The agreement on cooperation in the field of protection of copyright and the related rights

of September 24, 1993

The State Parties of this agreement, hereinafter referred to as "State Parties",

proceeding from the principles and regulations of the Universal Declaration of Human Rights, Agreement on creation of the Commonwealth of Independent States of December 8, 1991, the Almaty declaration of December 21, 1991, the Memorandum of understanding concerning legal succession concerning the agreements of the former USSR which are of mutual interest of July 6, 1992,

considering modern role of copyright in forming of national cultural capacity, in the international cultural exchange, and also in development of equal interstate trade and economic relations,

aiming at further cooperation increase in the field of mutual exchange of cultural values by use of works of science, literature and art,

recognizing necessary to determine conditions and procedure for mutual protection of copyright and the related rights,

agreed as follows:

Article 1

The State Parties provide in the territories accomplishment of the international obligations following from participation of the former USSR in the World convention on copyright (in edition of 1952), that the date of entry into force of the specified Convention for the former USSR (on May 27, 1973) is date from which each State Party reads out itself connected it by provisions.

Each State Party will direct about it the necessary application to the Director-General of the United Nations for education, science and culture (UNESCO).

Article 2

The State Parties apply the World convention on copyright (in edition of 1952) in the relations among themselves as to the works created after May 27, 1973 and to the works protected by the legislation of the State Parties before this date on the same conditions which are established by the national legal system concerning the authors.

Terms of protection of copyright are established according to the legislation of that State Party which provides protection, however, it shall not provide protection during term more long, than the protection term established in other respective State Party.

Article 3

The State Parties will take necessary measures for development and adoption of the bills providing protection of copyright and the related rights at the level of requirements of the Bern convention on protection literary and works of art, the Geneva convention on protection of producers of soundtracks from not permitted reproduction of their soundtracks, the Roman convention on protection of the rights of actors contractors, producers of soundtracks, the organizations of TV and radio broadcasting.

Article 4

The State Parties will carry out joint operation on fight against illegal use of objects of copyright and the related rights and through the competent organizations will promote development of specific programs and actions.

Article 5

The State Parties will promote creation and functioning of the national author's and legal organizations in the field of management of copyright on collective basis, to the conclusion between these organizations of agreements on cooperation.

Article 6

The State Parties will provide the solution of questions of avoidance of double taxation of author's and other remuneration, determination of procedure for mutual calculations in the relevant agreements and will take measures for their timely implementation.

Article 7

This agreement is open for accession to it of other states which were earlier entering the former USSR.

This agreement becomes effective from the date of delivery to depositary of the third notification confirming accomplishment by the State Parties of the interstate procedures necessary for its introduction in force.

For other State Parties this agreement becomes effective from the date of receipt by depositary of the notification on accomplishment of these procedures by them.

The State Party can denounce this agreement in 12 months from the date of the written application to depositary about such intention.

It is made in the city of Moscow on September 24, 1993 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.

Notification of the Republic Georgia

Proves to be true present that the Republic Georgia joins the Agreement on cooperation in the field of protection of copyright and the related rights accepted at meeting of Council of heads of states of the Commonwealth of Independent States in Moscow on September 24, 1993.

It is made in Almaty on February 10, 1995.
