Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are applied:

- the allowing document - the administrative document of allowing nature issued by allowing body, to the legal entity and the individual entrepreneur for implementation of certain type of activity or action with indication of its term in case of obligatory observance of allowing conditions in the form of permission, the certificate, the conclusion, the act of approval, approval, the certificate, the certificate, registration, task and the decision, except for licenses;

- authorization system - set of the procedures of regulation of business activity by allowing bodies connected with issue, renewal, suspension and renewal of action and cancellation of the allowing document, issue of duplicates of the allowing document, maintaining the Single state electronic register of allowing documents and the register of allowing documents, control of observance by legal entities and individual entrepreneurs of allowing conditions and issue of instructions about elimination of violations of these conditions;

- allowing conditions - set of the requirements and conditions established by this Law and other regulatory legal acts of the Republic of Tajikistan which accomplishment is obligatory the applicant in case of receipt of the allowing document (or) the owner of the allowing document when implementing the corresponding type of business activity;

- allowing body - the authorized state body given according to this Law the right of issue of the allowing document;

- the applicant - the legal entity or the individual entrepreneur who submitted the application and documents necessary for receipt of the allowing document to allowing body;

- the owner of the allowing document - the legal entity or the individual entrepreneur having the allowing document for implementation of specific type of activity or actions;

- the declared responsibility - the declaration the applicant of the responsibility about observance of allowing conditions when implementing business activity;

- approval by default - the procedure owing to which the allowing document is considered issued, renewed, renewed if the allowing body did not pass the decision according to the statement with the notification of the applicant in terms and on the conditions provided by this Law;

- single window - the simplified procedure of consideration of the application on issue of the allowing document and check of provided information and (or) its transfer to authorized state bodies on approval if other law provides their approval, without involvement in this process of the applicant;

- information system of issue of the allowing document - complex of software, methods and procedures for receipt of electronic request, acceptance, creation, processing, transfer, storage and integrity checking of electronic documents and execution of allowing documents;

- electronic form of permission - the permission in electronic form which is drawn up and received with use of information system of issue of the allowing document;

- electronic execution of the allowing document - execution of the allowing document with use of information and telecommunication technologies within electronic interaction between state bodies, authorized organization and requesting;

- interdepartmental electronic interaction - data exchange between state bodies by means of information and communication technologies;

- electronic request of issue of the allowing document - the document on provision of permission constituted from required in electronic form in the single approved form;

- electronic base of allowing documents - the component of information system of issue of the allowing document containing information about the allowing documents, and also other statistical and analytical data issued to subjects of business activity;

- the register of allowing documents - set of data on the issued, renewed, suspended, renewed and cancelled allowing documents which are maintained by each allowing body;

- the single state electronic register of allowing documents - the generalized database and information on allowing documents available online.

Article 2. Legislation of the Republic of Tajikistan on authorization system

The legislation of the Republic of Tajikistan on authorization system is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.
