1. Approve the enclosed technical regulation "Requirements to Safety of Buildings and Constructions, Construction Materials and Products".

2. Ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 30.01.2017 No. 29

3. Recognize invalid:

1) the order of the Government of the Republic of Kazakhstan of February 4, 2008 No. 96 "About approval of the technical regulation "Safety of Construction Materials, Products and Designs" (SAPP of the Republic of Kazakhstan, 2008, No. 5, the Art. 53);

2) the order of the Government of the Republic of Kazakhstan of March 6, 2008 No. 227 "About approval of the technical regulation "Requirements to Safety of Buildings, Constructions and Adjacent Territories" (SAPP of the Republic of Kazakhstan, 2008, No. 12-13, of the Art. 122).

4. This resolution becomes effective after six months from the date of the first official publication.

Technical regulation "Requirements to Safety of Buildings and Constructions, Construction Materials and Products"

1. Scope

1. This technical regulation "Requirements to Safety of Buildings and Constructions, Construction Materials and Products" (further - the Technical regulation) is developed according to the Laws of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan", of November 9, 2004 "About technical regulation".

2. This technical regulation establishes the minimum requirements to safety of the construction objects and construction products at all stages of their lifecycle for the purpose of protection of life, human health and animals, property and environmental protection, and also the prevention of actions misleading consumers (users) concerning appointment and safety of construction objects and construction products, elimination of technical barriers in trade.

3. Subjects of this technical regulation are: buildings and constructions (further - construction objects), construction materials, products and designs (further - construction products), design processes, productions, transportations, storages, uses and post-utilizations of construction objects and construction products (lifecycle daleestadiya).

4. Identification of construction products is made by use of codes of the Commodity nomenclature of external economic activity (further - the Commodity Nomenclature of Foreign Economic Activity) and the codes corresponding to them on the National qualifier of products by types of economic activity of the Republic of Kazakhstan 04-2008, on marking and accompanying documents, on signs, parameters, indicators and requirements which are in total sufficient for recognition. The list of construction products concerning which safety requirements are established is given in appendix 1 to this Technical regulation.

5. Construction objects and the project documentation it is identified by the following rules:

1) the project documentation is identified by types and structure of town-planning and architectural and construction documentation depending on object and constructions are more whole and it is developed according to the customer's task for designing and specifications of the service providers on engineering and municipal support around expected construction constituted according to the procedure, established by the legislation in the sphere of architectural, town-planning and construction activities;

2) construction processes for creation of all types of three-dimensional, plane and linear capital objects (buildings, constructions and their complexes, communications), including the processing and engineering equipment relating to them, are identified by types of installation and construction works and are implemented according to the procedure, established by the Civil code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan";

3) the buildings and constructions realized in the market and put into operation are identified on functional purpose according to the project documentation or technical data sheet according to the Civil code of the Republic of Kazakhstan and the legislation in the sphere of architectural, town-planning and construction activities;

4) processes of operation of buildings and constructions depending on their functional purpose are identified on the basis of provisions of legal acts of the Republic of Kazakhstan and this Technical regulation;

5) engineering procedures of post-utilization of buildings (constructions) are identified according to the procedure, established by the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan" and solutions of local executive bodies.

6. Identification of construction objects and the project documentation is performed in the following cases:

1) in case of creation and the conclusion of contracts for order fulfillment on development of the project documentation;

2) in case of realization by the subject of the market of the project documentation for implementation of construction;

3) in case of creation and the conclusion of works agreements on implementation of construction works;

4) in case of realization in the market of the operated buildings and constructions passing from one owner to another;

5) in case of the delivery and acceptance for operation finished by construction of facilities;

6) in case of realization in the market of objects of construction in progress;

7) in case of delivery and acceptance of the objects of construction in progress subjected to preservation;

8) in case of operational and other control of technical condition of the building and construction;

9) in case of creation and the conclusion of lease agreements on buildings and constructions or on its certain rooms and sites;

10) in case of conclusion of the building and construction from operation or liquidation of object of construction in progress for the purpose of work on post-utilization.

7. Depending on identification tasks in case of the operated building and construction tool or visual examinations of object are conducted.

8. Identification of construction objects of technical regulation of this Technical regulation is carried out:

1) the customer investor of contract works in construction (including project, prospecting, expert, research works for construction, production of construction materials, products and designs by orders, production of installation and construction works);

2) the owner of real estate object in the form of the operated building and construction or object of construction in progress;

3) authorized bodies when implementing the state control and supervision within their competence.

9. The requirements established in this Technical regulation are obligatory and act on all territory of the Republic of Kazakhstan.

2. Terms and determinations

10. In this Technical regulation the following terms and determinations are applied:

1) control - the procedure of check on compliance to the established requirements;

2) the building - the artificial structure consisting from the bearing and protecting designs forming the obligatory land closed amount, depending on functional purpose used for accommodation or stay of people, accomplishment of production processes, and also placement and storage of material values. The building can have underground part;

3) the responsible user of the building and construction - physical person or legal entity (owners of buildings and constructions, except for owners of rooms (apartments), the physical persons and legal entities managing objects of condominium and other subjects to industrial and civil function), responsible for monitoring procedure of technical condition, maintenance and running repair of the building and construction;

4) manufacturer - the legal entity or physical person making construction products for the subsequent alienation or own consumption;

5) the artificial circle - the habitat created by the person for ensuring the activity;

6) real estate object (immovable object) - the same that construction;
