the State Register. In electronic version of the State Register there shall be separate transition to the State register of legal acts of the Nakhchivan Autonomous Republic.

1.7. The state Register is kept in electronic option by means of registration information system and in paper option in the book of the State Register in state language of the Azerbaijan Republic. In the presence of the translation into other language of the act approved according to the procedure, determined for adoption of this act by the body (organization) which adopted the legal act the legal act in the corresponding language also is entered in the State Register.

1.8. The state Register is kept according to the structure determined in article 80 of the Constitutional Law of the Azerbaijan Republic "About regulatory legal acts".

1.9. The legal acts provided for inclusion in the State Register shall conform to requirements of the Constitutional Law of the Azerbaijan Republic "About regulatory legal acts", and also the rules established concerning development and acceptance of separate legal acts.

1.10. Not the acts of normative nature adopted for the purpose of implementation of specific (one-time) organizational, control or administrative actions or intended for cases of one-time application are entered in the State Register, and the acts of normative nature reflecting obligatory rules of conduct for limited circle of subjects and intended for repeated application are introduced.

1.11. Regulatory legal acts of the central executive bodies and acts of normative nature become effective from the date of their publication in electronic version of the State Register if later term of their entry into force is not provided in these acts. The solution of the Constitutional Court of the Azerbaijan Republic on use of analogy of the right or analogy of the law becomes effective from the date of the publication in electronic version of the State Register.

1.12. The separate provisions of legal acts which are the state secret are not published in electronic version of the State Register and the collection of the State Register.

1.13. Except for legal acts which separate provisions are the state secret are not allowed the publication in electronic version of the State Register and the collection of the State Register of incomplete legal acts.

1.14. Texts of the legal acts included in the State Register together with texts officially of the published legal acts are considered as official source for the reference.
