The agreement between the Government of the Republic of Belarus and the Cabinet of Ministers of Ukraine on cooperation in the field of tourism

The government of the Republic of Belarus and the Cabinet of Ministers of Ukraine which are hereinafter referred to as with the Parties

being guided by mutual desire to develop cooperation in the field of tourism between the states of the Parties,

recognizing importance of bilateral ties in the field of tourism and considering them as essential and necessary factor of social and economic development, strengthening of friendship and deepening of mutual understanding between the people of the states of the Parties,

wishing to create the legal basis for further development of tourist exchanges on the basis of equality and mutual advantage,

agreed about the following:

Article 1

The parties will strengthen and encourage cooperation in the field of tourism between the states of the Parties according to national legal systems of the states of the Parties, and also international treaties which participants are the states of the Parties, including this agreement.

Article 2

The parties will promote establishment and expansion of business contacts between the Belarusian and Ukrainian tourism organizations of different patterns of ownership participating in development of the international tourism, performing capital investments in the sphere of tourism, and also joint activities for servicing of tourists.

The parties will encourage both group, and individual tourism in its various forms, participation on mutual basis in exhibitions, fairs, conferences, the congresses and seminars, other international tourist actions.

The parties do not bear responsibility according to the obligations arising from contracts between the subjects of the states of the Parties listed in part one of this Article.

Article 3

The parties according to national legal systems of the states of the Parties will aim at simplification of the boundary, customs and other procedures connected with tourist trips of citizens of the state of one Party and persons who are constantly living in its territory, on the territory of the state of other Party.

Article 4

The parties will perform necessary actions for mutual safety of tourists who travel to the state of one Party from the state of other Party, according to international standards.

Article 5

The parties according to national legal systems of the states of the Parties will exchange statistical data, information on the legislation, scientific research in the field of tourism, and also about tourist resources of the states of the Parties, condition of the tourist market, reference and promotional materials on tourism.

Article 6

The parties will promote informing citizens of the states and persons who constantly live in their territory, leaving in tourist trips on the territory of the state of other Party, about the national legal system of the state of other Party regulating procedure for entrance, stay and departure of foreign citizens.

Article 7

The parties will give each other help in preparation of professional personnel for the sphere of tourism, and also to exchange scientists, representatives of mass media and experts in the field of tourism, will promote comprehensive contacts and joint organization activity of the states of the Parties performing researches in the field of tourism.

Article 8

The parties will cooperate within the World Tourism Organization (WTO), and also other international organizations in the field of tourism which members are the states of the Parties.

Article 9

The bodies responsible for implementation of this agreement, are:

from the Belarusian Side - the Ministry of Sport and tourism of the Republic of Belarus,

from the Ukrainian Side - the Ministry of Culture and tourism of Ukraine.

Article 10

The parties independently incur all expenses connected with implementation of this agreement.

Article 11

By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are integral parts of this agreement can be made to this agreement.

Article 12

This agreement becomes effective from the date of its signing.

The agreement is signed for a period of five years and will be prolonged automatically for the subsequent five-year terms if any of the Parties at least in six months prior to the expiration of the next five-year term does not send the written notice to other Party about the intention to terminate the Agreement.

The matters of argument connected using or interpretation of provisions of this agreement, are permitted by consultations and negotiations.

Cancellation of this agreement will not influence project implementation and the programs in the field of tourism adopted during action of this agreement except cases when the Parties agree about other.

It is made in Minsk on February 16, 2006 in two authentic copies, everyone in the Russian and Ukrainian languages, and all texts are equally authoritative.
