The government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation which are hereinafter referred to as with the Parties

based on the Agreement on the Customs union of January 20, 1995, the Agreement on the Customs union and the Common economic space of February 26, 1999, the Agreement on creation of single customs area and forming of the Customs union of October 6, 2007,

understanding need of further development of the mutually advantageous, fair and oriented to the market system of trade in agricultural products,

for the purpose of ensuring coordination of line items of state members of the Customs union in case of accession to the World Trade Organization,

being guided by the principles of international law,

agreed about the following:

Article 1 Subject of the agreement

1. Subject of this agreement is establishment of rules of implementation of the state support of producers of agricultural goods.

2. This agreement acts on the territory of the Common economic space of the states of the Parties and is applied to the goods specified in appendix No. 1, being integral part of this agreement, (further - agricultural goods).

Article 2 of Determination

The concepts used in this agreement mean the following:

"administrative and territorial units" - subjects of the Russian Federation and (or) the area of the Republic of Belarus and the Republic of Kazakhstan (including Minsk, Astana and Almaty);

"the state support of agricultural industry" - the financial assistance rendered by the government or other state body of the state of the Party or local self-government to producers of agricultural goods directly or by proxy them the agent.

The procedure of payments of amounts of the state support of agricultural industry is provided in appendix No. 2, being integral part of this agreement;

"the subsidizing body" - one or several state bodies or local government bodies of the states of the Parties performing decision making in the field of provision of the state support of agricultural industry.

The subsidizing body according to the legislation of the states of the Parties can charge or order to the authorized agent (any other organization) to execute one or several functions assigned to it relating to provision of measures of the state support of agricultural industry. Such actions of the authorized agent will be considered as actions of the subsidizing body.

The actions of the president of the state of the Party directed to provision of measures of the state support of agricultural industry are considered as actions of the subsidizing body.

The article 3 Classification of Measures of the State Support of Agricultural Industry by Extent of the Distorting Impact on trade

1. Measures of the state support of agricultural industry are subdivided on:

1) the measures which are not making the distorting impact on mutual trade of the states of the Parties in agricultural goods (further - the measures which are not making the distorting impact on trade);

2) the measures which are most making the distorting impact on trade of the states of the Parties in agricultural goods (further - the measures which are most making the distorting impact on trade);

3) the measures making the distorting impact on mutual trade of the states of the Parties in agricultural goods (further - the measures making the distorting impact on trade).
