For the purpose of providing with customs authorities the Russian Federation protection of the rights to intellectual property items on customs area of the Customs union and according to provisions of Articles 331, 332, 333 Customs Code of the Customs Union (The Federal Law of June 2, 2010 No. 114-FZ "About ratification of the Agreement on the Customs Code of the Customs Union" (The Russian Federation Code, 2010, No. 23, the Art. 2796), Articles 308, 309, 310 Federal Laws of November 27, 2010 No. 311-FZ "About customs regulation in the Russian Federation" (The Russian Federation Code, 2010, No. 48, the Art. 6252), Item 5.2.4 of the Regulations on the Federal Customs Service approved by the Order of the Government of the Russian Federation of July 26, 2006 No. 459 (The Russian Federation Code, 2006, No. 32, Art. 3569; 2008, No. 17, Art. 1883, No. 24, Art. 2867, No. 46, Art. 5337; 2009, No. 6, Art. 738, No. 12, Art. 1429; 2010, to No. 9, of the Art. 967, No. 26, of the Art. 3350, No. 52 (p. I), the Art. 7080), I order:

1. Approve the enclosed operations procedure of customs authorities of the Russian Federation when taking measures to protection of the rights to intellectual property items.

2. To impose control of execution of this Order on the deputy manager of FCS of Russia S. O. Shokhin.

I. General provisions

1. The operations procedure of customs authorities of the Russian Federation when taking measures to protection of the rights to intellectual property items (further - the Procedure) is developed according to provisions of Articles 331, of 332, 333 Customs Code of the Customs Union (The Federal Law of June 2, 2010 No. 114-FZ "About ratification of the Agreement on the Customs Code of the Customs Union" (The Russian Federation Code, 2010, No. 23, the Art. 2796)) (further - the Code) and Articles 308, of 309, 310 Federal Laws of November 27, 2010 No. 311-FZ "About customs regulation in the Russian Federation" (The Russian Federation Code, 2010, No. 48, the Art. 6252) (further - the Law), the civil legislation of the Russian Federation, and also international treaties and other obligations of the Russian Federation for the purpose of ensuring uniform approach when implementing protection of intellectual property rights and counteractions to illicit trafficking in the goods containing intellectual property items.
