About some questions of customs regulation

For the purpose of ensuring application in the Republic of Belarus Agreements on the Customs Code of the Customs Union of November 27, 2009, other international treaties of state members of the Customs union within the Eurasian economic community, decisions of the Commission of the Customs union and the Eurasian economic commission regulating customs legal relationship in the Customs union I decide:

1. No. 380 is excluded according to the Presidential decree of the Republic of Belarus of 28.07.2014

2. No. 490 is excluded according to the Presidential decree of the Republic of Belarus of 22.12.2018

3. Make changes and addition to the following presidential decrees of the Republic of Belarus:

3.1. subitem 8.7 of Item 8 of the Regulations on Department of protection of the Ministry of Internal Affairs of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of June 4, 2004 No. 268 "About some questions of law-enforcement bodies of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2004, No. 91, 1/5581; 2007, No. 262, 1/9048) to state in the following edition:

"8.7. renders services in maintenance (the customs escort obligatory for maintenance) of the goods and (or) vehicles moved on the territory of the Republic of Belarus with road transport;";

3.2. in the Presidential decree of the Republic of Belarus of July 13, 2006 No. 443 "About customs fees" (The national register of legal acts of the Republic of Belarus, 2006, No. 112, 1/7742; 2007, No. 224, 1/8894; 2010, No. 28, 1/11354):

3.2.1. in Item 1:

in subitem 1.1:

state paragraph two in the following edition:

"making of customs transactions;";

the fourth to exclude the paragraph;

3.2.2. in Item 2 of figure "1-7" to replace with figures "1-5, 7";

3.2.3. in appendix 1 to this Decree:

"Rates of customs duties for making of customs transactions concerning the goods moved through customs border (except goods for private use)";

"The commodity nomenclature of foreign economic activity of the Republic of Belarus" shall be replaced with words words "the single Commodity nomenclature of foreign economic activity of the Customs union";

the words "customs clearance" shall be replaced with words "making of customs transactions";

exclude the column "Rate of Customs Duty for Customs Clearance out of the Places Determined for This Purpose and (or) Working Hours of Customs Authority, in Euro Equivalent";

3.3. in Item 8 of the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 21, 2008 No. 228 "About some questions of customs authorities" (The national register of legal acts of the Republic of Belarus, 2008, No. 105, 1/9651):

3.3.1. state subitem 8.13 in the following edition:

"8.13. performs maintaining registers of customs representatives, customs carriers, owners of warehouses of temporary storage, owners of customs warehouses, owners of the duty-free shops, intellectual property items, banks and non-bank financial credit institutions recognized by customs authorities guarantors of customs payment, Authorized Economic Operators;";

3.3.2. in subitem 8.22 the word "features" shall be replaced with words "procedure for application and production";

3.3.3. state subitem 8.44 in the following edition:

"8.44. makes inclusion of legal entities in registers of customs representatives, customs carriers, owners of warehouses of temporary storage, owners of customs warehouses, owners of duty-free shops and exception of persons performing activities in the field of customs affairs from these registers; determines procedure for forming and maintaining registers of customs representatives, customs carriers, owners of warehouses of temporary storage, owners of customs warehouses, owners of duty-free shops; determines procedure for issue and cancellation of the competence certificate of the specialist in customs clearance;";

3.3.4. add Item with subitem 8.60 of the following content:

"8.60. gives to legal entities the status of Authorized Economic Operator; grants and withdraws certificates on inclusion in the register of Authorized Economic Operators and their duplicates, makes changes and (or) additions to these certificates; determines procedure for forming and maintaining the register of Authorized Economic Operators.";
