The State Parties of this agreement on behalf of the governments (further - the Parties),

being guided by the Agreement on creation of general scientific and technological space of the State Parties of the Commonwealth of Independent States of November 3, 1995,

considering the interlibrary subscription of the State Parties of the CIS as the most important instrument for ensuring of functioning of general information and scientific and technological space,

confirming commitment to obligations concerning human rights on open entry to information,

proceeding from mutual interest in development of cooperation in the interlibrary subscription and enhancement of the mechanism of mutual use of funds of libraries, documentary funds and bodies of information,

agreed as follows:

Article 1

1. The parties create system of the interlibrary subscription of the states of members of the CIS (further - SMBA) on the basis of interaction of the national MBA systems (further - NSMBA) and documentary funds.

2. The parties assign functions of coordination of interlibrary servicing in SMBA to the Russian state library.

Article 2

1. The parties according to their national legal systems take measures for creation and development effective NSMBA, the Parties providing for users the maximum availability of funds of libraries and bodies of information irrespective of their departmental accessory.

2. The parties determine parent organizations of the national NSMBA systems for implementation of coordination of activities of libraries and bodies of information. In the presence of several parent organizations one of them is allocated with functions of the national center of the interlibrary subscription bearing responsibility for scientific, methodical and organizational support and observance of requirements of SMBA.

3. The parties undertake obligations on legal and financial and economic support of NSMBA and the centers of the interlibrary subscription and development of SMBA on contractual basis.

Financing of works on coordination of interlibrary servicing in SMBA is performed at the expense of contributions of the national centers of the interlibrary subscription.

Article 3

The parties take agreed measures on ensuring interaction of NSMBA and free provision of documents and information for subscribers of the Parties.

Article 4

1. For implementation of this agreement in structure of Interstate committee on scientific technology development (further - MK scientific and technological revolution) creates Section. Functions, working bodies, residence and financing of activities of Section are determined by the Regulations on it approved by Interstate economic Committee of Economic union (further - MEK) by representation of MK scientific and technological revolution.

2. As first-priority measures for implementation of this agreement Section develops and represents in accordance with the established procedure to MEK:

a) drafts of normative legal documents on SMBA:

about standards of single SMBA (including the list of the documents sent on SMBA);

about ensuring safety of the sent documents;

about the amount of the customs duties on the directed documents;

about introduction of reduced post rates for transfer of documents;

b) offers on financial and economic mechanisms and system of mutual calculations and payments between libraries and bodies of information of the Parties.

3. Coordination of accomplishment of the works mentioned in this Article and control of their realization are exercised by MK scientific and technological revolution.

Article 5

Before development of the main documents regulating work of SMBA, the Parties will take measures on:

to provision according to their national legal systems on equivalent basis on requests of subscribers of documents in originals and copies from funds of libraries and bodies of information irrespective of their departmental accessory;

safety of the documents received on SMBA, and in case of causing damage - compensation according to requirements of the asset holder;

to observance of the unified procedures of the order and submission of documents;

to business correspondence concerning SMBA in Russian.

Article 6

Provisions of this agreement do not mention obligations assumed by the Parties according to other international treaties.

Article 7

The matters of argument connected using or interpretation of this agreement, are permitted by consultations and negotiations of concerned parties.

Article 8

Each Party can leave this agreement, having sent the written notice of it to depositary not later than 6 months to exit, having settled the obligations which arose during operation of the Agreement.

Article 9

Changes and additions by common consent of the Parties which are drawn up by separate protocols can be made to this agreement and stipulated in Article 11 Agreements become effective according to the procedure.

Article 10

This agreement is signed sine die.

Article 11

The agreement becomes effective from the date of its signing, and for the states which legislation requires accomplishment of the interstate procedures necessary for its entry into force, - from date of delivery of the relevant documents to depositary.

Article 12

This agreement is open for accession to it of other states sharing its purposes and the principles by transfer to depositary of documents on such accession.
