About some guarantees to the citizens undergoing compulsory military service, alternative service

For the purpose of increase in level of social security of the citizens undergoing compulsory military service, alternative service:

1. Determine that:

1.1. the citizens undergoing compulsory military service, alternative service are granted delay of return (repayment) of the credit (including preferential) on construction (reconstruction) or acquisition of premises and interest payment for use of this credit for the period of passing of such service by them (further - delay);

1.2. delay is granted from the date of the beginning of passing by the citizen of compulsory military service, alternative service about day of dismissal of the citizen from this service;

1.3. provision of delay is performed based on the supplementary agreement to the credit agreement on construction (reconstruction) or acquisition of premises (further - the credit agreement) in case of submission by the citizen undergoing compulsory military service, alternative service to bank of the certificate of the duty station and post in the standard form approved by the Ministry of Labour and Social Protection in coordination with the Ministry of Defence with indication of in it start dates of passing of compulsory military service, alternative service;

1.4. the supplementary agreement to the credit agreement at the choice of the citizen undergoing compulsory military service, alternative service consists or with prolongation of term of complete return (repayment) of the credit (including preferential) on construction (reconstruction) or acquisition of premises and interest payment for use of this credit for delay provision term, or without prolongation of term of complete return (repayment) of the specified credit and interest payment for use of it.

By provision to the citizens undergoing compulsory military service, alternative service, delays with prolongation of term of complete return (repayment) of the credit (including preferential) on construction (reconstruction) or acquisition of premises and interest payment for use of this credit for delay provision term charge by bank of such percent which are subject to payment by citizens during provision of delay is not made. Charge of these percent is performed by bank in the prolonged period of term of complete return (repayment) of the specified credit and interest payment;

1.5. in case of early dismissal from compulsory military service, alternative service, the conclusion of the contract on passing of military service the citizen who is granted delay within 10 days following behind day of dismissal (the conclusion of the contract) shall sign with bank the supplementary agreement to the credit agreement about delay cancellation;

1.6. the citizen who is granted delay in confirmation of the term of passing of compulsory military service shall provide to bank the certificate of the period of service, alternative service issued in the place of passing of compulsory military service, alternative service, in the standard form approved by the Ministry of Labour and Social Protection in coordination with the Ministry of Defence (further - the reference), in cases:

the conclusions of the supplementary agreement to the credit agreement about delay cancellation (in case of early dismissal from compulsory military service, alternative service, the conclusion of the contract on passing of military service);

dismissals from compulsory military service, alternative service.

The citizen who is granted delay submits within bank the reference within the following terms:

no later than day of the conclusion of the supplementary agreement to the credit agreement about delay cancellation (in case of early dismissal from compulsory military service, alternative service, the conclusion of the contract on passing of military service);

within 10 days following behind day of dismissal from compulsory military service, alternative service;

1.7. in case of non-presentation by the citizen of the reference in the cases specified in part one of subitem 1.6 of this Item, and in the terms determined in part two of subitem 1.6 of this Item and also in case of discrepancy of term of provision of delay to the actual term of compulsory military service, alternative service of the citizen confirmed with the reference, bank:

has the right to make recalculation to the subject debt repayment according to the credit agreement for the period of delay provision according to the procedure, established by the supplementary agreement to the credit agreement about delay provision and to demand from the citizen who is granted delay, payments of penalty in the amount of, determined by this agreement and not exceeding the size of penalty established by the credit agreement;

refunds expenses of the republican budget on compensation of losses of bank from provision of delay according to Regulations on procedure for compensation of losses of banks from provision to the citizens undergoing compulsory military service, alternative service, delays of return (repayment) of the credit (including preferential) on construction (reconstruction) or acquisition of premises and interest payment for use of this credit for the period of passing of such service by them approved by this Decree;

1.8. compensation of losses of banks from provision to the citizens undergoing compulsory military service, alternative service, delays is performed monthly at the expense of means of the republican budget in the amount of the refunding rate of National Bank which developed in the accounting period, increased by 3 annual interest rates during the entire period of passing of compulsory military service, alternative service.

2. Approve the enclosed Regulations on procedure for compensation of losses of banks from provision to the citizens undergoing compulsory military service, delays of return (repayment) of the credit (including preferential) on construction (reconstruction) or acquisition of premises and interest payment for use of this credit for the period of passing of such service by them, alternative service.

3. To provide to Council of Ministers of the Republic of Belarus financing of compensation of losses of banks from provision of delay at the expense of the means of the republican budget provided on these purposes.

4. This Decree becomes effective after its official publication.
