About measures for further increase in the list and sales amounts of exclusive types of products through the commodity and raw exchange

For the purpose of further increase in the list and sales amounts through the commodity and raw exchange of exclusive types of products, raw materials and materials, and also for subjects of small business to them and private entrepreneurship the Cabinet of Ministers decides expansions of access:

1. Agree with the offer of the Ministry of Economics, State committee of the Republic of Uzbekistan on demonopolization and development of the competition, JSC Uzbek Republican Commodity and Raw Exchange on approval of the list of additional exclusive types of products with determination of the minimum amount of their exposure to the exchange biddings, according to the appendix N 1.

2. Determine that since July 1, 2011:

realization of the exclusive types of products included in appendix N 1, is performed according to the Section I of the Regulations on special procedure for realization of strategic types of material resources approved by the resolution of the Cabinet of Ministers of February 5, 2004 N 57;

the manufacturing organizations perform obligatory exposure to the exchange biddings of exclusive types of products, according to the appendix N 1 to this resolution, except for amounts on which agreements for 2011, without the right of their prolongation are signed;

the exclusive types of products specified in appendix N 1, acquired at the exchange biddings, are used only for own needs, production and resale are not subject.

In case of identification of the facts of resale of the resources specified in appendix No. 1 to this resolution, acquired by consumers at the exchange biddings, that the gained income from resale is withdrawn according to the procedure provided by the resolution of the Cabinet of Ministers of October 28, 2010 No. 239 "About measures for further enhancement of procedure for declaring (approval) and establishment of regulated prices (rates) for goods (works, services).

The heads of the companies who allowed the facts of resale of resources bear responsibility in the procedure established by the legislation.

3. Enter since July 1, 2011 procedure according to which amounts of the strategic and exclusive types of products specified in the appendix N 1 to this resolution, and also in appendices No. No. 1 and 2 to the resolution of the Cabinet of Ministers of February 5, 2004 No. 57, not implemented following the results of calendar month according to direct export agreements and on the domestic market, are subject to obligatory exposure by the manufacturing organizations (sellers) to the exchange biddings.

4. Approve offers of JSC Uzbek Republican Tovarnosyryevy Exchange, the Ministry of Economics, the State committee on demonopolization and development of the competition and the State Property Committee of the Republic of Uzbekistan on modification of the Rules of stock exchange trading directed to enhancement of the mechanism of access for the participants to the exchange biddings using the taken highly liquid and exclusive forms of products for own production needs.

5. Make changes and additions to the Regulations on special procedure for realization of strategic types of material resources approved by the resolution of the Cabinet of Ministers of February 5, 2004 N 57 (the joint venture of the Republic of Uzbekistan, 2004, N 2, the Art. 10), according to the appendix N 2.

6. To the Ministry of Economics together with the State committee on demonopolization and development of the competition, the Ministry of Justice of the Republic of Uzbekistan, JSC Uzbek Republican Commodity and Raw Exchange interested in the ministries and departments in a month to make offers on the changes and amendments in the legislation following from this resolution.

7. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.
