About bases of the town-planning legislation of the Kyrgyz Republic

This Law establishes the general beginnings of town-planning activities and is aimed at providing development of territorial systems of resettlement of administrative and territorial units taking into account rational creation of favorable living environment of the person, environmental management and placement of productive forces in the territory of the Kyrgyz Republic.
Public administration in the field of architectural and construction activities is exercised of the Government of the Kyrgyz Republic.
Development of policy in the field of architectural and construction activities, and also control and supervision in the specified area are performed by the authorized state bodies determined by the Government of the Kyrgyz Republic.
Authorized state body on development and realization of policy in the field of architectural and construction activities - the executive body authorized by the Government of the Kyrgyz Republic to perform regulation of the relations in architectural and construction area.
Authorized state body on supervision and control in the field of architectural and construction activities - the executive body authorized by the Government of the Kyrgyz Republic to perform functions of architectural and construction supervision and control.
1. The authorized state body on development and realization of policy in the field of architectural and construction activities performs:
1) project development of regulatory legal acts in the field of arkhitekturnostroitelny activities;
2) the forecasting, design and regulation of system of resettlement determining placement of productive forces, forming of engineering, transport, social infrastructures taking into account ecological state of environment;
3) development of concepts and determination of the main operating conditions of administrative and territorial units in interaction with the environment;
4) development of town-planning decisions according to the layout, building, reconstruction and improvement of administrative and territorial units;
5) preserving and recovery of historical and cultural heritage, monuments of town planning, architecture and monumental art, landscapes and other protected territories;
6) creation of system of complex preparation of professional personnel in the field of town planning;
7) the interconnected development of housing, public and business asset in case of the advancing development of engineering and transport infrastructure;
8) creation of fundamental research and applied base of development of all directions of town planning in the Kyrgyz Republic;
9) examination of the design estimates on construction and other construction changes of real estate objects according to the procedure, established by the Government of the Kyrgyz Republic;
10) management of all types of town-planning and architectural process.
2. The authorized state body on supervision and control in the field of architectural and construction activities performs:
1) control of quality of construction processes;
2) control of observance of the established regulations, rules, programs, schemes, plans and projects in the field of architectural and construction process;
3) control of ensuring with subjects construction activities of requirements for safety of the population, the territories and settlements from impact of the dangerous (harmful) natural and technogenic, anthropogenous phenomena and processes;
4) assessment of conformity put into operation completed by asset construction.
The legislation of the Kyrgyz Republic on architecture and town planning is based on the Constitution of the Kyrgyz Republic, consists of this Law and other regulatory legal acts of the Kyrgyz Republic, and also international treaties which took legal effect in the procedure established by the law which participant is the Kyrgyz Republic.
1. This Law extends to citizens of the Kyrgyz Republic, foreign citizens and stateless persons, constantly or temporarily living in the territory of the Kyrgyz Republic, and the legal entities performing town-planning activities and using its results.
2. The relations of designers, builders, operators and other participants of town-planning activities are regulated by the corresponding regulatory legal acts of the Kyrgyz Republic.
Subject of town-planning legal relationship is planning, functioning, management and other changes of the living environment and life activity of the person as a result of all types of town-planning activities.
Objects of town-planning activities are:
1) systems of the territorial organization of resettlement;
2) systems of placement territorial and production (agro-industrial, hydrotechnical, industrial) complexes, recreational, nature protection and other zones;
3) administrative and territorial units and their systems;
4) town-planning, architectural, landscape complexes, ensembles, buildings, constructions, historical and cultural monuments;
5) infrastructure, engineering and road and transport constructions and communications.
1. Subjects of town-planning legal relationship in the Kyrgyz Republic are:
1) citizens and their associations;
2) state bodies and local government bodies;
3) legal entities, irrespective of legal forms and patterns of ownership, the enabling development and the realization of town-planning documentation.
2. Foreign citizens and foreign legal entities can be given the accomplishment right in the territory of the Kyrgyz Republic of works (services) in the field of architectural and town-planning activities in the procedure established by the legislation of the Kyrgyz Republic.
The principles of town-planning activities are:
1) legality;
2) ensuring realization of the rights and obligations of each of participants of town-planning process;
3) priority of ecological and social conditions of forming and development of administrativnoterritorialny units and their systems;
4) publicity and accounting of public opinion in decision making in the course of town-planning activities;
