The Ministry of Internal Affairs of the Russian Federation and the State committee of Ukraine for nationalities and the migrations which are hereinafter referred to as by the Parties

attaching importance to development and strengthening of mutually beneficial cooperation in the field of regulation of migratory processes, and also to ensuring protection of human rights and freedoms,

aiming to develop effective forms of interaction of the Parties and to promote the operational solution of questions of cooperation and expansion of professional bonds,

agreed as follows:

Article 1

The parties perform cooperation in the field of migration according to provisions of this agreement, being effective within the competence, with compliance with law and the international obligations of the states.

Article 2

The parties perform cooperation in the following main directions:

- protection of the rights of migrants;

- immigration control and prevention of illegal migration;

- shelter questions;

- external labor migration;

- cooperation at the international level (including regional cooperation).

Article 3

The parties exchange experience in the field of regulation of migratory processes, including perform:

- acquaintance with activities of the central and territorial authorities of the Parties;

- experience exchange on creation of information systems and maintaining databanks in the field of migration.

For this purpose according to the mutual arrangement of the Parties conferences and seminars on increase in professional level of specialists are held.

Article 4

The parties inform each other on the national legal system regulating questions of internal and external migration, including labor, provisions of shelter, resettlement, and also implementation of immigration control and prevention of illegal migration.

Article 5

The parties perform on mutual basis exchange of scientific information in the field of migration, including - methodical materials and results of the conducted researches, hold joint symposiums and scientific conferences.

Article 6

The parties regularly on mutual basis perform exchange of information and analytical materials, statistical data and other data in the field of migration, and also information on the directions of the activities.

Provision of information within this agreement is made on own initiative or based on request of other Party.

Article 7

Coordination of actions for cooperation of the Parties within this agreement is assigned:

from the Russian Side - on the Federal Migration Service of the Ministry of Internal Affairs of the Russian Federation,

from the Ukrainian Side - on Management for refugees and migration of the State committee of Ukraine for nationalities and migration.

The parties determine the structural divisions which can come into direct contacts in pursuance of provisions of this agreement.

Article 8

Agents of the parties if necessary hold working meetings and consultations for the purpose of consideration of questions of increase in efficiency of cooperation based on this agreement.

For coordination of actions of the Parties within the specific actions working groups can be created.

Article 9

The parties perform cooperation and hold consultations with the purpose of approval of the line items within participation in work of the universal and regional international organizations and forums concerning population shift.

Special attention of the Party is paid to consideration of problems of forced and illegal migration, and also development of joint efforts of counteraction of illegal migration.

Article 10

This agreement does not interfere with the Parties in determination and development of other mutually acceptable directions and forms of cooperation taking into account the conditions determined in Article 1 of this agreement.

Article 11

The parties independently incur expenses which will arise during implementation of this agreement if other procedure is not established.

Article 12

All matters of argument connected using or interpretation of provisions of this agreement, the Parties solve by consultations and negotiations.

Article 13

Changes and additions are made to this agreement by mutual consent of the Parties and drawn up by Protocols which will be integral parts of this agreement.

Article 14

The parties when implementing cooperation use Russian and Ukrainian languages.

Article 15

This agreement does not mention obligations of the Parties according to other international treaties which participants are the Russian Federation and Ukraine.

Article 16

This agreement becomes effective from the date of its signing and will be effective before the expiration of three months from the date of when one of the Parties receives the written notice of other Party of its intention to stop its action.

In case of cancellation of this agreement of its provision continue to be applied to all incomplete actions performed according to this agreement.

It is made in Yalta on July 18, 2003 in duplicate, everyone in the Russian and Ukrainian languages, and both texts are equally authoritative.
