About approval of the Procedure for development of the project documentation on construction of facilities

In pursuance of part one of article 31 of the Law of Ukraine "On regulation of town-planning activities" PRIKAZYVAYU:

1. Approve the Procedure for development of the project documentation on construction of facilities which is applied.

2. To the deputy minister Isayenko D. V.:

2.1. Submit in accordance with the established procedure this order on state registration to the Ministry of Justice of Ukraine;

2.2. Bring this order to permission to the interested organizations.

3. To impose control over the implementation of this order on the deputy minister Isayenko D. V.

4. This order becomes effective from the date of its official publication.

Procedure for development of the project documentation on construction of facilities

1. In this Procedure terms are used in such value:

the author of the project - the architect or the engineer who is developer of the approved project;

construction - new construction, reconstruction, restoration and major repair of construction objects;

the general designer (further - the general designer) the designer who in the consent of the customer involves in performance of works of the third parties (subdesigners);

the chief architect of the project (further - GAP) - the architect who has the qualification certificate and performs work on architectural volume designing heads and/or coordinates development of separate Sections of the project documentation;

the chief project engineer (further - GIP) - the engineer who has the qualification certificate of the design engineer on construction designing except certificates on observance of requirements of safety of life and health of the person, protection of the surrounding environment, accomplishment of engineering researches, estimate documentation, technology of construction production, and performs work on construction designing, heads and/or coordinates development of separate Sections of the project documentation;

adjustment of the project documentation - modification of the approved (approved) construction project based on task for adjustment (further - design assignment);

construction object - houses, buildings, constructions of any assignment, their complexes and/or parts, linear objects of engineering and transport infrastructure;

project works - the works connected with creation of the project documentation for construction objects;

the designer - the legal entity incorporating the corresponding contractors who according to the legislation received the qualification certificate confirming capability of performance of works on objects of the corresponding class of effects (responsibility) or physical person which according to the legislation has such qualification certificate (further the certified contractor);

the subcontract designer (further - the subdesigner) the designer who according to the procedure, defined by the works agreement and based on the agreement of the sub contracting signed with the general designer is involved in performance of works.

object - the house, the building, construction, their part, linear object of engineering and transport infrastructure;

complex (structure) - set of buildings, structures, constructions of any assignment, linear objects of engineering and transport infrastructure which construction is performed according to the single project documentation;

the copy of design assignment, the project documentation created in electronic form - the file containing the data set identical to the corresponding original of the electronic document.

Other terms are applied in the values given in the Budget code of Ukraine, the Laws of Ukraine "On regulation of town-planning activities", "About architectural activities", "About investing activities", "About construction regulations", "About environmental impact assessment", "About electronic documents and electronic document management", "About electronic confidential services".

2. This Procedure determines the procedure of development of the project documentation on construction of facilities and extends to subjects of town-planning.

3. For ensuring designing of construction object the customer shall provide to the general designer (designer) basic data on designing.

4. The main components of outgoing data are:

town-planning conditions and restrictions;

specifications;

design assignment.

4.1. The design assignment of construction objects is constituted taking into account requirements of the state construction regulations of GSN A.2.2-3:2014 "Structure and contents of the project documentation on construction" and affirms the customer in coordination with the general designer (designer).

Design assignments can be created in electronic form with observance of requirements of the Law of Ukraine "About electronic documents and electronic document management" with the subsequent approval by his customer in coordination with the general designer (customer) by imposing of the digital signature based on the qualified digital signature certificate of the customer and general designer (designer).

The copy of design assignment is loaded by the general designer (designer) through electronic office of the user of Single state electronic system in the field of construction (further - electronic office of Electronic system) into the Register of construction activities of Single state electronic system in the field of construction (further - the Register of construction activities) according to the Procedure for maintaining Single state electronic system in the field of construction approved by the resolution of the Cabinet of Ministers of Ukraine of June 23, 2021 No. 681. On copy of design assignment the digital signature which is based on the qualified digital signature certificate of responsible persons who signed design assignment, with use of software of electronic system is imposed.
