The government DECIDES:

1. Create as consultative body Economic council in case of the Prime Minister.

2. Approve Regulations on the organization and functioning of Economic council in case of the Prime Minister according to appendix No. 1.

3. Recognize invalid some orders of the Government according to appendix No. 2.

Regulations on the organization and functioning of Economic council in case of the Prime Minister

I. General provisions

1. The economic council (further – Council) is created in case of the Prime Minister as consultative body and:

1) carries out mission for simplification of dialogue between representatives of business community and politicians for the purpose of development of favorable social and economic climate and business environment, non-discriminatory, transparent and favorable for investments;

2) for the purpose of support and coordination of implementation process of the Agreement on simplification of procedures of trade performs functions of National committee on assistance to trade;

3) performs powers of the Advisory board on small and medium scale enterprises.

2. Council performs the activities according to the legislation, in particular Item 2 of Article 23 appendices to the Protocol on introduction of amendments to the Marrakesh agreement on organization of the World Trade Organization accepted by the Law No. 129/2016, article 10 of the Law No. 179/2016 on small and medium scale enterprises and this Provision.

II. Main functions and obligations of Council

3. For realization of the assigned mission Council performs the following main functions:

a) provision to the Government of examination from business environment in case of development public the politician in economic and budget and tax areas, in the sphere of trade, etc.;

b) monitoring and assessment of impact of implementation specified public the politician;

c) assistance of private sector to process of development of public decisions in economic and budget and tax areas, in the sphere of trade, etc.;

d) providing the single mechanism on consultation and coordination of activities, for the purpose of assistance to foreign trade and implementation of the Agreement on simplification of procedures of trade (the purpose on simplification of procedures);

e) promotion of the measures necessary for implementation of the Agreement on simplification of procedures of trade (the purpose on regulation);

f) consideration and promotion of the investment projects necessary for implementation of the Agreement on simplification of procedures of trade (the purpose on development);

g) increase in level of awareness on the mechanism and the benefits provided along with implementation of measures for simplification of foreign trade (the purpose on promotion);

h) support to negotiating concerning simplification of procedures of foreign trade at the bilateral, regional or world levels (the purpose on negotiating);

i) identification of key problems, requests and requirements of small and medium scale enterprises for the Republic of Moldova;

j) representation to the Ministry of Economy and Infrastructure of opinion of business community on problems and interests of small and medium scale enterprises;

k) discussion and introduction of suggestions for improvement of the regulatory base influencing creation and development of small and medium scale enterprises;

l) formulation of recommendations concerning development, change and program implementations and the politician for support of development of the sector of small and medium scale enterprises according to requirements of the single market and requirements of improvement of quality of products according to the European standards;

m) assistance in promotion of policy of support of development of the sector of small and medium scale enterprises;

n) increase in awareness of the public and concerned parties about problems of small and medium scale enterprises;

o) taking measures to cooperation with civil society, private sector, mass media concerning development of small and medium scale enterprises;

p) monitoring of access of small and medium scale enterprises to financing and applications by competent organizations of the recommendations developed by Council.

4. Council carries out the following obligations:

a) reviews all requests of the Prime Minister and represents him the corresponding comments and recommendations;

b) promotes development of the concept of the Government on some processes of reform;

c) makes offers on politicians of economic development, represents recommendations about the programs of public investments developed by the ministries and other bodies of public management;

d) the politician, the politician of foreign and domestic trade, support of real production sector, development of infrastructure, improvement of situation in the labor market, humanitarian development and social protection, etc. makes suggestions for improvement monetary, budget and tax;

e) considers and proposes solutions on urgent social and economic problems of the state.

III. Structure, organization and functioning of Council

5. Members of council are appointed the Prime Minister from among representatives of business environment, associations of entrepreneurs, scientific community, the international organizations operating in the sphere of reforms of business environment and organizations of the state. The structure of Council affirms the decision of the Prime Minister, after receipt of consent of persons invited by the Prime Minister.

The structure of Council - consultative body as National committee on assistance to trade and the Advisory board on small and medium scale enterprises can be appointed by the separate decision of the Prime Minister.

6. Membership in Council is voluntary and assumes the high civil responsibility.

1) Membership in Council stops in the following cases:

a) voluntary refusal;

b) dissolution of the organization in which the member of council performs the activities;

c) according to the proposal of the Prime Minister.

2) In the above-stated cases the secretariat informs the Prime Minister who, makes, as necessary, the decision on the beginning of the procedure of selection of new members within 30 days.

7. For accomplishment of the functions and more effective implementation of activities as a part of Council theme working groups permanent or temporary (ad hoc) can be created.

Each standing group will have the coordinator who is member of the corresponding working group, elected by her members by a simple majority vote. The coordinator will organize work of group and directs it.
