About approval of Rules of carrying out radiation control

(as amended of the Order of the Minister of Finance of the Republic of Kazakhstan of 26.04.2017 No. 276)

According to item 4 of article 192 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of carrying out radiation control.

2. Recognize invalid:

2) the order of the Vice-Minister of Finance - the Chairman of the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan of September 7, 2005 No. 345 "About introduction of amendments to the order of the Acting Chairman of the Agency of customs control of the Republic of Kazakhstan of September 27, 2004 No. 400 "About approval of Rules of carrying out radiation control by customs authorities on frontier of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 3862, No. 230-231) published in the Yuridicheskaya Gazeta newspaper of December 9, 2005.

3. (Baymaganbetov S. N.) to provide to the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its subsequent publication in mass media.

4. This order becomes effective after ten calendar days from the date of its first official publication and extends to the relations which arose since July 1, 2011.

Rules of carrying out radiation control

Chapter 1. General provisions

1. These rules of carrying out radiation control (further - Rules) are developed according to item 4 of article 192 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan" (further - the Code) and determine procedure for carrying out state revenues of radiation control by bodies.

2. In these rules the following concepts are used:

1) source of ionizing radiation - the radioactive materials, devices or devices containing radioactive materials, and also the electrophysical devices or devices which are letting out or capable to emit ionizing radiation;

2) capacity of dose - radiation dose for unit of time (second, minute, hour);

3) packaging - the packaging set with its radioactive content in the type provided for transportation having signs of radiation hazard;

4) radiation accident - violation of limits of safe operation of subject to use of atomic energy in case of which there was exit of radioactive products and/or ionizing radiation for the borders provided by the project of normal operation which could bring or led to radiation of people or radioactive environmental pollution above the established regulations;

5) radiation control - check of level of the ionizing radiation proceeding from the goods and (or) vehicles moved through customs border of the Eurasian Economic Union, and its comparison with natural background for the purpose of safety for the population and the environment;

6) radioactive materials - any materials of natural or technogenic origin in any aggregate state containing radionuclides.

3. Radiation goods control and vehicles one of types of customs control at check points and other places of movement through customs border of the Eurasian Economic Union which is performed for the purpose of radiation safety of the population on customs area of the Eurasian Economic Union and the Republic of Kazakhstan according to the legislation of the Eurasian Economic Union and the Republic of Kazakhstan, observance of the international non-proliferation regime of nuclear weapon and nuclear materials, prevention of customs offenses when moving at check points through customs border of the Eurasian Economic Union of radioactive materials (further - RV), goods and vehicles with the increased power level of equivalent dose of gamma radiation, density of flow neutron, alpha, beta radiations (further - ionizing radiation).

The goods and vehicles crossing check points and other places of movement through customs border of the Eurasian Economic Union are subject to radiation control.

4. For radiation control bodies of state revenues use the stationary and figurative systems of radiation control RV adapted for technologies of customs control.

Chapter 2. Procedure for carrying out radiation goods control and vehicles

5. The goods entering goods items of the Commodity nomenclature of the foreign economic activity of the Eurasian Economic Union (further - the CN FEA EEU) approved by the Decision of Council of the Eurasian economic commission of July 16, 2012 No. 54 are subject to priority radiation control:

1) 2612 - ores and concentrates uranium or thorium;

2) 2844 - radioactive chemical elements and isotopes radioactive (including the sharing and reproducing chemical elements, and isotopes) and their connections; the mixes and remaining balance containing these products;

3) 2845 - isotopes, except isotopes of goods item 2844; connections inorganic or organic, certain or uncertain chemical composition;

the goods entering subsubline items:

4) 8401 30 000 0 - the fuel elements (fuel elements) which are not irradiated (for nuclear reactors);

5) the radio isotope products which are part of devices and the equipment of goods item 9022 - the equipment based on use of alpha, beta, gamma or neutron radiations.

6. Taking into account class of the used equipment radiation control at check points and other places through customs border of the Eurasian Economic Union within customs control consists of the following stages:

1) primary radiation control;

2) additional radiation control;

3) profound radiation inspection;

4) examination.
