The agreement between the Government of the Russian Federation and the Government of the Azerbaijan Republic on cooperative principles and conditions of relations in the field of transport

of July 14, 1993

The government of the Russian Federation and the Government of the Azerbaijan Republic which are hereinafter referred to as by the Parties

being guided by aspiration to further development of cooperation in the field of transport,

wishing to facilitate implementation of freight and passenger traffic between both countries, and also transit across their territories to the third countries,

agreed as follows:

Article 1.

The parties will develop and deepen mutual economic and sci-tech cooperation in the field of all modes of transport.

Article 2.

Each of the Parties provides in the territory on the principles of reciprocity favorable conditions for functioning of all modes of transport of other Party transporting passengers and loads between both countries and transit across their territories.

Article 3.

The transportations of passengers and loads performed by carriers of one of the Parties on the territory of other Party based on this agreement and also the vehicles which are carrying out these transportations are exempted from taxes and the state charges connected with use or content of roads and other means of communication, ownership or use of vehicles, and also taxes and fees on the income and profit received from transportations.

Article 4.

1. The parties keep the existing rules, provisions, instructions, standards and specifications regulating work of transport.

2. Change, and also introduction of the new regulating documents infringing on interests of other Party are made under approval between competent authorities of the Parties.

3. The parties will aim to provide standardization of the transport legislation existing in their territories.

Article 5.

The organization of transportation of goods and passengers and transit across their territories will be performed by railway, air, water and road transport between both countries on the basis of the agreements signed by the Ministry of Transport of the Russian Federation (regarding the organization of rail haulings - the Ministry of Railways of the Russian Federation) and Management of the Azerbaijani railroad (regarding rail transport), Azerbaijan Hava of Yollara State concern (regarding air transport), the Caspian sea shipping company (regarding sea transport) and Azeravtonagliyyat State concern of the Azerbaijan Republic (regarding road transport).

Article 6.

1. The parties keep the operating procedure of international carriages established by international treaties in the field of transport which participant was the USSR.

2. Each of the Parties in case of the conclusion with the third countries of the agreements in the field of transport changing the procedure established by the agreements specified in Item 1 of this Article will inform on it other Party.

Article 7.

1. The parties will promote development of direct commercial ties of transport enterprises and organizations of both countries and creation of joint businesses in the field of transport.

2. The parties will help cooperation of the companies of both countries in the field of production and repair of vehicles.

Article 8.

The parties will help cooperation in the field of training of engineers, technicians and specialists of mass professions of transport, proceeding from single requirements to the level of their preparation.

The qualification documents in the field of transport issued upon termination of educational institution are recognized in the territories of both Parties.

Article 9.

Calculations and payments between transport organizations and firms of both Parties will be made according to the agreements on calculations and payments existing between the Parties.

Article 10.

The questions which are not settled by this agreement, and also international treaties which participants are both Parties will be solved according to the domestic legislation of each of the Parties.

Article 11.

For the purpose of ensuring accomplishment of this agreement, and also in case of difficulties in transportations between both countries the Ministry of Transport of the Russian Federation (and regarding the organization of rail haulings - the Ministry of Railways of the Russian Federation) and Management of the Azerbaijani railroad (regarding rail transport), Azerbaijan Hava of Yollara State concern (regarding air transport), the Caspian sea shipping company (regarding sea transport) and Azeravtonagliyyat State concern of the Azerbaijan Republic (regarding road transport) will be performed by direct contacts and to hold, as required, bilateral meetings for development of mutually acceptable decisions.

Article 12.

This agreement becomes effective from the date of exchange of the notifications confirming accomplishment of the interstate procedures by the Parties necessary for its entry into force and will be effective before the expiration of 90 days from the date of when one of the Parties reports other Party by the written notice of the intention to terminate this agreement.

It is made in Moscow on July 14, 1993 in duplicate, everyone in the Russian and Azerbaijani languages, and both texts are equally authoritative.
