ORDER OF THE MINISTRY OF INFRASTRUCTURE OF UKRAINE

of July 27, 2011 No. 237

About approval of Rules of approval of the organizations for preparation for maintenance (Part-147)

According to the Air code of Ukraine, the Law of Ukraine "About the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law" and for the purpose of implementation in Ukraine of the European technical regulation and standards of PRIKAZYVAYU:

1. Approve Rules of approval of the organizations for preparation for maintenance (Part-147) which are applied.

2. To provide to the public air service of Ukraine:

2.1. Submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

2.2. Bringing this order to data of the interested companies, organizations, the organizations, physical persons and legal entities which activities are connected with maintenance of flight suitability of aviation engineering.

3. Certificates of educational institutions of civil aviation on training of personnel on maintenance of air vehicles remain acting during the effective period established in them.

4. Declare invalid the order of Public service of Ukraine on supervision of safety control of aircraft of 13.09.2004 No. 38 "About application in civil aviation of Ukraine of Joint Aviation Requirements of JAR-147 - "The approved training / ekzamenovaniye on maintenance", registered in the Ministry of Justice of Ukraine 27.09.2004 for No. 1218/9817.

5. This order becomes effective from the date of its official publication.

6. To impose control over the implementation of this order on the First Deputy Minister Efimenko K. O.

Rules of approval of the organizations for preparation for maintenance (Part-147)

I. General provisions

1.1. These rules establish technical requirements and procedures for competent authorities concerning approval of the organizations for training of aeronautical personnel for maintenance of air vehicles, including any component intended for establishment on them.

1.2. These rules are applied to the organizations performing training of aeronautical personnel for maintenance of the civil air vehicle, and also the components intended for establishment on such air vehicle (further - preparation).

1.3. In these rules terms are used in such value:

avionics - aviation and the avionics of the air vehicle;

The agency - the European Aviation safety agency (EASA);

state member - member states of the European Union and Ukraine;

component - any engine, the screw, part or the device;

the organization - the legal entity performing training of aeronautical personnel for maintenance of the civil air vehicle, and also the components intended for establishment on such air vehicle. Such organization can be based in Ukraine or on its borders;

pre-flight inspection - survey which is carried out before departure to make sure of suitability of the air vehicle to scheduled flight;

maintenance - major repair, repair, survey, replacement, modification or fault recovery of the air vehicle or component or any combination of these works, except for pre-flight inspection;

the civil air vehicle - the air vehicle registered in the State register of civil air vehicles.

1.4. For the organizations which main place of implementation of activities is located in the territory of Ukraine competent authority of rather these rules is the Public air service of Ukraine.

1.5. For the organizations which main place of implementation of activities is located outside the boundaries of the territory of Ukraine and which perform training of aeronautical personnel for maintenance of the air vehicles registered in the State register of civil air vehicles of Ukraine competent authority of rather these rules is the Public air service of Ukraine.

1.6. Before signing of the international treaty on mutual recognition of approvals of the organizations for preparation for maintenance between Ukraine and member states of the European Union of provision of Chapter 1. (147. 1) the EASA Part-147 standard in Ukraine are not applied.
