AGREEMENT OF THE STATE PARTIES OF COMMONWEALTH OF INDEPENDENT STATES

of April 12, 1996

About creation of the Interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States

The governments of the State Parties of this agreement (further - the Parties),

proceeding from provisions of the Agreement on cooperation in the field of veterinary science of March 12, 1993,

for the purpose of prevention of spread of infectious diseases of animals and mutual protection of the territories from epizooty,

agreed as follows:

Article 1

The parties create the Interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States (further - the Reserve) due to equity of the State Parties of this agreement.

Article 2

The parties create and use the Reserve according to Regulations on the Interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States. The specified Provision is integral part of this agreement.

Control of forming and use of this Reserve is assigned to Intergovernmental council on cooperation in the field of veterinary science and Interstate economic Committee of economic union.

Article 3

The parties enter duty-free delivery of the biological products intended for creation and use of the Reserve.

The written confirmation of the central public veterinary services of the State Parties of the Agreement is considered the document confirming purpose of batch of biological products in case of accomplishment of customs procedures.

Article 4

Changes and additions by common consent of the Parties can be made to this agreement.

Article 5

The matters of argument connected using or interpretation of this agreement, are permitted by consultations and negotiations.

For the purposes of permission of possible disputes and claims of material nature of the provision of this agreement continue to be effective concerning the Party which left it before complete settlement of all matters of argument.

Article 6

This agreement is open for accession to it of other states ready to assume liabilities following from this agreement.

Article 7

This agreement is signed sine die.

Article 8

This agreement becomes effective from date of delivery on storage to depositary of the third notification on accomplishment by the Parties of all necessary interstate procedures which signed it.

Article 9

Any Party can leave this agreement, having in writing notified on it depositary.

The agreement voids concerning such Party in six months after receipt by depositary of the notification on denouncement.

It is made in the city of Moscow on April 12, 1996 in one authentic copy in Russian. The authentic copy is stored in the Executive Secretariat of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.

Appendix

to the Agreement on creation of the Interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States

Regulations on the Interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States

I. General provision

The interstate reserve of biological products and other remedies of animals in the State Parties of the Commonwealth of Independent States (further - the Reserve) is created for ensuring first-priority works on liquidation of the centers of especially dangerous diseases of animals in the states which signed the Agreement on cooperation in the field of veterinary science on March 12, 1993 (further - the Agreement).

II. Forming of the Reserve

1. Forming and use of the Reserve performs Intergovernmental council on cooperation in the field of veterinary science (daleesovt) through Rosagrobioprom joint-stock company.

2. The nomenclature and quantity of the biological products included in the Reserve are specified in appendix 1 to this Provision.

The nomenclature of biological products of the Reserve and regulation of their accumulating can change Council for the offer of the central public veterinary services of the State Parties of the Agreement.

3. Expenses on creation of the Reserve and its refreshening are financed by contributions of the State Parties of the Agreement according to appendices 2 and 3 to this Provision.

From contributions on the settlement account of JSC Rosagrobioprom the special fund which funds in the form of non-interest loans JSC Rosagrobioprom transfers to the companies and research establishments performing production, accumulating, storage and delivery of biological products to consumers or customers is created.

JSC Rosagrobioprom has no right to spend the funds transferred by the State Parties of the Agreement for the purposes which are not provided by this Provision.

III. Storage and use of the Reserve

1. Biological products of the Reserve are stored at the companies making them or in research establishments.

2. In the Reserve the biological products having expiration date less than 12 months are not pledged.

3. The biological products accumulated in the Reserve shall:

conform to the approved nomenclature, requirements of state standard specifications or specifications and to be prepared for long-term storage, and their high-quality condition shall be confirmed by passports of products, acts of testing, etc.;

be stored separately from material values of the current consumption and in the conditions ensuring their quantitative and high-quality safety.

4. The shortage of biological products of the Reserve formed in the course of storage shall be filled immediately at the expense of the companies or research establishments which allowed this shortage.
