About adoption of the technical regulation of the Customs union "About safety of the low-voltage equipment"

(as amended on 25-10-2016)

According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Commission of the Customs union (further - the Commission) solved:

1. Accept the technical regulation of the Customs union "About safety of the low-voltage equipment" (TR CU 00_/2011) (is applied).

2. Approve:

2.1. The list of standards as a result of which application on voluntary basis observance of requirements of the technical regulation of the Customs union "About safety of the low-voltage equipment" is provided (TR CU 00_/2011) (is applied);

2.2. The list of the standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation of the Customs union "About safety of the low-voltage equipment" (TR CU 00_/2011) and implementation of assessment of conformity of objects of technical regulation it (is applied).

3. Establish:

3.1. the technical regulation of the Customs union "About safety of the low-voltage equipment" (further - the Technical regulation) becomes effective on February 15, 2013;

3.2. the documents on assessment (confirmation) of compliance to the mandatory requirements established by the legislation of state members of the Customs union or regulatory legal acts of the Customs union, issued or accepted concerning products which are object of technical regulation of the Technical regulation (further - products), about day of entry into force of the Technical regulation, are valid before the termination of term of their action, but no later than March 15, 2015, except for such documents issued or accepted about day of official publication of this Decision which are valid before the termination of term of their action.

From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by the legislation of state members of the Customs union or regulatory legal acts of the Customs union is not allowed;

3.3. till March 15, 2015 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by the legislation of the state members of the Customs union or regulatory legal acts of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted about day of entry into force of the Technical regulation is allowed.

The specified products are marked by national mark of conformity (market access mark) according to the legislation of state members of the Customs union or with the Decision of the Commission of September 20, 2010 No. 386.

Marking of such products single market circulation mark of state members of the Customs union is not allowed.

3.3.1. Till November 15, 2013 production and release into the stream of commerce on customs area of the Customs union of products which were not subject about day of entry into force of the Technical regulation to obligatory assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union without documents on obligatory assessment (confirmation) of compliance and not marked national mark of conformity (market access mark) is allowed;

3.4. the product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision, and also products specified in subitem 3.3.1 of this Decision is allowed during the service life of products established according to the legislation of state members of the Customs union.

4. To the secretariat of the Commission jointly with the Parties to prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure.

5. To provide to the Belarusian Side with participation of the Parties based on monitoring of results of application of standards preparation of offers on updating of Lists of the standards specified in Item 2 of this Decision and representation at least once a year from the date of entry into force of the Technical regulation in the Secretariat of the Commission for approval in accordance with the established procedure.

6. To the parties:

6.1. about day of entry into force of the Technical regulation to determine the state control (supervision) bodies responsible for implementation of the state control (supervision) of observance of requirements of the Technical regulation and to inform on it the Commission;

6.2. from the date of entry into force of the Technical regulation to provide carrying out the state control (supervision) of observance of requirements of the Technical regulation taking into account subitems 3.2 – 3.4 presents of the Decision.

On safety of low-voltage equipment

Preface

1. This technical regulation of the Customs union is developed according to the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.

2. This technical regulation of the Customs union is developed for the purpose of establishment on single customs area of the Customs union single obligatory for application and execution of requirements to the low-voltage equipment, ensuring free movement of the low-voltage equipment released on single customs area of the Customs union.

3. If concerning the low-voltage equipment other technical regulations of the Customs union, Eurasian economic community (further - EurAsEC) establishing requirements to the low-voltage equipment are accepted, then the low-voltage equipment shall conform to requirements of these technical regulations of the Customs union, EurAsEC which action extends to it.

Article 1. Scope

1. This technical regulation of the Customs union extends to the low-voltage equipment released on single customs area of the Customs union.

The electric equipment, held for use belongs to the low-voltage equipment to which action of this technical regulation of the Customs union extends with rated voltage from 50 to 1000 V (inclusive) of alternating current and from 75 to 1500 V (inclusive) of direct current.

2. This technical regulation of the Customs union does not extend on:

the electric equipment intended for work in the explosive environment;

products of medical appointment;

the electric equipment of elevators and cargo elevators (except electrical machines);

electric equipment of defense appointment;

actuation devices for pasturable fences;

the electric equipment, held for use on air, water, land and underground transport;

the electric equipment intended for security systems of reactor installations of nuclear power plants.

3. This technical regulation of the Customs union establishes requirements to the low-voltage equipment for the purpose of protection of life and health of the person, property, and also the prevention of actions, the misleading consumers (users) concerning its appointment and safety.

Article 2. Determinations

In this technical regulation of the Customs union the following terms and their determinations are applied:

the manufacturer - the legal entity or physical person as the individual entrepreneur performing on its own behalf production and (or) realization of the low-voltage equipment and responsible for its compliance to safety requirements of the technical regulation of the Customs union;

the importer - the resident of state member of the Customs union who signed with the nonresident of state members of the Customs union the agreement in foreign trade on transfer of the low-voltage equipment enables the realization of this equipment and bears responsibility for its compliance to safety requirements of this technical regulation of the Customs union;

the rated voltage of the low-voltage equipment - the entrance and (or) output tension (the range of tension) of the low-voltage equipment specified by the manufacturer on this equipment and in operational documents;

the address of the low-voltage equipment in the market - processes of transition of the low-voltage equipment from the manufacturer to the consumer (user) on single customs area of the Customs union which there undergoes the low-voltage equipment after completion of its production;

application to destination - use of the low-voltage equipment according to the appointment specified by the manufacturer on this equipment and (or) in operational documents;

person authorized by the manufacturer - the legal entity or physical person registered in accordance with the established procedure by state member of the Customs union which is determined by the manufacturer based on the contract with it for implementation of actions from his name in case of confirmation of conformity and placement of products on single customs area of the Customs union, and also for assignment of responsibility for discrepancy of products to requirements of the technical regulation of the Customs union;

the electric equipment - the equipment intended for development, transformation, transfer, distribution and use of electrical energy, including, as for direct use, and built in machines, mechanisms, devices, devices and other products.

Article 3. Rules of market circulation

1. The low-voltage equipment is issued in market circulation in case of its compliance to this technical regulation of the Customs union, and also to other technical regulations of the Customs union, EurAsEC which action extends to it and provided that it underwent confirmation of conformity according to Article 7 of this technical regulation of the Customs union, and also according to other technical regulations of the Customs union, EurAsEC which action extends to it.

2. The low-voltage equipment which compliance to requirements of this technical regulation of the Customs union is not confirmed shall not be marked by single market circulation mark of state members of the Customs union and is not allowed to release into the stream of commerce in the market.

3. The low-voltage equipment which is not marked by single market access mark of gosudarstvchlen of the Customs union is not allowed to release into the stream of commerce in the market.

Article 4. Safety requirements

The low-voltage equipment shall be developed and manufactured so that in case of its application to destination and fulfillment of requirements to installation, this equipment provided to operation (use), storage, transportation (transportation) and maintenance:

necessary level of protection against direct or indirect impact of electric current;

lack of unacceptable risk of emergence of the increased temperatures, arc categories or radiations which can lead to emergence of dangers;

necessary level of protection against injuries the rotating and motionless parts of the low-voltage equipment;

necessary level of protection against the dangers of not electric origin arising in case of use of the low-voltage equipment, including caused by physical, chemical or biological factors;

necessary level of insulating protection;

necessary level of mechanical and switching wear resistance;

necessary level of resistance to the external influencing factors, including nonmechanical nature, in case of the corresponding climatic conditions of external environment;

lack of unacceptable risk in case of the overloads, emergency operation and refusals caused by influence external and the internal influencing factors;

lack of unacceptable risk in case of connection and (or) installation.

The low-voltage equipment shall be developed and manufactured so that it was not source of emergence of the fire in normal and emergencies of work.

Necessary level of information for safe use of the low-voltage equipment to destination shall be provided to the consumer (user).

Article 5. Requirements to marking and operational documents

1. The name and (or) designation of the low-voltage equipment (type, brand, model), its key parameters and characteristics influencing safety, the name and (or) the trademark of the manufacturer, the name of the country where the low-voltage equipment is manufactured shall be applied on the low-voltage equipment and are specified in the operational documents attached to it.

At the same time the name of the manufacturer and (or) his trademark, the name and designation of the low-voltage equipment (type, brand, model) shall be also applied on packaging.

2. If the data provided in Item 1 of this Article cannot be applied on the low-voltage equipment, then they can be specified only in the operational documents attached to this equipment. At the same time the name of the manufacturer and (or) his trademark, the name and designation of the low-voltage equipment (type, brand, model (in the presence)) shall be applied on packaging.

3. Marking of the low-voltage equipment shall be legible, easily readable and is applied on the low-voltage equipment in available to survey without disassembly using the tool the place.

4. Operational documents to the low-voltage equipment shall contain:

information listed in Item 1 of this Article;

information on purpose of the low-voltage equipment;

characteristics and parameters;

rules and conditions of safe operation (use);

rules and conditions of installation, storage, transportation (transportation), realization and utilization (if necessary - establishment of requirements to them);

information on measures which should be undertaken in case of failure detection of this equipment;

the name and the manufacturer's location (authorized by the manufacturer of person), the importer, information for communication with them;

month and year of production of the low-voltage equipment and (or) information on the place of drawing and method of determination of year of production.

5. Operational documents are carried out in Russian and in the state language(s) of state member of the Customs union in the presence of relevant requirements in the legislation(s) of the state (v) - the member(s) of the Customs union.

Operational documents are carried out on papers. The set of operational documents on electronic media can be attached to them. The operational documents which are included in the package of the low-voltage equipment not of household purpose can be executed only on electronic media.

Article 6. Ensuring compliance to safety requirements

1. Compliance of the low-voltage equipment to this technical regulation of the Customs union is provided with accomplishment of its safety requirements directly or fulfillment of requirements of the standards included in the List of standards as a result of which application on voluntary basis observance of requirements of the technical regulation of the Customs union is provided.

2. Methods of researches (testing) and measurements of the low-voltage equipment are established in the standards included in the List of the standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation of the Customs union and implementation of assessment (confirmation) of compliance of products.

Article 7. Confirmation of conformity

1. Before release into the stream of commerce in the market the low-voltage equipment shall undergo confirmation of conformity to safety requirements of this technical regulation of the Customs union.

Confirmation of conformity of the low-voltage equipment is performed according to schemes according to the Regulations on procedure for application of standard schemes of assessment (confirmation) for compliance in technical regulations of the Customs union approved by the Commission of the Customs union (further - the Commission).

2. The low-voltage equipment included in the List given in appendix to this technical regulation of the Customs union is subject to confirmation of conformity in the form of certification (scheme 1c, 3s, 4s).

The low-voltage equipment which is not included in the specified List is subject to confirmation of conformity in the declaration form of compliance (scheme 1d, 2d, 3D, 4d, 6d). The choice of the scheme of declaring of compliance of the low-voltage equipment which is not included in the List is performed by the manufacturer (authorized by the manufacturer person), the importer.

According to the decision of the manufacturer (authorized by the manufacturer of person), the importer confirmation of conformity of the low-voltage equipment which is not included in the List can be performed in the form of certification according to Item 5 of this Article.

In case of non-use of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union or in case of their absence, confirmation of conformity of the low-voltage equipment is performed in the form of certification (scheme 1c, 3s, 4s) according to Item 10 of this Article.

3. Certification of the low-voltage equipment produced in lots is performed according to the scheme 1c. The low-voltage equipment for certification is represented by the manufacturer (person authorized by the manufacturer).

Certification of batch of the low-voltage equipment is performed according to the scheme 3c, single изделияпо to the scheme 4c. The batch of the low-voltage equipment (single product) manufactured on single customs area of the Customs union is represented by the manufacturer, the batch of the low-voltage equipment (single product) imported on single customs area of the Customs union is represented by the importer or the manufacturer (person authorized by the manufacturer).

4. Certification of the low-voltage equipment is carried out by the accredited body on certification (assessment (confirmation) of compliance) included in the Unified register of certification bodies and test laboratories (centers) of the Customs union.

Testing for the purpose of certification are carried out by the accredited test laboratory (center) included in the Unified register of certification bodies and test laboratories (centers) of the Customs union.

5. When carrying out certification of the low-voltage equipment (scheme 1c, 3s, 4s):

5.1. the manufacturer (person authorized by the manufacturer), the importer provides to certification body (assessment (confirmation) of compliance) the set of documents on the low-voltage equipment confirming compliance of the low-voltage equipment to safety requirements of this technical regulation of the Customs union which includes:

specifications (in the presence);

operational documents;

the list of standards to which requirements this low-voltage equipment from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union shall conform;

the contract (delivery agreement) or the shipping documentation (for batch of the low-voltage equipment (single product) (scheme 3c, 4s);

5.2. The manufacturer undertakes all necessary measures that the production process was stable and provided compliance of the manufactured low-voltage equipment to requirements of this technical regulation of the Customs union;

5.3. certification body (assessment (confirmation) of compliance):

5.3.1. performs selection of sample (samples);

5.3.2. carries out identification of the low-voltage equipment by establishment of identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs union, to provisions stipulated in Clause by the 5th this technical regulation of the Customs union, and to the documents listed in subitem 5.1 of Item 5 of this Article;

5.3.3. will organize carrying out testing of sample (samples) the low-voltage equipment for compliance to requirements of standards from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union and carries out the analysis of the protocol (protocols) of testing;

5.3.4. carries out the analysis of condition of production (scheme 1c).

In the presence the manufacturer of the certified quality management system has productions or developments and productions of the low-voltage equipment are estimated by possibility of this system to provide stable release of the certified low-voltage equipment conforming to requirements of this technical regulation of the Customs union;

5.3.5. issues the certificate of conformity in the single form approved by the Commission. Effective period of the certificate of conformity for the low-voltage equipment produced in lots - no more than 5 years, for batch of the low-voltage equipment (single product) effective period of the certificate of conformity is not established;

5.4. the manufacturer (person authorized by the manufacturer), the importer:

5.4.1. puts single market circulation mark of state members of the Customs union;

5.4.2. creates after completion of confirmation of conformity set of documents on the low-voltage equipment in which includes:

the documents provided in subitem 5.1 of Item 5 of this Article;

protocol (protocols) of testing;

production condition analysis results;

certificate of conformity.

5.5. the certification body (assessment (confirmation) of compliance) carries out inspection check-up behind the certified low-voltage equipment by means of carrying out testing of samples in accredited test laboratory (center) and (or) the analysis of condition of production (scheme 1c).

6. Declaring of compliance of the low-voltage equipment (scheme 1d, 2d, 3D, 4d, 6d) is performed on the basis:

6.1. own proofs (scheme 1d, 2d):

- carrying out testing of the low-voltage equipment (for batch of the low-voltage equipment (single product) (scheme 2d);

- carrying out testing of the low-voltage equipment and production supervision by the manufacturer (for the low-voltage equipment produced in lots) (scheme 1d);

6.2. the evidence obtained with participation of accredited test laboratory (center), certification body of the systems of quality management included in the Unified register of certification bodies and test laboratories (centers) of the Customs union (the scheme 3D, 4d, 6d):

- carrying out testing of the low-voltage equipment, certification of quality management system of production or development and production of the low-voltage equipment and production supervision by the manufacturer (for the low-voltage equipment produced in lots) (scheme 6d).

- carrying out testing of the low-voltage equipment (for batch of the low-voltage equipment (single product) (scheme 4d);

- carrying out testing of the low-voltage equipment and production supervision by the manufacturer (for the low-voltage equipment produced in lots) (the scheme 3D);

- paragraph the fifth subitem 6.2. Article 7 No. 884 is excluded as technical mistake according to the Solution of KTS of 09.12.2011

6.3. Declaring of compliance of the low-voltage equipment produced in lots is performed by the manufacturer (person authorized by the manufacturer) according to schemes 1d, 3D, 6 of.

Declaring of compliance of batch of the low-voltage equipment (single product) is performed by the manufacturer (person authorized by the manufacturer), the importer according to schemes 2d, 4 of.

7. When declaring compliance of the low-voltage equipment according to schemes 1d, 2d:

7.1. the manufacturer (person authorized by the manufacturer), the importer:

7.1.1. creates set of the documents confirming compliance of the low-voltage equipment to requirements of this technical regulation of the Customs union which includes:

specifications (in the presence);

operational documents;

the list of standards which requirements are conformed by this low-voltage equipment, from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union;

the protocol (protocols) of the testing which are carried out in test laboratory (center) at the choice of the manufacturer (authorized by the manufacturer of person), the importer;

certificate of conformity (in the presence);

the declaration of conformity of the manufacturer (in the presence) (for batch of the low-voltage equipment (single product) (scheme 2d);

the contract (delivery agreement) or the shipping documentation (for batch of the low-voltage equipment (single product) (scheme 2d);

7.1.2. carries out identification of the low-voltage equipment by establishment of identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs union, to provisions stipulated in Clause by the 5th this technical regulation of the Customs union, and to the documents listed in subitem 7.1.1. Item 7.1 of this Article;

7.2. manufacturer:

exercises production supervision and takes all necessary measures in order that the production process provided compliance of the low-voltage equipment to requirements of this technical regulation of the Customs union (scheme 1d).

Requirements to production processes and control, and also results of their control shall be drawn up documentary (in the form established by the manufacturer);

7.3. the manufacturer (person authorized by the manufacturer), the importer:

7.3.1. adopts the declaration of conformity of the low-voltage equipment constituted in writing to this technical regulation of the Customs union in the single form approved by the Commission and puts single market circulation mark of state members of the Customs union;

7.3.2. includes after completion of confirmation of conformity in the set of documents on the low-voltage equipment given in subitem 7.1.1. Item 7.1 of this Article, declaration of conformity.

8. When declaring compliance of the low-voltage equipment according to schemes 3D, 4d, 6d:

8.1. the manufacturer (person authorized by the manufacturer), the importer:

8.1.1. creates set of documents on the low-voltage equipment which includes:

specifications (in the presence);

operational documents;

the list of standards to which requirements this low-voltage equipment from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union shall conform;

the contract (delivery agreement) or the shipping documentation (for batch of the low-voltage equipment (single product) (schemes 3D, 4d);

the certificate of conformity (the copy of the certificate) on quality management system of production or development and production of the low-voltage equipment (scheme 6d);

8.1.2. carries out identification of the low-voltage equipment by establishment of identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs union, to provisions stipulated in Clause by the 5th this technical regulation of the Customs union, and to the documents listed in subitem 8.1.1. Item 8.1. this Article;

8.1.3. will organize carrying out testing of sample (samples) the low-voltage equipment for compliance to requirements of standards from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union;

8.2. manufacturer:

exercises production supervision and takes all necessary measures in order that the production process provided compliance of the low-voltage equipment to requirements of this technical regulation of the Customs union (schemes 3D, 6d). Requirements to production processes and control, and also results of their control shall be drawn up documentary (in the form established by the manufacturer);

takes all necessary measures in order that the production process and stable functioning of quality management system of production or development and production of the low-voltage equipment provided compliance of the low-voltage equipment to requirements of this technical regulation of the Customs union (scheme 6d);

8.3. the manufacturer (person authorized by the manufacturer), the importer:

8.3.1. adopts the declaration of conformity of the low-voltage equipment constituted in writing to this technical regulation of the Customs union in the single form approved by the Commission and puts single market circulation mark of state members of the Customs union;

8.3.2. creates after completion of the procedures of confirmation of conformity set of documents on the low-voltage equipment in which includes:

the documents provided in subitem 8.1.1 of Item 8.1 of this Article;

protocol (protocols) of testing;

declaration of conformity.

9. The declaration of conformity is subject to registration according to the legislation of the Customs union. Action of the declaration begins from the date of its registration.

Effective period of the declaration of conformity for the low-voltage equipment produced in lots - no more than 5 years, for batch of the low-voltage equipment (single product) effective period of the declaration of conformity is not established.

10. When carrying out certification of the low-voltage equipment, in case of non-use of standards from the List of the standards specified in Item 1 of Article 6 of this technical regulation of the Customs union or in case of their lack (scheme 1c, 3s, 4s):

10.1. the manufacturer (person authorized by the manufacturer), the importer provides to certification body (assessment (confirmation) of compliance) the set of documents on the low-voltage equipment confirming compliance of the low-voltage equipment to safety requirements of this technical regulation of the Customs union which includes:

specifications (in the presence);

operational documents;

the description of the made technical solutions and risks assessment confirming fulfillment of requirements of safety of this technical regulation of the Customs union;

the contract (delivery agreement) or the shipping documentation (for batch of the low-voltage equipment (single product) (scheme 3c, 4s);

10.2. The manufacturer undertakes all necessary measures that the production process was stable and provided compliance of the manufactured low-voltage equipment to requirements of this technical regulation of the Customs union;

10.3. certification body (assessment (confirmation) of compliance):

10.3.1. performs selection of sample (samples);
