About approval of the Procedure for carrying out by the Ministry of Justice of Ukraine of checks of activities of territorial authorities of justice

According to the Law of Ukraine "About the central executive bodies", the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 N 395, for the purpose of strengthening of control of activities of territorial authorities of justice and increase in efficiency of conducting checks by the Ministry of Justice of PRIKAZYVAYU:

1. Approve the Procedure for carrying out by the Ministry of Justice of Ukraine for checks of activities of territorial authorities of justice which is applied.

2. Determine Department of internal security of the Public criminal and executive service of Ukraine and judicial authorities responsible for conducting complex checks of territorial authorities of justice and control checks for their results.

3. To department of interaction with authorities (Zerkal O. V.) to bring this order to permission of heads of structural divisions of the office of the Ministry of Justice of Ukraine and chiefs of Head departments of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, justice departments in areas, the cities of Kiev and Sevastopol, chairmen of the Public executive service of Ukraine and the Public registration service of Ukraine.

4. Declare invalid the order of the Ministry of Justice of Ukraine of December 11, 2007 N 1794/7 "About approval of the Procedure for carrying out by the Ministry of Justice of Ukraine of checks of activities of territorial authorities of justice".

5. (Zerkal O. V.) to submit to department of interaction with authorities this order on state registration according to the Presidential decree of Ukraine of 03.10.92 N 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

6. I reserve control over the implementation of this order.

7. This order becomes effective from the date of its official publication.

Procedure for carrying out by the Ministry of Justice of Ukraine for checks of activities of territorial authorities of justice

1. This Procedure determines the mechanism of implementation by the Ministry of Justice of checks of condition of observance by territorial authorities of justice of the Constitution of Ukraine, the requirements of the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts, the Cabinet of Ministers of Ukraine, the Ministry of Justice of Ukraine and the organization of work on their accomplishment.

2. In this Procedure terms are used in such value:

complex check - scheduled or unscheduled inspection during which all activities of territorial authorities of justice are checked;

control check - check of condition of activities of territorial authority of justice which is carried out by the Ministry of Justice for the purpose of determination of condition of realization by territorial authority of justice of recommendations, data during the previous checks;

scheduled inspection - complex, target, control check of activities of territorial authority of justice which is carried out based on the plan which affirms the Minister of Justice;

unscheduled inspection - the check of activities of territorial authority of justice which is not planned by the Ministry of Justice;

territorial authorities of justice - interregional managements of the Ministry of Justice;

target check - scheduled or unscheduled inspection during which one or several activities of territorial authorities of justice are checked.

3. Complex inspection of activities of territorial authority of justice is carried out, as a rule, time in three years.

Target inspection of activities of territorial authority of justice is carried out, as a rule, time in two years.

Control inspection by results of activities of territorial authority of justice is carried out in case of need.

4. The department of internal security of the Public criminal and executive service of Ukraine and judicial authorities of offers of structural divisions of the office of the Ministry of Justice performs preparation of annual plans of conducting complex checks and control checks by their results of activities of territorial authorities of justice and submits them for approval to the Minister of Justice.

5. Organizational support on carrying out:

complex and control checks on their consequences it is assigned to Department of internal security of the Public criminal and executive service of Ukraine and judicial authorities;

target and control checks on their consequences it is assigned to structural divisions of the office of the Ministry of Justice within their competence, according to the purpose and tasks of check.

6. For conducting complex and control checks the Ministry of Justice forms working group.

Structural divisions of the office of the Ministry of Justice give to Department of internal security of the Public criminal and executive service of Ukraine and judicial authorities in the terms determined by the corresponding service record Department of internal security of the Public criminal and executive service of Ukraine and judicial authorities, offers in structure of the working group and the plan of conducting complex check and control check for its consequences.

Based on the received offers the Department of internal security of the Public criminal and executive service of Ukraine and judicial authorities prepares the draft of the relevant order on conducting complex check (control by its results) with indication of terms of carrying out, structure of the working group and the plan of complex check (control by its results) which after its coordination with Accounting service represents for the signature to the state secretary of the Ministry of Justice.

After signing of the relevant order Department of Internal Security of the Public criminal and executive service of Ukraine and judicial authorities prepares the service record for Management of personnel with indication of review periods and the period of business trip and gives it together with the copy of the order on conducting complex check (control by its results) for preparation of the draft of the order on business trip.
