according to the Decision of Council of heads of states of the Commonwealth of Independent States on agreed measures for reconstruction and preserving general scientific space within the Commonwealth of Independent States of February 10, 1995,
being effective in the direction of consecutive realization of provisions of the Agreement on creation of Economic union of September 24, 1993,
considering necessary to take urgent measures for support of science, preserving and development of scientific and technological capacities of the Parties as most important condition of ensuring national security,
recognizing need of consolidation of these potentials for the purpose of the most complete and effective use for spiritual and economic development of the Parties in modern conditions,
developing the efforts made within earlier signed agreements on cooperation of the State Parties of the Commonwealth of Independent States in the field of science and technologies including:
about sci-tech cooperation within the State Parties of the Commonwealth of Independent States of March 13, 1992;
about direct scientific and technical connections within the Commonwealth of Independent States of March 13, 1992;
about cooperation in the field of preparation scientific and research and educational personnel and nostrification of documents on their qualification within the Commonwealth of Independent States of March 13, 1992;
about joint use of scientific and technical objects within the Commonwealth of Independent States of March 13, 1992;
about carrying out coordinated policy in the field of standardization, metrology and certification of March 13, 1992;
about interstate exchange of scientific and technical information of June 26, 1992 and others,
agreed as follows:
1. The parties will undertake jointly and separately agreed measures on creation of general scientific and technological space within the Commonwealth of Independent States. Forming of general scientific and technological space will be performed step by step in interrelation with development of integration processes in the Commonwealth in general.
2. In this agreement the scientific and technological space of the state is meant as the circle of ensuring functioning and development of science and technologies which is characterized by the single state scientific and technological policy relying on adequate regulatory framework and including the list of national priorities, management systems scientific technology development, financings, preparation and certification of scientific and engineering personnel, scientific and technical information, standardization, metrology, certification, protection of the rights to results of scientific and technical activities.
The general scientific and technological space of the State Parties of the Commonwealth is meant as the environment which is characterized by carrying out coordinated policy by these states in the priority directions which are of mutual interest in development of science and technology, harmonization of content its separate component and the corresponding national regulatory frameworks. The general scientific and technological space provides also to each State Party of the Agreement of possibility of use of scientific and technological spaces, the markets of scientific and technological goods and services of other agreement parties, according to national legal systems of the Parties.
For the purpose of creation of general scientific and technological space and in development of the arrangements fixed in the Agreement on sci-tech cooperation within the State Parties of the Commonwealth of Independent States of March 13, 1992, the Parties will provide interaction in the solution of the specific objectives directed on:
creation of the effective organizational mechanism of coordination of integration processes in the field of science and technologies;
development of financial and economic mechanisms and system of mutual calculations and payments for support of joint scientific research;
cancellation within the Commonwealth of customs restrictions in case of exchange of results of scientific research, experimental both prototypes and technologies, transfer of scientific literature, scientific and technical information, devices, the experimental equipment, reactants and other materials for research works;
providing open entry to open scientific and technical information and the data which do not have commercial nature;
mutual provision of national treatment for the research organizations, scientists and specialists of the State Parties of this agreement in the markets of scientific and technological goods and services, and also with participation in tenders on open state orders.
The main sales term of this agreement of the Party consider the recognition of priority of the scientific and technological sphere by all State Parties of this agreement which is expressed in need of the accelerated forming of regulatory framework of its support and development and also corresponding to this priority of the guaranteed level of public financing of this sphere.
As the first-priority measures directed to creation of general scientific and technological space, the Parties are considered necessary to prepare and sign the following interstate and intergovernmental agreements:
about forming and the status of interstate scientific and scientific and technological programs and projects;
about creation and the status of the international scientific organizations;
about organization and the status of the international research centers;
about procedure for attraction to accomplishment of national scientific and technological programs of the research centers, scientists and specialists of the State Parties of the Commonwealth;
about procedure for currency-free exchange of scientific publications and the periodical press, translated foreign scientific and scientific and pedagogical literature;
about creation of the interlibrary subscription.
1. For implementation of this agreement of the Party create Interstate council on cooperation in scientific and technical and innovative spheres (NTI MS) performing the activities according to the Regulations on it which are integral part of this agreement.
2. The MS of NTI develops questions of forming of interstate scientific and technical and innovative space, determines the priority directions and forms of cooperation in scientific and technical and innovative spheres, accepts within the competence, and in necessary cases prepares and submits in accordance with the established procedure for consideration of heads of states and heads of governments of the State Parties of the CIS draft documents connected with the solution of tasks of interstate scientific and technical and innovative cooperation.
