1. Approve the Order of registration of agreements of reinsurance it (is applied).

2. To provide to department of registration, licensing and allowing procedures together with department of legal providing submission of this order to the Ministry of Justice of Ukraine for state registration.

3. To department organizational and analytical, documentary and staffing to provide placement of this order on the official site of State commission on regulation of the markets of financial services of Ukraine on the Internet after its state registration.

4. Control over the implementation of this order to assign to the vice-chairman according to distribution of obligations.

5. This order becomes effective from the date of its official publication.

Order of registration of agreements of reinsurance

1. This Procedure is developed according to article 12 of the Law of Ukraine "About insurance".

2. The insurer (the assignor, the reinsurer) - resident (dalshezayavitel) in Natskomfinuslug are registered:

the contracts of reinsurance signed with insurers (overcautious persons) - nonresidents, including with participation of insurance and/or reinsurance brokers;

the agreement of reinsurance (agreements of reinsurance) signed (concluded) with the insurer (overcautious person) - the resident if the amount (amounts) reinsurance (reinsurance) payment (payments) under all agreements of reinsurance signed with the same insurer (overcautious person) - the resident, equals (equal) or exceeds (exceed) within calendar year totally 1 000 000 hryvnias.

Other agreements of reinsurance are subject to registration at the insurer (overcautious person) and the insurer (the assignor, the reinsurer).

3. For registration of agreements of reinsurance Zayavitel submits to Natskomfinuslug the application for registration of the agreement of reinsurance according to appendix 1 to this Procedure (further - the Statement) and the copies of agreements of reinsurance certified by impress of a seal and the signature of the head or authorized person Zayavitelya (with provision of the relevant document which certifies right to sign of the authorized person).

Copies of agreements of reinsurance on two and more pages shall be stitched and contain end-to-end numbering of pages.

4. In case of the conclusion of the agreement of reinsurance which according to paragraphs to the first - third Item 2 of this Procedure is subject to registration with the insurer (overcautious person) - the nonresident Zayavitel within ninety calendar days from the date of the conclusion of the agreement sends to Natskomfinuslug (together with the Statement) for registration of the copy of contracts of reinsurance with insurers (overcautious persons) - nonresidents in triplicate, one of which shall be certified notarially, and two others are certified by impress of a seal and the signature of the head or authorized person Zayavitelya (on condition of provision of the relevant document which certifies right to sign of the authorized person).

In case of achievement or excess of the amount of the made reinsurance payment (reinsurance payments) of 1 000 000 hryvnias under the agreement (agreements) of reinsurance signed (concluded) with the same insurer (overcautious person) - the resident within ten working days from day of such achievement and/or excess Zayavitel sends to Natskomfinuslug (together with the Statement) for registration of the copy of agreements of reinsurance (together with all changes (in the presence)) with the insurer (overcautious person) - the resident in duplicate, certified by impress of a seal and the signature of the head or authorized person Zayavitelya (on condition of provision of the relevant document which certifies right to sign of the authorized person).

The agreements of reinsurance specified in the paragraph the second this Item are subject to registration in case of achievement or excess within calendar year of the amount of the made reinsurance payment (reinsurance payments) of 1 000 000 hryvnias, 2 000 000 hryvnias and all other amounts which are multiple 1 000 000 hryvnias.

The statement shall be attached to one of the copies of the agreement of reinsurance certified by impress of a seal and the signature of the head or authorized person Zayavitelya (on condition of provision of the relevant document which certifies right to sign of the authorized person), and is stitched together with this copy and all changes (in the presence).

5. By results of consideration of the agreements of reinsurance submitted on registration within ten working days from the date of registration of a statement the authorized persons of Natskomfinuslug determined by the order of the Chairman Natskomfinuslug register the agreement of reinsurance or leave it without registration what to the Applicant it is reported in writing within ten working days from the date of registration of a statement about.

6. In case of registration of the agreement of reinsurance on the title page of each copy of the copy of the agreement of reinsurance the text becomes or the stamp with text about date and number of registration which sample is given in appendix 2 to this Procedure is put down, and the mark in the magazine of registration of agreements of reinsurance becomes.

8. Agreements of reinsurance which are subject to registration in Natskomfinuslug concluded with insurers (overcautious persons) residents, shall meet general requirements to the agreements established by the Civil code of Ukraine, other laws taking into account features, in particular relatively:

subject of the agreement of reinsurance;

the size of insurance sum under the agreement of reinsurance (responsibility limit);

list of insured events;

size of reinsurance payments and terms of their payment;

reinsurance rate;
