AGREEMENT

of May 26, 1995

About creation of Council for cultural state cooperation - members of the Commonwealth of Independent States

(Protocol as amended of 18.10.2011)

The governments of the State Parties of this agreement, further - the Parties,

aiming at further development of cultural cooperation between the states,

realizing that development of such cooperation is equitable to radical interests of the people of their states, promotes goal achievement, proclaimed the Charter of the UN, the Helsinki Final act of the Organization for Security and Co-operation in Europe, fundamental documents of the Commonwealth of Independent States,

believing that development of cultural cooperation between the states is impossible without attraction to their joint operation of the international and national non-governmental organizations, associations and associations interested in questions sack tours

proceeding from provisions of the Agreement on cooperation in the field of culture signed on May 15, 1992 in Tashkent

agreed as follows:

Article 1

For the purpose of carrying out by the Parties the coordinated policy in the field of culture as it is determined in Article 1 of the Agreement on cooperation in the field of culture signed on May 15, 1992 in Tashkent Council for cultural state cooperation - members of the Commonwealth of Independent States, further - Council is created. Approve Regulations on Council which are the integral component of this agreement it (is applied).

Article 2

Council approves the Rules of procedure and Regulations of work.

Article 3

Nothing in this agreement shall be understood as limiting the rights of the Parties in the field of cultural cooperation.

Article 4

This agreement becomes effective from the date of signing, and for the states which legislation requires accomplishment of the interstate procedures necessary for its introduction in force, - from the date of delivery of the relevant documents to depositary.

Article 5

This agreement voids for the Party which sent to depositary the notification on the desire to leave the Agreement, in six months after the date of receipt by depositary of the adequate notice.

Article 6

Depositary of this agreement is the Executive secretariat of the Commonwealth of Independent States.

It is made in the city of Minsk on May 26, 1995 in one authentic copy in Russian. The authentic copy is stored in the Executive secretariat of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.

Regulations on Council for cultural state cooperation - members of the Commonwealth of Independent States

I. General provisions

1.1. Council on cultural state cooperation - members of the Commonwealth of Independent States (further - Council) is body of industry cooperation of the CIS and is intended for ensuring coordination of interaction and the solution of questions in the field of culture within the competence.

1.2. In the activities Council is guided by the Charter of the Commonwealth of Independent States, agreements and decisions made within the CIS and this Provision.

1.3. Council is urged to organize and coordinate execution of the decisions concerning competence of Council, accepted by Council of heads of states, Council of Heads of Government, Council of Foreign Ministers and CIS Economic Council.

1.4. Council interacts with Executive committee of the CIS, other bodies of the CIS, if necessary - with the secretariats of other international organizations, and also public authorities of the states - members of the CIS.

1.5. Council is accountable in the activities to Council of CIS Heads of Government.

1.6. The report for work of Council is considered in accordance with the established procedure at meetings of Council of Heads of Government, Council of Foreign Ministers, CIS Economic Council, Council of permanent plenipotentiaries of the State Parties of the Commonwealth under authorized and other bodies of the Commonwealth, and also the Commission on economic problems under CIS Economic Council.

1.7. Council annually provides information on the activities in Executive committee of the CIS.

1.8. Working language of Council is Russian.

II. Functions of Council

Council within the competence performs the following functions:

2.1. Consideration of questions of cultural state cooperation - members of the CIS.

2.2. Studying of opportunities of further development of cultural cooperation, including interaction of the government and public institutions performing cultural ties within the CIS, studying according to interest of the State Parties of the CIS of processes and tendencies in the field of culture within the CIS.

2.3. Project development of multi-lateral international treaties, comprehensive programs and other documents on the questions which are within the competence of Council, holding joint actions in the field of culture.

2.4. Assistance to public authorities in the field of culture, to public organizations of the State Parties of the CIS in development of coordinated actions in the field of culture.

III. Rights of Council

Council has the right:

3.1. Request in accordance with the established procedure in the State Parties of the CIS and bodies of industry cooperation of the CIS information on the questions entering its competence.

3.2. Submit in accordance with the established procedure offers for consideration of Council of heads of states and Council of CIS Heads of Government.

3.3. Create constants or temporary work groups for preparation of draft documents on the questions which are within the competence of Council.

3.4. Within the competence to make decisions and recommendations.

3.5. Resolve other issues entering its competence.

IV. Procedure for forming of Council

4.1. Members of council are heads of public authorities in the field of culture of the State Parties of the CIS.

In case of the direction on meeting of Council of persons, replacement members of council, their powers shall be confirmed in writing.

4.2. Each state has one voice in Council.

4.3. The head of the Secretariat of Council, and also the representative of Executive committee of the CIS is part of Council with the right of advisory vote.

4.4. Representatives of the international and national public associations of cultural figures and art of the State Parties of the CIS can participate in meeting of Council with the right of advisory vote.

4.5. Representatives of the states which are not part of the CIS can participate in meeting of Council.
