State Parties of this agreement, daleegosudarstva-participating,

proceeding from the Agreement between the State Parties of the Commonwealth of Independent States on social and legal guarantees of the military personnel, persons discharged from military service, and members of their families from February 14, 1992,

expressing concern of the State Parties in destiny of the military personnel of the former USSR and members of their families, and also recognizing need of acceptance of agreed measures for the solution of questions of providing them as premises,

agreed as follows:

Article 1

This agreement extends to the military personnel (except the military personnel of conscription service) passing military service in Armed Forces and other military forming of the State Parties of the Commonwealth of Independent States which were earlier in the military service in Armed Forces and other military forming of the former USSR, in the Joint Armed Forces of the Commonwealth of Independent States (further - the military personnel), and also to citizens from among the specified military personnel discharged from military service after December 31, 1991, and members of their families and who are foreign citizens in relation to the state of their stay or having the right to acquisition of nationality of the State Party in the territory of which the permanent residence is chosen.

Article 2

Military personnel and members of their families in case of transfer for further passing of military service to other state are provided with premises on regulations and according to the procedure, established by the legislation of the State Party to which they arrive.

For the military personnel directed for passing of military service to the territory of other State Party remain premises on the permanent residence for passing of military service by them in the territory of other State Party (are reserved). At the same time, for military service office premises by agreement of the interested State Parties are provided to them.

Article 3

The citizens discharged from military service and members of their families when moving on the permanent residence from the territory of one on the territory other State Party are provided at the chosen place of residence with premises on the regulations established for citizens of the state to which territory they arrived.

The State Party, in Armed Forces and which other military forming citizens specified in this Article passed military service beforehand acquires for them premises on the permanent residence elected by them in the territory of other State Party on condition of delivery of the premises occupied by these citizens still to the duty station (residence) or if premises still to the duty station (residence) were not provided to them.

The procedure and terms of acquisition of the specified premises are determined by the governments of the State Parties on bilateral basis.

Article 4

The military personnel, citizens discharged from military service and members of their families in case of departure to the permanent residence from the territory of one on the territory other State Party have the right to exchange of the premises occupied by them for permanent residence, irrespective of their departmental accessory, with citizens of other State Party, and also to sale of the premises privatized by them irrespective of privatization terms.

Exchange and sale of these premises are performed on regulations and according to the procedure, established by the legislation of the State Parties and if regulatory legal acts on these questions are not adopted, then before their acceptance - on regulations and according to the procedure, established by the legislation of the former USSR.

Article 5

Disputes over questions of exchange and sale of premises in cases, stipulated in Article 4 this agreements, are permitted by court of the State Party in the territory of which there are premises which are matter in issue.

Article 6

To the military personnel, citizens discharged from military service and members of their families in case of departure on the permanent residence from the territory of one on the territory other State Party by authorized bodies of the State Parties issue the document confirming the fact of delivery, privatization, exchange, sale or other actions made with the premises occupied by them with indication of time of their making. The issued documents are recognized the State Parties.

Article 7

The State Parties inform each other on the regulations existing in these states in the field of the housing legislation, and also perform permanent cooperation in case of the solution of questions of providing with premises of the military personnel, the citizens discharged from military service and members of their families.

Article 8

The questions connected using this agreement if necessary will be approved by authorized competent authorities of the State Parties on bilateral or multilateral basis.

Article 9

The agreement becomes effective from the date of receipt by depositary of the third notification on accomplishment by the State Parties of the interstate procedures necessary for its entry into force.

It is made in the city of Moscow on March 28, 1997 in one authentic copy in Russian. The authentic copy is stored in the Executive Secretariat of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.
