For the purpose of implementation of the Presidential decree of the Republic of Kazakhstan of July 21, 2011 No. 120 "About measures for accomplishment of the Decision of Interstate council (the supreme body of custom union) of Eurasian economic community "On Single Non-tariff Regulation of Custom Union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation" of November 27, 2009 No. 19, of Decisions of the Commission of custom union of June 18, 2010 No. 333 "About application of measures of non-tariff regulation within single customs area", of November 27, 2009 No. 132 "On single non-tariff regulation of custom union the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation" DECIDES: the Government of the Republic of Kazakhstan

1. Approve Rules of import to the territory of the Republic of Kazakhstan from the countries which are not entering into the Customs union and export from the territory of the Republic of Kazakhstan to these countries of the precious metals and primary goods containing precious metals.

2. To the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan to determine places of customs declaring and customs clearance of the precious metals and primary goods containing precious metals.

3. Ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 19.09.2014 No. 995

4. This resolution becomes effective from the date of signing and is subject to official publication.

Rules of import to the territory of the Republic of Kazakhstan from the countries which are not entering into the Customs union and export from the territory of the Republic of Kazakhstan to these countries of the precious metals and primary goods containing precious metals

1. General provisions

1. Rules of import to the territory of the Republic of Kazakhstan from the countries which are not entering into the Customs union and export from the territory of the Republic of Kazakhstan to these countries of the precious metals and primary goods containing precious metals (further - Rules) are developed according to Regulations on procedure for import to customs area of the Customs union within EurAsEC and export from customs area of the Customs union within EurAsEC of the precious metals, gemstones and primary goods containing precious metals (further - the Provision) the approved decision of Interstate Council of EurAsEC (the supreme body of the Customs union) of November 27, 2009 No. 19 "On single non-tariff regulation of custom union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation".

2. Requirements of these rules do not extend to the control in case of transfer pricing exercised according to the national legal system of the Republic of Kazakhstan on transfer pricing.

3. Requirements of these rules do not extend to transactions of National Bank of the Republic of Kazakhstan.

4. The basic concepts used in these rules:

precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium and osmium) according to appendices 1 and 2 to Rules, except for products from them;

the primary goods containing precious metals - the raw precious metals (including, Dore's alloy in the form of ingot, the cathode metal and zinc rainfall), scrap and waste of precious metals, ores and concentrates of precious metals, the ores, concentrates and ashes of non-ferrous metals, semi-products of production of non-ferrous metals containing precious metals according to appendix 3 to Rules;

special accounting - maintaining the register of legal entities by authorized body (except for National Bank of the Republic of Kazakhstan) and the individual entrepreneurs performing transactions with precious metals and primary goods, containing precious metals, not assuming collection of collection for their entering into the register in form according to appendix 4 to Rules;
