The state members of the Collective Security Treaty Organization (далееОДКБ, the Organization) which are hereinafter referred to as with the Parties
being guided by aspiration of enhancement of military and technical and military-economic state cooperation - organization members,
recognizing necessary creation of conditions for joint support of development and enterprise integration of defense industry of state members of the Organization,
agreed as follows:
For the purposes of this agreement mentioned below terms mean:
"military products" (further - PVN) - arms, military equipment, documentation, works, services, results of intellectual activities, including exclusive rights on them (intellectual property), and information in voyennotekhnichesky area, and also any other products carried by the national legal system, regulatory legal acts of the Parties to PVN;
"interstate science and production associations (joint businesses) on military production" (further - Associations) the companies (organization) of state members of the Organization which combined the scientific and technical, potential, intellectual and investment potentials for development, production, repair, upgrade and utilization of PVN.
Associations are created based on bilateral or multi-lateral agreements between concerned parties.
Questions of economic activity of the created Associations are determined by constituent documents according to the national legal system of the Party of registration of Consolidation.
Consolidation performs foreign trade activity with the Parties concerning PVN issued by it.
The right to implementation of foreign trade activity by it is granted according to the national legal system of the Party where Consolidation is registered as the legal entity.
Deliveries of PVN to state members of the Organization are performed on the basis of the Agreement on the basic principles of military and technical cooperation between the State Parties of the Agreement on collective security of the May 15, 1992 signed on June 20, 2000.
Concerning unconditional observance of provisions of the mentioned Agreement and control of target use of PVN delivered by Consolidation in gosudarstvachlena of the Organization, Consolidation interacts with authorized bodies of the Parties concerning military and technical cooperation.
To the third parties Consolidation performs deliveries of PVN according to the national legal system of the Party where it is registered as the legal entity.
The Associations PVN moved with the companies, and also the goods for production of PVN occurring from customs area of one Party and imported on customs area of other Party, intended for this Party are exempted from import customs duties.
The basis for such release is the list of PVN and goods for production approved by authorized bodies on military technically cooperation of the Parties PVN or the conclusion of this body of the Party of import that the imported PVN and/or goods intended for production of PVN are imported according to this agreement.
Activities of the companies entering Consolidation are subject to the taxation according to the national legal system of the Party where they are registered as the legal entity.
Creation of Associations does not interfere with preserving and development of cooperation bonds of the companies which entered Merging with the companies of the states, not being participants of this agreement who are performed on the terms of the corresponding international treaties.
Entry into Consolidation does not exclude the right of the companies to foreign trade activity according to the national legal system if other is not stipulated in constituent documents of Consolidation.
Protection of the data received during activities of Consolidation and which are the state secret (the state secrets) is performed according to the Agreement on mutual ensuring safety of the classified information within the Collective Security Treaty Organization of June 18, 2004 and the national legal system of the Parties.
The parties provide protection of intellectual property, the Associations used and received in the course of activities, according to the Agreement on mutual protection of the rights to the results of intellectual activities received and used during military-economic cooperation within the Collective Security Treaty Organization of October 6, 2007 and international treaties which participants are the Parties, and the national legal system of the Parties.
Disputes and disagreements on interpretation and application of provisions of this agreement are permitted by consultations and negotiations between concerned parties.
In the consent of the Parties changes and additions which are its integral part which are drawn up by the relevant protocol can be made to this agreement and become effective according to the procedure, stipulated in Article the 15th this agreement.
This agreement becomes effective from the date of delivery on storage to depositary of the fourth written notice of accomplishment by the Parties of the interstate procedures necessary for its introduction which signed it in force.
For the Parties which performed necessary interstate procedures later this agreement becomes effective from the date of delivery of the relevant documents to depositary.
