About energy efficiency of buildings

The purpose of this Law is assistance to increase in energy efficiency of buildings taking into account improvement of thermal microclimate in them, cost efficiency, decrease in consumption (use) in energy resources and emissions of greenhouse gases in the atmosphere.

Article 1. Legal regulation of the relations in the field of energy efficiency of buildings

This Law establishes the legal basis in the field of assessment of energy efficiency and decrease in consumption of energy resources of buildings, energy efficient construction, and also governs the legal and organizational relations between the owners of buildings irrespective of patterns of ownership certified by specialists and state bodies of the executive authority.

Article 2. Coverage of this Law

Operation of this Law extends:

1) on buildings: residential, public, administrative and multipurpose non-productive, and also on their technical systems;

2) on the activities connected with energy efficiency of buildings in case of them:

a) designing and construction;

b) to commissioning;

c) to leasing;

d) exposure to sale;

e) energy renovation.

Article 3. Main terms, concepts and determinations

In this Law the following main terms, concepts and determinations are used:

1) the building - the construction object having the rooms for life activity of people protecting the designs and technical systems using heat and electrical energy on heating and hot water supply, and also other systems and the equipment intended for its operation;

2) energy renovation of the building - step-by-step or one-time change:

a) the protecting structures of the existing building or its technical systems in case of which due to additional thermal isolation, replacement of the translucent and opening designs or replacement of the equipment of technical systems the structure of energy consumption changes;

b) level of thermal protection of the outside protecting designs for 25 percent at least their total area;

3) technical systems of the building - the technical systems of heating, hot water supply, ventilation, chilling and lighting installed for one building;

4) copper (heatgenerator) - the integrated design consisting of direct copper and the block of torches and intended for transfer to the thermal carrier of the warmth released in the course of burning;

5) energy efficiency of buildings - amount of the energy necessary for satisfaction of all energy demands in normative use of the building;

6) the minimum requirements of energy efficiency of buildings the established minimum level of energy efficiency of buildings which shall be realized;

7) class of energy efficiency of the building - the classification designating the level of energy efficiency of the building characterized by interval of values of specific expense of heat energy on heating of the building and hot water supply for the heating period;

8) energy certification of buildings - process of data collection and processing about use of energy resources for the purpose of receipt of reliable information about amount of the used energy resources, about indicators of energy efficiency of buildings, identifications of opportunities of energy saving and increase in energy efficiency with reflection of the received results in the energy certificate;

9) the energy certificate of the building - the document of the established form which includes indicators of energy efficiency of the building, filled by the certified specialist;

10) the certified specialist - the physical person who received the state qualification certificate in the field of energy certification of buildings and (or) implementation of periodic control of energy efficiency of coppers, systems of heating and hot water supply;

11) energy marking (the index of energy efficiency) - the short characteristic of the building by energy efficiency serving for information;

12) periodic control of energy efficiency of coppers, systems of heating and hot water supply - complex of actions for establishment of compliance of coppers, systems of heating and hot water supply to requirements of energy efficiency.

Article 4. The legislation of the Kyrgyz Republic in the field of energy efficiency of buildings

The legislation in the field of energy efficiency of buildings consists of the Law of the Kyrgyz Republic "About energy saving", this Law and other regulatory legal acts of the Kyrgyz Republic, and also international treaties which became effective in accordance with the established procedure accepted according to it which participant is the Kyrgyz Republic.

Article 5. Providing and the principles of activities in the field of energy efficiency of buildings

1. Activities in the field of energy efficiency of buildings are performed on the basis of the following principles:

1) effective and rational use of energy resources;

2) decrease in consumption of primary energy;

3) unity of rules of establishment of requirements of energy efficiency of buildings;

4) support and stimulation of measures for increase in energy efficiency of buildings;

5) decrease in emissions of greenhouse gases in CO2 equivalent;

6) compliance of normative and legal acts of the Kyrgyz Republic to the international standards in the field of energy efficiency of buildings.

2. The minimum requirements to energy efficiency of buildings affirm the Government of the Kyrgyz Republic. The minimum requirements of energy efficiency of buildings are subject to revision at least once in 10 years.

3. The minimum requirements of energy efficiency of buildings do not extend:

1) on individual residential buildings which total area does not exceed 150 square meters;

2) on the buildings intended for making of religious practices, rituals and ceremonies;

3) on buildings which according to the legislation of the Kyrgyz Republic are carried to objects of cultural heritage (historical and cultural monuments) if fulfillment of requirements of energy efficiency is impossible owing to change of style of its appearance and the protecting designs;

4) on temporary objects of non-capital construction;

5) on country houses;

6) on buildings and structures of auxiliary use (podsobnokhozyaystvenny appointment).

4. New buildings and buildings in which energy renovation is performed except for specified in part 3 of this Article, shall conform to the minimum requirements to their energy efficiency.

5. The project documentation shall be developed for receipt of the construction license or implementation of energy renovation of the building taking into account the minimum requirements to its energy efficiency.

6. Commissioning of the buildings which are again built and undergone energy renovation which do not conform to the minimum requirements of energy efficiency of buildings is not allowed.
