The Azerbaijan Republic, the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan, the Republic Kyrgyzstan, the Republic of Moldova, the Russian Federation, the Republic of Tajikistan, Turkmenistan, the Republic of Uzbekistan and Ukraine which are hereinafter referred to as - "the State Parties of the Commonwealth",
proceeding from need of acceptance of agreed measures for providing social and legal protection of the military personnel, persons discharged from military service, and members of their families,
considering the rights of the military personnel to be translated for passing of military service or to be transferred to the reserve (resignation) from one state of the Commonwealth in another,
for the purpose of creation by the serviceman of proper level of living and conditions for accomplishment of obligations of military service, and also the legal basis for implementation of these measures
agreed as follows:
For the military personnel, persons discharged from military service and living in the territory of the State Parties of the Commonwealth, and also members of their families the level of the rights and privileges established earlier by the laws and other regulations of the former USSR remains.
Unilateral restrictions of the specified rights and privileges of the military personnel, persons discharged from military service and members of their families are not allowed.
The State Parties of the Commonwealth have the right to take measures for strengthening of social protection of the military personnel, persons discharged from military service and members of their families.
The states of the Commonwealth the legislation are established and provide all completeness of the political, social and economic and personal rights and freedoms to the military personnel, persons discharged from military service and to members of their families according to rules of international law and provisions of this agreement, including the following rights:
keep nationality of the State Party of the Commonwealth which they had to appeal (revenues) to military service;
have the property belonging to them in property and dispose at discretion of this property;
live in the premises occupied by them;
receive the pension established by the legislation. The procedure for provision of pensions of the military personnel is established by intergovernmental agreements;
when crossing Frontier of the state of the Commonwealth to take personal property without collection of duties, taxes and payments, except for objects, export (import) of which is prohibited by the legislation of the relevant state;
get education in the highest, average and specialized secondary educational institutions of the state of the Commonwealth, to use preschool child care facilities;
use medical and other types of social security;
on employment in state bodies, the companies, organizations and the organizations after dismissal from military service.
Besides the military personnel after dismissal from military service, and also members of their families has the right to be naturalized the state of stay, to remain on permanent residence in its territory or to choose other residence.
The states of the Commonwealth provide with premises of the military personnel and members of their families which do not have housing or needing improvement of housing conditions according to the legislation of the state of stay.
The State Parties of the Commonwealth undertake the obligation in 1992 to develop and adopt mutually agreed legal acts for social protection of the military personnel, persons discharged from military service and members of their families.
The agreement becomes effective from the moment of its signing.
It is made in Minsk on February 14, 1992 in one authentic copy in Russian. The authentic copy is stored in archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.
