The government of the Russian Federation and the Government of Turkmenistan which are hereinafter referred to as by the Parties

being guided by regulations of the Agreement between the Government of the Russian Federation and the Government of Turkmenistan on cooperation in the field of culture, science and education of May 18, 1995,

proceeding from desire of further development of friendship between two countries, strengthenings of historical and cultural ties between two people,

including development of education by the most important condition of cultural interaction and cooperation of two countries,

agreed as follows:

Article 1

The parties open joint Russian-Turkmen high comprehensive school of name Ampere-second in the city of Ashgabat. Pushkina (further referred to as "School") for providing children of the citizens of the Russian Federation living in Turkmenistan and children of citizens of Turkmenistan conditions for receipt of the main general and secondary (complete) general education according to the state educational standards of the Russian Federation.

Article 2

For placement of School the Turkmen Side provides to the Russian Side in use for the duration of this agreement without collection of the rent the building with the school territory located in the city of Ashgabat undertakes payment of utilities (payment for gas, water and the electric power).

Article 3

Material logistics of educational process of School is performed within the means provided to the Ministry of Education of the Russian Federation in the federal budget for the corresponding year on education.

Article 4

The school performs routine maintenance and overhaul repairs of the building due to attraction of financial resources of sponsors.

Article 5

The parties authorize to coordinate activities of School concerning regulation in the place of its arrangement, financing, planning and the organization of educational process:

from the Russian Side - the Ministry of Education of the Russian Federation,

from the Turkmen Side - the Ministry of Education of Turkmenistan.

Authorized bodies of the Parties perform licensing of School, the approved carrying out its certification and the state accreditation providing the right of issue by School of education documents of the state sample.

Article 6

The school in the activities is guided by regulations on it and the Charter approved by the Ministries of Education of the states of the Parties and realizes the Russian general education programs of the primary general, main general and secondary (complete) general education according to the training terms established in the Russian Federation.

Article 7

Training at School is performed in Russian on the basis of the curriculum constituted with observance of standard rates of the approximate curriculum of educational institutions of the Russian Federation, with obligatory inclusion in it of objects of public disciplines and Turkmen according to the basic curriculum of high schools of Turkmenistan.

Article 8

In School for training at budget basis children of the citizens of the Russian Federation living in Turkmenistan and citizens of Turkmenistan are accepted in equal quantity.

Article 9

In addition to training of pupils at budget basis enrollment of pupils of pupils on training at contractual basis, including citizens of other states is allowed.

Any forms of the sponsor's and trustee help to School as are permitted from parents of pupils, and the Russian, Turkmen and foreign legal entities and physical persons.

Article 10

Development of general education programs of the main general and secondary (complete) general education at School comes to the end with obligatory state (final) certification of graduates. The certificate about the main general education, the certificate about the secondary (complete) general education which are recognized in the territory of both states is issued to the graduates who underwent the state (final) certification.

Article 11

The quantity of classes at School is determined by the Ministry of Education of the Russian Federation in coordination with the Ministry of Education of Turkmenistan proceeding from requirements, conditions and the sanitary standards necessary for implementation of educational process.

Article 12

The list of heads and pedagogical workers, educational support personnel of School is created of citizens of the Russian Federation and Turkmenistan on the basis of terminal employment contracts according to the legislation of Turkmenistan.

Appointment of the principal is made by the Ministry of Education of the Russian Federation in coordination with the Ministry of Education of Turkmenistan.

Article 13

At the time of creation the School is completed from teaching and technicians, and also school enrollment of the former comprehensive school for children of the military personnel of Task force Boundary troops of the Russian Federation in Turkmenistan.

Article 14

Financial accounting and the reporting of School are performed according to the plan of accounts of budget accounting of the Russian Federation and Turkmenistan. To the positions connected with financial responsibility of School citizens of the Russian Federation are accepted.

Article 15

Disputes on interpretation and accomplishment of this agreement are subject to permission by consultations and negotiations between the Parties.

Article 16

As agreed by the parties changes and additions which are drawn up in the form of protocols which become integral part of this agreement can be made to the Agreement and become effective according to the procedure, provided for this agreement.

Article 17

This agreement becomes effective from the date of its signing.

This agreement is signed for a period of five years and will be prolonged automatically for the subsequent five-year periods if any of the Parties does not notify in writing other Party at least in six months prior to the expiration of the corresponding period on the intention to stop its action.

It is made in Moscow on January 21, 2002 in duplicate, everyone in the Russian and Turkmen languages, and both texts are equally authoritative.
