THE AGREEMENT BETWEEN THE MINISTRY OF ECONOMICS OF THE REPUBLIC OF BELARUS AND THE MINISTRY OF THE PROPERTY RELATIONS OF THE RUSSIAN FEDERATION ON THE COOPERATION IN THE FIELD OF MANAGEMENT OF THE STATE-OWNED PROPERTY AND ITS PRIVATIZATION

of October 23, 2003

The Ministry of Economics of the Republic of Belarus and the Ministry of the property relations of the Russian Federation and (further - the Parties),

being guided by the Agreement on creation of the Union State of December 8, 1999 and the Action program of the Republic of Belarus and the Russian Federation on realization of provisions of the Agreement on creation of the Union State of December 8, 1999,

aiming at establishment of mutually advantageous communications within the competence, proceeding from the states conferred by the legislation to the Parties of powers,

intending to promote creation of the conditions favoring to mutual participation of the commercial organizations (business entities) of two countries in privatization of state-owned property on the basis of broad exchange of information in the field of management of state-owned property and its privatization and mutual enhancement of the regulatory base

agreed as follows:

Article 1

The parties provide implementation of mutual exchange of information about the developed and become effective regulatory legal acts concerning privatization and management of state-owned property, including lease, concession, pledge, bankruptcy, trust management and others, according to the legislation of the states of the Parties.

Article 2

The parties, taking into account mutual interest, and being guided by the national legal system, promote creation of legal entities of various patterns of ownership.

Article 3

For the purpose of implementation of this agreement of the Party exchange necessary information on the privatization course, conditions and terms of sale of property, including shares of the joint-stock companies which are of mutual interest. Carrying out experience exchange on the organization of such actions and development of normative and methodical documentation can be performed by holding of conferences, seminars and working meetings.

Article 4

The parties shall take all measures for unconditional accomplishment of the assumed liabilities depending on them under this agreement and, if necessary, jointly consider the Agreements of problem arising in implementation process.

Article 5

The parties create bilateral working group for implementation of this agreement.

Article 6

The parties not transfer to the third parties information, documentation and other data having confidential nature.

Article 7

Disputes and disagreements which can arise in case of application of provisions of this agreement are solved by consultations and negotiations between the Parties.

Article 8

The agreement can be changed and added according to the mutual arrangement of the Parties which is drawn up by the protocols which are integral part of this Agreement.

Article 9

This agreement becomes effective from the date of its signing and is effective till December 31, 2005.

It is made in Moscow on October 23, 2003 in duplicate in the Belarusian and Russian languages, and both texts are equally authoritative.
