The agreement on cooperation on the organization and carrying out search and rescue ensuring flights of aircrafts of civil aviation

of December 9, 1994

The governments of the State Parties of this agreement which are hereinafter referred to as - Contracting Parties,

being guided by aspiration to interaction deepening, provisions of the Convention on international civil aviation of 1944 (the daleechikagsky convention) and attaching significance to civil aviation as one of important factors of cooperation of the people of the State Parties of the Commonwealth of Independent States,

proceeding from the proclaimed cooperative principles and friendship,

providing achievement of the agreed measures taken for the purpose of the organization and carrying out search and rescue ensuring flights of aircrafts of civil aviation, applying the standards and recommended practice of International Civil Aviation Organization concerning cooperation between search and rescue services of the adjacent states

agreed as follows:

Article 1

Contracting parties recognize need of development of the corresponding regulations and rules on the organization of search and rescue ensuring flights of aircrafts of civil aviation.

Article 2

The aircraft of the state of the Contracting Party and persons which are on its board suffering or injured disaster are subject to immediate search and rescue. It is performed on an equal basis irrespective of the state accessory of this aircraft and circumstances of disaster.

Article 3

Each Contracting Party in the territory of the state accepts according to the national legal system and rules all necessary measures of search and rescue ensuring flights of aircrafts directed to accomplishment of immediate and effective works on search and rescue of passengers and crews of the aircrafts which are in distress or the victims, to rendering necessary assistance to victims.

Article 4

Each Contracting Party charges the organization and carrying out search and rescue of the aircrafts which are in distress or the victims, to the search and rescue organizations or by agreement the search and rescue organizations of other Contracting Party, or interstate search and rescue body which can be created by all or part of Contracting Parties.

The search and rescue organizations of each Contracting Party coordinate the activities with the relevant organizations of other Contracting Parties.

Article 5

Contracting parties will organize in the territory of the states such procedure for search and rescue providing according to which the operators of air transport performing the activities connected with flights of aircrafts allocate to search and rescue body for its requirement search and rescue forces on the duty and means containing in readiness for carrying out search and rescue works.

Article 6

Contracting parties take measures for creation and financial material security of search and rescue bodies in the territories of the states, will organize search and rescue ensuring flights of aircrafts, including:

determine borders of search and rescue, if necessary in coordination with the adjacent states within which they perform search and rescue ensuring flights;

create the coordination centers of search and rescue with the organization of straight lines of communication at the operational levels between them;

provide the coordinated actions of bodies of Contracting Parties, perform search and wrecking;

if necessary take measures for the immediate admission on the territory of the states of search and rescue forces and means of other Contracting Parties.

Each Contracting Party publishes and distributes all necessary information on conditions of the admission of search and rescue forces and funds of other Contracting Party for the territory of the state.

Article 7

For timely assistance to the aircrafts which are in distress or injured the international distress signals, urgency, the prevention and applied in case of search and rescue transactions are effective.

The list of the technical means which are subject to installation on the aircrafts intended for carrying out search and rescue works is determined by the rules accepted by each Contracting Party.

Article 8

For the purpose of achievement of the coordinated actions aimed at search and rescue providing flights of aircrafts on operational carrying out search and wrecking, experience exchange and information on the matters, the search and rescue organizations of Contracting Parties meetings within Council for aircraft and use of airspace, and also joint exercises of search and rescue forces are periodically held.

Terms, the place and procedure for holding such meetings, doctrines are determined by agreement between authorized departments of Contracting Parties.

Article 9

The relevant authorized departments and the organizations of Contracting Parties will perform cooperation on enhancement of search and rescue providing, development of the single principles of the organization of search and rescue of passengers and members of crews of the aircrafts which are in distress or the victims, unification of the used technical means and rescue equipment, implementation of their mutual deliveries on contractual basis.

Article 10

Each Contracting Party, in case when the aircraft of other Contracting Party is in distress or suffered around responsibility of the Contracting Party, immediately notifies on it the corresponding Contracting Party and takes necessary measures for the organization of timely search and rescue works, provides free passing of information on the aircrafts which are in distress or the victims. At the same time:

the companies, the organizations and the organizations having means of communication present them for passing of information on the aircrafts which are in distress or the victims;

provision of telephone and cable communication for the information transfer concerning assistance to the aircraft, in distress is performed out of any queue, with payment on ordinary rate, and the first message on aviation incident is performed free of charge;

regional authorities, the companies, organizations and the organizations without delay report about all cases of disasters of aircrafts known for it to search and rescue body or on the nearest airfield.

Article 11

Works on search of aircrafts of any states and rescue of the people who are onboard basing of search and rescue forces and means, their providing and servicing during these works are made at the expense of the state of the Contracting Party in the territory of which the aircraft of the state of other Contracting Party suffered disaster.

Article 12

Evacuation of passengers and crew members from the place of disaster is performed at the expense of the operator of the aircraft.
