ORDER OF THE MINISTER OF TRANSPORT AND COMMUNICATIONS OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of write-off of air vehicles

(as amended on 05-07-2019)

According to the subitem 13) Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft", PRIKAZYVAYU:

1. Approve the enclosed Rules of write-off of air vehicles.

3. To provide to committee of civil aviation of the Ministry of Transport and Communications of the Republic of Kazakhstan (Adimold R. O.) in the procedure established by the legislation of the Republic of Kazakhstan submission of this order to the Ministry of Justice of the Republic of Kazakhstan for state registration.

4. To impose control of execution of this order on the vice-Minister of Transport and Communications of the Republic of Kazakhstan Bekturov A. G.

5. This order becomes effective after ten calendar days after its first official publication.

Rules of write-off of air vehicles

Chapter 1. General provisions

1. Rules of write-off of air vehicles (further - Rules) are developed according to requirements of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft.

2. Rules establish procedure for write-off of the civil air vehicles registered in the State register of civil air vehicles of the Republic of Kazakhstan.

3. The civil air vehicles which fulfilled the appointed calendar time, the established resource or became useless for the reason are subject to write-off:

1) physical wear;

2) the aviation incident which led to violation of strength properties of the air vehicle;

3) detection of constructive and production shortcomings which can lead to aviation incident if their elimination is impossible or economically is not reasonable;

4) destructions of the air vehicle;

5) impossibility of aircraft salvage from the place of forced landing.

4. The aircraft engines, components, details and aggregates removed from the air vehicle and having expiration date are subject to recovery and after the made repairs are preserved and used in further operation.

5. The aircraft engines, details, aggregates and components which are not subject to recovery razukomplektovyvatsya and given in secondary raw materials.

Chapter 2. Procedure for write-off of air vehicles

6. The following procedure for write-off of the air vehicle is established:

1) creation of the commission on write-off of the air vehicle;

2) assessment of the air vehicle which is subject to write-off;

3) preparation of the act on write-off of the air vehicle.

7. For write-off of the air vehicle by the operator (owner) of the air vehicle the commission on write-off of the air vehicle is created (further - the commission). Service employees to functions of which are part of the commission questions belong:

1) maintenance, repair and operation of the air vehicle;

2) material and financial provision;

3) engineering supervision and quality system.

If the air vehicle which is subject to write-off is in repair agency, then in repair the companies the commission on write-off of the air vehicle and which part the representative of the operator (owner) of the air vehicle or its authorized representative is is created.

8. The commission carries out assessment of the air vehicle:

1) establishes the reasons of write-off of the air vehicle, according to Item 3 of these rules;

2) performs inspection of the air vehicle, studies the operating documentation (forms, passports, labels);

3) is established by unfitness of the air vehicle to further operation;

4) is determined by possibility of further use or not use of components, nodes, details from the written-off air vehicle.

9. By results of work of the commission the Statement on write-off of the air vehicle in form according to appendix 1 to these rules is drawn up.

10. For determination of possibility of using of aircraft engines and components from the written off air vehicle by the commission carries out the analysis of their technical condition and the analysis of the operating documentation. For refining of assessment of their technical condition, their dismantle and the direction on check in laboratory or manufacturer is made (by agreement).

11. Based on the analysis the Sheet of assessment of technical condition according to appendix 2 to these rules which is attached to the Act on write-off is constituted.

12. In case of write-off of the air vehicle the Act on write-off and the Sheet of assessment of technical condition are constituted in duplicate. The first copy remains at the operator (owner) of the air vehicle, the second copy goes to authorized organization in the field of civil aviation (further - authorized organization) and is one of documents for exception of the air vehicle of the state register of civil air vehicles of the Republic of Kazakhstan.

13. The act on the write-off of the air vehicle and the Sheet of assessment of technical condition signed by the commission and approved by the operator (owner) of the air vehicle with original certificates about state registration of the air vehicle and the Airworthiness certificate of the air vehicle go within 10 (ten) calendar days from the date of signing of the act for write-off in authorized organization.

14. In case of write-off of the air vehicle owing to premature depreciation, breaches of conditions of operation, damage materials of investigation of the commission are applied to the Act on write-off.

15. The authorized organization, based on the submitted documents, makes the decision on write-off of the air vehicle and in 22 (twenty two) working days, from the moment of receipt of documents, excludes the air vehicle from the State register of civil air vehicles of the Republic of Kazakhstan. To the operator (owner) of the air vehicle the Certificate on exception of the air vehicle of the state register of civil air vehicles of the Republic of Kazakhstan in form of the Minister of investments and development of the Republic of Kazakhstan approved by the order of June 30, 2017 No. 409 "About approval of Rules of state registration of civil air vehicles of the Republic of Kazakhstan, the rights to them, and also the document forms certifying the rights to them" is granted (registered in the Register of state registration of regulatory legal acts at No. 15553).

16. The operator (owner) of the air vehicle starts dekitting and reduction of the air vehicle in non-flying condition what within 30 (thirty) calendar days notifies authorized organization with provision of the corresponding photos or other documents confirming destruction of the air vehicle on. Also all technical documentation is liable to destruction.
